ARCHITECTS August 23, 1983 Mr. William Dreuding Aspen/Pitkin County Building Department 506 East Mai n St reet Aspen, Colorado 81611 RE: RED ONION OFFICES BOARD OF ADJUSTMENT APPLICATION Dear Bill: We are asking the Board of Adjustment for a variance to exceed the Floor Area requi rement of the zone by 250 square feet. This enti re area of 250 square feet is constituted by a "Garden" which lies at the center of the Red Onion Offices. Our "hardship" derives from the fact that we were encouraged to pursue the "Garden" concept by Building Department Officials (see Gibson & Reno letter of August 9, 1983) and only later told that we could not gain approval without a variance. At this point Construction Drawings were completed, a Contract for Construction awarded (Hunter Construction Corp.) and demolition was under way. The "Garden" area .serves several beneficial solar purposes: 1. As a bio-mass heat collection and retention area. 2. As a humidifier of the inside environment. 3. As a daylighting mechanism for the adjacent offices. These three solar features are intensified by use of a "Skylid" system which increases the heat-gathering by 20% through di rect reflectance from the roof. During summer months, the skylids are inverted to block all di rect sun from entering the garden and thus reduce the cooling load (see enclosed sketches). To forever dedicate this area as "Garden" and not to be used as normal commercial floor area, the Owners have covenanted that this area be so dedicated in perpetuity (see enclosed covenant). The Planning Department has agreed to exempt this area from any G.M.P.-required approval by an in-house review and approval (per Sunny Vann, August 12, 1983). Planning further feels this application lacks negative impacts in that: 1. it will not increase the &Ilk of the building, and 2. it will not increase the Impacts to systems and services. , 203 s. CHARLES B. ISRAEL, managing joint venturer of RED ONION INVESTORS, being first duly sworn upon his oath, avers and certifies as follows: :) I' GENERAL RECITALS i! 1. RED ONION INVESTORS is the owner of all of the Red Onion Condominiums situate on Lots N, 0 and P, Block 89, City and Townsite of Aspen, Pitkin County, Colorado. 2. RED ONION INVESTORS has applied for a building permit to construct 2,565 square feet ox commerci~l space situate above Condominium Unit #4, Red Onion Condominiums. 3. RED ONION INVESTORS has requested that its building permit include 255 square feet of garden area which is not intended to be a commercial use but rather is mechanical space in the form of a passive collector and biomass which it has requested the City of Aspen Building Department, including its zoning function, to consider not to be within the floor area ratio calculations for purposes of its building permit for said 2,565 square feet of commercial space. COVENANTS 1. In consideration of the issuance of the building permit requested by RED ONION INVESTORS including the 2,565 square feet of commercial area and in addition thereto the approximately 255 square feet of glassed-in garden area, RED ONION INVESTORS covenants that the 255 square foot garden area shall not be utilized as commercial space but rather that its purpose shall be limited to a solar collector and biomass area, mechanical in nature. That the covenant herein made shall be a covenant running with the land having a term of the greater of ( . ) years or the lives of all of the joint venturers of RED ONION INVESTORS and their now living children plus twenty-one years (21). ;; 3. I, 'i ,I , the City of Aspen shall be contained in an amendment to the Condominium Declaration for Red Onion Condominiums which will be presented to the land use authorities of the City of Aspen for approval upon completion of the improvements contemplated under the solicited building permit, but no later than May 1, 1984; in addition, RED ONION INVESTORS will insert appropriate plat language on the First Supplemental Condominium Plat for Red Onion Condominiums reflecting the existence of the foregoing covenant. In the event of any violation of the said covenant, the City of Aspen shall be entitled to enjoin the further use by RED ONION INVESTORS and its grantees of the said garden area in addition to any other remedies which may be available to it by law; and in the event of any litigation arising hereunder, if the City of Aspen shall pr~vail therein it shall be entitled to its reasonable attorneys' fees in enforcing the covenant herein recited. 5. This Covenant shall be binding upon RED ONION INVESTORS its successors, grantees and assigns in and to Red Onion Condominiums and each and all of the condominium units therein. You indicated to me that you had replaced the proposed sunscoop with an innovative "skylid" form of a skylight. Underneath this skylight will be a garden amenity not originally shown in the design reviewed by P & Z during the 1981 allocation of a GMP quota. You also indicated to me that due to the FAR calculations concerning the garden amenity, you had some additional flexibility in the design of the offices. You have therefore moved the front portion of the building forward by four feet. This change will still leave the facade of the addition approximately 15 feet back from the edge of the lower floor and will not increase the FAR for the entire building beyond the allocation of 2565.5 square feet. My feeling regarding these changes is that they are minor, generally con- sistent with your original approval, and need not be rescored by P & Z as per section 24-11.7 (b) of the Code. However, since you will be going before P & Z on July 19 for your View Plan Special Review, I suggest that we mention the changes which we have approved so that the public trust in the process can be served. 1 hope that my comments are in line with your conclusions as to our meeting today. To get to the end of Documents several meetings were necessary between myself and the following: June 15 Alan Richman and Collette Penne June 16 Jim Wi Ison June 24 Alan Richman July 8 Jim Wilson July 14 Board of Appeals July 15 Jim Wilson July 19 Planning and Zoning Commission July 25 . (Submit for Building Permit) It is to Alan, Collette, and Jim's credit that the project In 6 weeks time was able to navigate through requirements of GMP, HPC, View Plane, and code-related Board of Appeals issues. However, in one area I was led up a "blind alley". Let me describe this. In my first meeting with Alan we discussed the "interior garden" as an area exempted from Floor Area and floor area uses, permanently. He instructed me that this was not Planning's function to compute Floor Area, but rather the Building Department',s, and that if Jim Wilson had no prcblem with exempting it, neither would he. The day following Jim looked at and approved this idea. In three subsequent meetings with Jim and Alan to examine the progressprints, nothing was said to the contrary. Now, it seems, all parties are content to disown their involvement. This leaves me looking rather foolish in the eyes of my client, and worse, leaves my client in a position of extreme hardship. He has spent significantly for architectural and engineering plans, and has received bids and (earlier today) signed a Contract for Construction with the successful bidder. I'm sure you understand the added costs of redoing plans, rebidding, and delays.
