The fil:st photo shows the original sir-e posted, and the second photo shows the second site posted - a change due to rain and high winds that blew the sign off the original site. The fowwowing are some justificationsl 1. It is attractive, the neighbors support its existence, and because of its location behind our home, it is not visually apparent from Ute Ave. 2. It will not adversely affect the general purpose of the comprehensive general plan. It contains no flammable items. There is xx a ten foot retaining wall on our back property line, so it doesn't block any view or create any disturbance. J. We have an unusual lot shape. causing an "Extraordinary circumstance". 4. Other Ute Ave. dwellers are living in "Shacks", with storage rooms attached, not within setbacks. and certainly violating other building codes. To deny this structure's existence would deny us a substantial peoperty right enjoyed by other properties in our same zone and vicinity. (When the shed was built, nearly eight years ago, there were considerably more "rustic" dwellings all along Ute Avenue. Next door existed a horse corral and barn, home of"Smokey" and "Shuckins".) We consider the above valid reasons for granting a variance under Aspen code items d(2), d(J), and d(4).
