All persons affected by the proposed variance are invited to appear and state their views, protests or objections. J}Ji' \ bQ, GpP\ZVtd ctt ~"~ .<c6 rno.cl\r<1 RECORD OF PROCEEDINGS 100 Leaves Re ular Meetin BOARD OF ZONING ADJUSTMENTS June 23, 1983 Chairman Remo Lavagnino called the meeting to order at 4:05 p.m. with members Charles Paterson, Josephine Mann, Francis Whitaker, and John.Herz present. CASE #83-5 HERMAN EDEL 602 N. 4th Aspen, CO. The present house exceeds floor area ratio purposed passage solor addition would futher exceed FAR by 352 square feet. I I 1 i I , 1 , Lavagnino asked Edel if he would bring in the sign that was posted so that the board may examine it. Lavagnino told Edel that he could not read it from the street due to sun fading or some other possibility. Edel was asked to bring in a sworn affidavit and his sign; he will do so at the next meeting to be held on the 30th of June 1983. Edel told the board that he was under the floor area now by 212 square feet. The lot area is 7,618.9 square feet. Total allowable floor are of 3,693.3 feet. The living area is 3,480.9 square feet. That would allow Edel an additional area of 212.4 square feet. The addition is 360 square feet, leaving him over the FAR 147.6 square feet. Lavagnino stated that the variance was then for 147.6 square feet above the FAR. I",. Edel want to add a solar greenhouse with therapy pool facing due south. The reasons being that to collect solar heat and Edel's wife has a bad back. It is the only location in the house to put the therapy pool. The room will not be heated. The addition will contain all windows, like that of a green- house. Fans will push the heat through. The room is 15 x 24 square feet, which brings the applicant to 147 square feet in addition. , I I 1 j 1 I i , 1 I ! Lavagnino told Edel that the board has guidelines and it is difficult to give the applicant a variance on something that has become a convenience. Lavagnino asked the applicant if he could show some criteria for the board's guidelines. Ms. Mann added that if the board allowed all the applicants on the grounds of the solar principle, everyone that has over-built could co;ne before the board and expect a solar allowance also. 'Paterson added that a solar addition is looked upon with more favor than just "a plain old addition". Lavagnino asked the applicant to remember the board's criteria. He added that as one consideration along with the idea that the applicant can show hardship or practical difficulty, then Lavagnino might agree with the applicant. But if that is not established to begin with, then it becomes just like any other object of an increased FAR. Herz said that Edel was showing a hardship with a medical problem; his wife and 83 year old mother-in-law. Lavagnino added that a hardship or a practical difficulty is unique to that particular property. Edel told the board that he is trying to make his mother-in-law's life somewhat more pleasant and pleasurable. He said it was not a conven- ience, it is a practically of life. Lavagnino asked the board if they had any questions to ask the applicant. -1- 1"""\. '-' ~ ./ , Whitaker said that personal and financial problems are rarely considered as hardships over this application for granting a variance by the board. Edel asked the board how would he determine what is a hard- ship. Lavagnino replied by answering that Mr. Edel would have to prove that his situation is unique, but not with personal problems. It must deal with property. For example, somehow building went on before the ordinances were established. Or the surveyor made a mistake. Something that the applicant did not create himself, the applicant did not create the hardship or the practical difficulty~ Whitaker added that unless it was a real physical condition on the property, hardship, or to deny the right that other people have been given the same variance, it makes it very diffi- cult for Whitaker to grant this variance. Ms. Mann stated that she could not recall a time when the board has granted a variance when it apperared to the board that there was design alternatives that would not require a variance. , i I I ! Lavagnino summarized Ms. Mann's statement brieflv to Edel. He told Edelthat there is a design alternative that would accommodate Edel's mother-in-Iaw's use of the area and still meet the FAR requirements. Paterson added that the Board is up against the stone wall when they are looking for a practical difficulty or a real hardship. There are hardships that the board can consider, that is the problem. Edel told the board that he would go back and try to rework it. He added that he thought the board was making a great mistake and in the process they were hurting ~n elderly woman. Just by standing on afew feet and he would like to submit that is in error. Paterson stated that the board is here to solve individual problems. He added that he felt alittle more lenient towards this type of thing. One of the reasons being is that it is creating a solar situation, which is good for Aspen and also for what the board is trying to do in this town. Whitaker added that if it was impossible for Edel to accomp- lish what he set out to do within the setback within the FAR, then Whitaker would take a different view. He told Edel that he thought he could rearrange the facilities there and stay within the FAR. There were no letters received from any of the neighbors, for or against the proposed application. Edel and Lavagnino agreed that all of the neighbors had been notified. Edel told the board what bothers him about the actions of the board is the total lack of consideration and awareness of something that is more serious than all of than all of the board members. It bothers Edel greatly. Lavagnino asked him which is what? Edel replied, his mother-in-law. Edel thinks that is more important and more to the case. He added that he is not asking for 3,000, 300, or 200 sqaure feet. Whitaker stated that the board need not grant a variance merely because no apponents appear. In addition he said, the board must determine, before a variance is granted, that special conditions and circumstances do not result in the actions of the applicant. After, and only after practical difficulities or unnecessary hardships is determined can a variance be granted. -2- () I I i . Herz added that this is very minimal and that each and every case is different. He added that he thought that Edel had a real hardship and real practical difficulty. Edel told the board that he is not going this to sell the house, they are not going to sell the house. He explained to the board that he is trying to do something he thought was very nice, and good gestures are supposed to be rewarded, not made tough. Edel asked that this be tabled until his architect returns to town. Ms. Mann told Edel that the board has tried to be very care- ful and legal about what the board does. She added that she supports Whitaker in reference to Sandra Stuller's letter which was read earlier before the board. Lavagnino told Edel that the board is flexible and they do hear arguments based on the 'unique position that Edel has presented before the board. Lavagnino added that Edel is asking for relief from the strict adherence of the Code and has not demostrated this to the board, or atleast to the Chair- man. If Edel could demostrate this, then Edel could see that the board is flexible. Edel asked once again that the board ~espectfully table this case until another time. Whitaker asked that the applicant table this case for his con- venience and hopefully for the applicants benifit. Whitaker added that if Edel would ask his architect if he could re-design what is in question and let the board consider both. Let the architect re-design it within the Code and would then show a practical difficulty. Edel could prove to the board that he can not do the purposed request. Whitaker said he would agree, only on that bases. Whitaker moved to table case #83-5, a continuation of a public meeting until June 30th, 1983 at 4:00 p.m. Herz seconds the motion. All in favor; motion carried. Lavagnino asked the board if there were any other comments. Lavagnino told Drueding, from the Building Department that it is very important that the applicants receive the packet and any additional information. Lavagnino asked the board if they thought he was too out spoken and would like to hear any comments from the members. Whitaker added that the board is the next thing to a court of law. The board has to respect the guidelines that they are to follow. If not, the building inspector might as well grant the variance. Paterson said that he was all for Whitaker's statement. He also added that he is always in favor of flexibility. Herz also agreed with Whitaker's and Paterson's statement. He thought that the Board carne up with a good suggestion, let Edel prove that he cannot do it.
