BEFORE THE CITY OF ASPEN BOARD QF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING 'OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the Council Room, City Hall, Aspen, Colorado, (or at such other place as the m~eting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for var~ance from the provisions of the Zoning O.dinance, Chapter 24, Official Code of Aspen. Main, Aspen (Hickory House Rest) The Hickory House is a pre-existing, non-conforming use in the "0" Office Zoning Category. Applicant is requesting to enclose covered patio as a permanent addition. Sec 24-13.4 Nonconforming uses of structure or of structures and premises in combination. If lawful use involving individual structures, or of structure and premises in combination, exists at the effective date of adoption or amendment of this zoning code that would not be allowed in the district under the terms of this code, the lawful use may be continued so long as it remains otherwise lawful, subject to the fOllowing provisions: (a) No existing structure devoted to a use not permitted by this code in the district in which it is located shall be enlarged, extended, constructed, reconstructed, moved or structurally altered except in changing the use of the structure to a use permitted in the district in which it is located; (b) Any non-conforming use may be extended throughout any parts of a building which were manifestly arranged or designed for such use at the time of adoption or amendment of this code, but no such use shall be extended to occupy any land outside such building. Main, Aspen Dear Mr. Drueding: I own the house at 635 W. Bleeker which is one block from the Hickory House Restaurant. Customers from the Hickory House constantly park in front of my premises often blocking my driveway and entrance walks to my doors. This is also true with my neighbors and generally through- out the neighborhood. Furthermore, since a large percentage of their patronage are workmen, carpenters, plumbers, electricians, etc., most of the vehicles are small and large trucks. Up to this time Hickory House has not provided any off-street parking for their patrons; causing the above annoyance. Should they be permitted to "enclose and improve the existing screened patio dining area in order to provide more comfortable year-round dining.", this will require ~ parking facilities. I strenuously object to the granting of this variance unless and until off-street parking is provided equal to one car for every four seats which even at that ratio will cause serious congestion in the neighborhood.
