The undersigned is the owner of South facing units 129 and 218 at Aspen Square. reasons: We are Opposed to this construction for the following 1. It is our understanding that development in the area involved should be pursuant to a fully approved site plan with the attendant procedures. It is Our further understanding that no site plan has been submitted and to allow a variance would constitute a precedent for allowing the entire ordinance's procedural scheme to be ignored. A great deal of effort has been spent establishing procedures which safeguard the community froF.l indiscriminate construction and deviations from the established procedure with its attendant safeguards should not be tolerated. We would further question the legality of proceedino as the applicant has proposed. 2. The past activities at the North Nell Building have resulted in a great deal of noise pollution. This is particularly true after dark, both summer and winter. The proposed skylight will of necessity increase the after-dark noise pollution in the area. As one of the North Nell building's closest neighbors since DeceI'lber, 1968 I have watched the growth of the activity at that building and the increase in noise, visual pollution, and traffic congestion caused by the tremendous increase in sales volumes generated on the premises. I have no quarrel with anyone's desire to upgrade their premises and increase their gross income, however, there is a point at which changes to promote City of Aspen Board of Adjustment May 16, 1979 Page Tl^'O such increases do result in having a significant, unpleasant effect on all of the neighbors. We believe that this proposed skylight will cause a significant additional problem and for the reasons stated should not be permitted. This is re~erring to the Henke skylight structure with the May 24th hearing. The current views ~rom various windows have either a mountain, sky, weather, light, or town scene attractien. We like the status que of the magic scenes. These are part o~ the Aspen Square visitors ski-holiday or summer scene. This handsome complex o~ Aspen Square seems to attract people who came again and again. They spend their vacation money and help support the businesses in town and those adjacent to Aspen Square. One change in a nearby structure will very likely spawn other changes. Keeping Aspen Square ~ull, happy and alive is good econ- omics for the town. Durant, Aspen. Upon purchasing my unit I was told that it was not permitted that any building of any further height would be allowed. I feel that to permit further height will cause the property value to go down and will block the present view of many of the Condos of Aspen Square. While we are somewhat limited in our ability to fully comprehend the consequences of the requested vari- ance because we have not been supplied with material de- tails concerning it, it does appear to us that the vari- ance might well be undesirable. Clerestory windows located at the base of the hill could well cause reflections of the sun which would not only be disturbing to adjacent property owners, but could blind descending skiers and constitute an accident hazard as well. Moreover, if those windows were opened so as to allow noise from the building to escape to the outside, that noise would almost certainly constitute an annoyance to adjacent residents and particularly to those of us who are located above the building. Noise does have a tendency to rise, and it would be most disturbing during the night time hours when there is considerable activity in the build- ing. consequently, I would appreciate your conveying our feelings to the City so that due co~sideration will be given to the problems which we anticipat .
