Street Frontage Variance May 3, 1977 This letter is in response to the request by W.P.W. for a 5 foot street frontage variance for developed property along Lake Avenue more specifically known as Lot 19 of the W,P,W. subdivision replat recently approved by the City Council. The City Subdivision Code requires a 60 foot street frontage; lot 19 has a 55 foot frontage on Lake Avenue. The Planning Office supports the granting of this 5 foot variance for the following reasons: I. The Westerly line of lot 19 has been moved to the east to create a wider sideyard for the existing brick Victorian structure on adjacent lot 18. 2. Both lots 18 and 19 are develooed properties. The property line between shoul d be drawn to facilitate the needs of the existinq buildinqs not riqidly conformed to the code standard. 3. The I ine could be gerrymandered between lots 18 and 19 to meet the 60 foot requirement. However, the property line would not create an efficient prooerty line to promote easier vard maintenance. 4. Duplexes tend to draw tenants who typically have less pride of ownership, more cars and are more party oriented. The Hallam Lake area is considered by many to be the most prestigious residential community in Aspen. I feel that the existing subject structures are improved at less than highest and best us~ and maintained in less than good condition. A strong rehabilitation program would be well deserving of the location but duplex development may have a negative effect on the surrounding properties. I offer these comments as a "Personal Opinion" and further hesitate to establish market evidence for my opinion due to the unique nature of the neighborhood. We recently bought our home there - at Lake and Second Streets, and chose that location because it is a quiet, residential area. I do not know if it is true, but I have heard that duplexes may also be placed on the vacant lots at the corner of First and Smuggler, across the park. If so, and if a variance is allowed for du- plexing the Lake Street homes, there is a potential for essentially doubling the pop- ulation, traffic, noise levels, etc. of a one block area. WPW (Henry Pedersen and Jack and Jackie Wogan) has processed the subdivision exemption application through City P&Z and City Council receiving approval with certain conditions. So far as the variance is concerned, it would appear to be necessary as one new lot line to be drawn as approved by p&Z and City Council would vary from the city's sixty-foot front lot line requirement by a few feet. I should point out that all seven lots my clients' have purchased are substandard as to frontage, and three are substandard as to area, because they have existed since the 1890's. The change to four lots will bring them up to meeting all current city area, side yard, front yard, and rear yard setbacks, and front lot lines, except in the one instance for which this application is made. The variance is necessary and sought for the reason that the two lot lines had to be changed in order to give the existing Victorians, which are to be designated historic, sufficient side yards so that they are in an aesthetically pleasing situation and comply with current zoning side yard requirements. Hence, we would ask that the Board of Adjustment grant a variance to permit that deviation from the sixty-foot front yard requirement upon new Lot 19. I enclose a map for your convenience. Galena Aspen, Colorado 81611 Re: WPW--Board of Adjustment--variance Dear Dorothy: As you and I have discussed, there is an unsettled question as to whether the denial of a variance to WPW with regard to the five foot line variance on Lot 19, Block 103, Hallam's Addition, according to the revised plat recorded in Plat Book 5 at Page 91-93 requires a variance in order to restore or expand the existing Victorian house upon that site. As you know, The WPW Joint Venture takes the position that no such variance is needed for a building permit, because it was a condition of the subdivision exemption approval by P&Z and the City Council that the dwelling remain, and be restored, allowing us a .3 to 1 FAR, thus envisioning an expansion. Nonetheless, since the City is not prepared at this point in time to give us such a ruling, and since we do not control that dwelling nor Lot 19, as we are enjoined for a period of three months from affecting the resident's rights (Mr. and Mrs. Baranko's) in that dwelling, in a lawsuit pending in the District Court here, namely Baranko, et al. v. Shaw, et al., Civil Action No. 6313, we are not in a-position~test the issue by the filing of the building permit since Mr. Baranko controls the dwelling. We believe the decision of the Board of Adjustment on May 19, 1977, in Case No. 77-11 is incorrect, but whether we are correct, we of course do have the right to seek court review of it. As we discussed, the court review of the decision of an administrative body is required to be done within thirty days, see Rule 106, Colo. Rules Civ. Pro. It is entirely possible that the lawsuit that might be necessary to protect my client's rights under the Board's decision of May 19, will be totally moot depending upon the outcome of the Baranko suit, further negotiations with the City, , "'"..,",,' OATES, AUSTIN, MCGRATH So .JORDAN June 6, 1977 Page -2- and the like. Therefore, it would seem in the interest of the City, the Board of Adjustment, and of WPW that the City and the Board of Adjustment waive the 30-day time period for Court review of the May 19 decision, until thirty days after final disposition in the District Court of the Baranko v. Shaw case. If such a waiver is acceptable and would be recommended by you, would you please have the appropriate officials endorse the letter below. Would you also please see that the clerks and secretaries involved retain the tape recordings of the Board of Adjustment's Case No. 77-11, for May 19, 1977, and for May 5, 1977, which was the prior hear- ing in the matter that had been tabled. In the event you are unable to obtain a waiver for the time period or cannot obtain it by approximately June 17 (the 30-day period expires on June 18, a Saturday; since it is part of the Civil Rules, the period would normally be carried forward to June 20), and please consider this a claims and demand letter directed to the City and the Board of Adjustment pursuant to the provisions of Section 13.3 of the City Charter. In that event we would be forced to file a complaint in the District Court on June 17 seeking review of the Board's decision, but I would rather save both of us that bother.
