Harvey RE: HYMAN AVENUE VICTORIANS Dear Board Members, Herewith I am submitting an appeal for a variance for the HYMAN AVENUE VICTORIANS. The new evidence for your consideration consists of the site plans showing the practical difficulties imposed in positioning the new building because of the existing Victorian house. There is also an explanatory letter from Michael Erneman, the architect, describing the reasoning behind design which requires set back variance. HARVEY FOR HYMAN AVENUE VICTORIANS DESCRIPTION OF PROPOSED VARIANCE I propose to construct two-two bedroom townhouses on lots R & S, Block 32, East Aspen Addition. The current improvements consist of a Victorian house built in 1883 and remodelled this year. Even though it is a hardship in effort and expense to integrate the new building with the old, I have chosen to make the townhouses architecturally and aesthetically compatible with the Victorian house. It would have been easier to move or de- molish the house and build a maximum density cubical structure. It has been, and is, my desire to preserve and echo the historical architecture of Aspen. To integrate the two buildings according to my design, I am requesting a variance from set-back requirements for a roof projection of 1 foot, 2 inches on the East elevation and 3 feet, 6 inches on the North elevation. As you are aware, the roof lines and projections of overhangs and porches are indigenous to, and the most prominent features of, the Victorian architecture of Aspen. If the variance is not granted then the architectural in- tegrity of the design will be destroyed and a cubical building should be built. If the buildings are not compatible it will, I feel, be contrary to the duties of the board, as the code states that you exercise your powers and duties .....in accordance with the public interest and the most appropriate development of the area" (Municipal Code, City of Aspen, Section 2-21) JUSTIFICATION FOR PROPOSED VARIANCE I suffer in my design from a hardship because the original house was built in 1883, pre set-back requirements, and is in violation of current requirements. This is a special and estra- ordinary circumstance of my property that does not apply similiarly to other properties in the same vicinity and zone. (Municipal Code Section 2-22, d, 2) If you notice the site plan, you will see that the new building has been positioned with a set-back on the West side of 8'1" from building edge to the property line. Under permitted set-backs we could have expanded the building 3'1" farther to the West. However, because of the proximity of the neighboring building on the West and the position of the existing Victorian house the new building must be closer to the East side of the property. I am not trying to maximize the footprint of the new buildings. I am only trying to conform the new design to the existing Victorian structure. To do this I am not asking to push the actual wall out to the wall of the existing building, "..., '-' .~ ......,; but only to extend the roof projection. On the North side I am requesting a variance to extend the roof 3'6" into the set-back to fully cover the parking area. I considered moving the new building closer to the old or reducing the size of the new building but both of these solutions would destroy the livibility of the units. The new building has only a four foot walkway separating it from the old and the total livable floor space is 400 sq. ft. on the ground floor of the new building. To decrease the size of the new building to allow for the roof projection within the set- back requirements would reduce the room sizes to make them impractical. In addition the granting of this variance will not adversely affect the general purpose of the comprehensive general plan. In fact the granting of this variance will be in accordance with the public interest and the most appropriate development of the area, and thus will positively affect the general purpose of the comprehensive general plan. More specifically, I submit the following justifications: 1. The roof projection on the east elevation will be instrumental in keeping snow off the rear and principal entrance to the existing house and off the front and side entrances (there are no other entrances) to the east townhouse unit. Inadeq~ate protection over the entrances presents an unwarranted hardship while adequate protection is important for the enjoyment of a substantial property right. 2. The north elevation roof has a 450 north-south pitch. Without the variance and resulting projection there will be a constant winter threat of snow sliding onto automobiles and onto people entering and exiting the parking area. In light of the chronic problem in Aspen of people parking on the street, it is in accordance with the public interest to make this parking area as attractive as possible to insure its continuing use by the residents. Dear Members of the Board; This letter is written in behalf of Hr. Perry Harvey with specific regard to his appeal for zoning adjustment on the proposed Hyman Street Victorian Townhouse project. It is intended to pro- vide an explanation of my design approach to the project as it pertains to the Aspen Zoning Code, and further, to present a brief discussion of the hardships that occur as a result of existing conditions on the project site. Some nine months ago, when Perry Harvey first considered under- taking the Hyman Street project, the property consisted of two city lots, zoned R/MF, with a one story, one bedroom, turn-of- the-century Victorian house. This existing house was in poor structural condition, and it was located on the property such that it extended beyond allowable setback limits along two property lines. Moreover, it had undergone several cosmetic renovations and remodellings over the years which resulted in an unfortunate adulteration of what was originally an elegant example of early Aspen Victorian or Neo-Gothic architecture. The R/MF zoning designation would allow development of far greater intensity on the property than the existing house alone presented, and it would allow greater intensity than what might be developed comfortably if the house were retained and an additional building were erected on the property. Consequently, the initial concept for development involved razing the existing house and erecting a three story building to the maximum of allowable limits, consisting of six-one bedroom condominium units. Such a concept would be entirely consistent with every letter of the Aspen Zoning Code, and had it been carried out, Mr. Harvey's appeal to your board would be unnecessary. However, this early concept was abandoned in favor of one that included retention and restoration of the existing house and construction of two small two bedroom condominium units within a two story building. Another point of. relevance is that the~ew building is not. designed to the allowable'limi ts on,thfl West side. It is set back 8'-0" from the property line where a 5'-0" setback is required.
