Aspen/Pitkic P23nning Office 130 so'~;h .,.~",~,~ aspen, c~jiortltio s t re e t 81611 February 28, 1977 City of Aspen Board of Adjustment 130 South Galena Street Aspen, Colorado 81611 Dear Board Members: I am writing to you on behalf of the City of Aspen Electric Utility and Stogie Madalone, the Director of the City Electric Department and seek your grant of variance from the use restrictions in the P-Park zoning district. As you ~ay know, the electric department would like to construct a building in the general area of Cemetery Lane and Highway 82 for the purpose of enclosing switching gear and accessory electrical equipment. The attached plans indicate the proposed philosophy which includes extensive berming, landscaping and wood exterior with the intention of providing a structure that will be compatible with the surrounding predominantly residential area. Specifically the building will consist of some 1,140 square feet of which some--I34. S- square feet are proposed for office space .-'Ihe.__- balance of the building space will be devoted to switching gear and storage. Section 24-2.7 of the Municipal Code (zoning) already provides a broad exemption for utilities and reads as follows: "(a) Essential services shall be permitted as authorized by law, it being the intention of this section to exempt such essential services from the appllcation of this zoning code. .(b) For purposes of this section, "essential services" is defined to include the erection, alteration or maintenan~e by public utilities or municipal departments of underground, surface or overhead gas, electrical, steam, fuel or water transmission or distribution systems including towers, poles, wires, maics, drains, sewers, pipes, conduits, cables, fire alarm and, police call boxes, traffic signals, hydrants and similar equipment in connection herewith. , . // I I ! I i : \ \ \ Letter Board of Adjustment February 28, 1977 Page Two (c) Excluded from the exemption granted by this section are the maintenance and business facilities.necessary to supply such services, which facilities shall be restricted to their appropriate zone district. This 't;1;l-<w 1"'" request seeks a variance to cover the office use and the right to .~.,I ': enclose the gear. " '" (t' "v:" , .J.:{;v, ~-~ ..-~,.-- In the absence of this variance, the switching gear could be con- structed on the site with the effect of housing a much less aesthetic design solution and would involve l) visible overhead wires, 2) visible outside storage and 3) a substantially higher maintenance cost for the new equipment. From a planning standpoint, the building approach offers a much better solution for the area than the typical exposed sub-station package (e.g. cyclone fence, gravel, etc.). The office space would be for Stogie Madalone and would not be _ ~ t1 specifically for business affairs (Le. billing, etc.). ""'"', -- ",", Aspen/Pit 130 s ning Office tree t 1611 February 28, 1977 City of Aspen Board of Adjustment 130 South Galena Street Aspen, Colorado 81611 Dear Board Members: I am writing to you on behalf of the City of Aspen Electric Utility and Stogie Madalone, the Director of the City Electric Department and seek your grant of variance from the uSe restrictions in the P-Park zoning district. As you may know, the electric department would like to construct a building in the general area of Cemetery Lane and Highway 82 for the purpose of enclosing switching gear and accessory electrical equipment. The attached plans indicate the proposed philosophy which includes extensive berming, landscaping and wood exterior with the intention of providing a structure that will be compatible with the surrounding predominantly residential area. Specifically the building will consist of some l,140 square feet of which some 134.5 square feet are proposed for office space. The balance of the building space will be devoted to switching gear and storage. Section 24-2.7 of the Municipal Code (zoning) already provides a broad exemption for utilities and reads as follows: "(a) Essential services shall be permitted as authorized by law, it being the intention of this section to exempt such essential services from the application of this zoning code. (b) For purposes of this section, "essential services" is defined to include the erection, alteration or maintenance by public utilities or municipal departments of underground, surface or overhead gas, electrical, steam, fuel or water transmission or distribution systems including towers, poles, wires, mains, drains, sewers, pipes, conduits, cables, fire alarm and police call boxes, traffic signals, hydrants and similar equipment in connection herewith. Adjustment 28, 1977 Page Two (c) Excluded from the exemption granted by this section are the maintenance and business facilities necessary to supply such services, which facilities shall be restricted to their appropriate zone district. (Ord. No. 11-l975 II 1)" This section does not provide for the exemption of "office space" or the enclosure of the facilities described in part (b) above. This request seeks a variance to cover the office USe and the right to enclose the gear. In the absence of this variance, the switching gear could be con- structed on the site with the effect of housing a much less aesthetic design solution and would involve 1) visible overhead wires, 2) visible outside storage and 3) a substantially higher maintenance cost for the new equipment. From a planning standpoint, the building approach offers a much better solution for the area than the typical exposed sub-station package (e.g. cyclone fence, gravel, etc.). The office space would be for Stogie Madalone and would not be specifically for business affairs (i.e. billing, etc.). This space would also offer advantages in terms of overall security for the area. We believe that authority exists for the granting of this variance under part (D) Section 2-22 of the Municipal Code. Sub-parts 1., 2., and 4. of this section are particularly appropriate to this action and are as follows: "(l) That the special conditions and circumstances do not result from the actions of the applicant. (2) That special or extraordinary circumstances apply to the subject property that do not apply similarly to other properties in the same vicinity and zone. (4) That the granting of the variance will not adversely affect the general purpose of the comprehensive general plan. (Code 1962, ~ 11-1-12; Ordin. No. 21-167, ~ 1; Ord; No. 35-l974, llll l,2)" Attached please find a copy of the list of property owners residing within 300 feet of the subject proposal.
