APPLICATION IS MADE FOR A BUILDING PERMIT TO BUILD AN ADDITION TO A NON-CONFORMING BUILDING. THE BUILDING IS NON-CONFORMING SINCE THE REQUIRED 25% OPEN SPACE HAS NOT BEEN PROVIDED. A NON-CONFORMING USE OF LAND OR OF A BUILDING OR ANY PORTION THEREOF SHALL NOT BE EXTENDED. We were informed by him that the Building Permit was applied for and approved by the City of Aspen Building Department. Mr. Cline gave us the understanding that he had told the building department there would be a delay encountered because of title problems with the land and an approval of an SBA loan, also for the plans to be put out for bids. We had to have the plans and the approval for building to present to the SBA. On March 22, 1972 I wrote check # in the amount of $111.00, to the City of Aspen for the building permit. The City cashed the check, but no permit was issued. We were under the impression that the permit would be issued when the SBA 10<4, w~s completed, and we purchased the property. We were also informed by Mr. Cline that he had received a variance on " the 25 per cent green law, since we were an existing building. ~e title problem on the land was not solved till Oct. of 1972. The SBA loan was approved 12_26_72 and just completed with the bank 3_21_73. We have been waiting all this time on the loan. Now it seems we have no building permit and can not complete our plans. c J 4 NOTICE OF PUBLIC HEARING Case No. 73-8 BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Offi~ial Code of Aspen of June 25, 1962, as amend- ed, a public hearing will be held in the Council Room, City Hall, Aspen, Colorado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Resolution, Title XI, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious con- sideration to the opinions of surrounding property owners and others affected in de~iding whether to grant or deny the request for variance.
