Description of proposed exception shoHing justifications:
The City of,Aspen respectifully requests the Board of Adjustment
to permit the use of a 5000 gallon above ground storage tank for
the duration of the energy cris~s. Only #2 & less volatile
fuel will be stored in the tank.

Provisions of the Zoning Ordinance requiring the Building Inspector
to fOrlvard this application to the Board of AdjustTnent and reason
for not grant,ing penr:it:
Application is made for a variance to permit the use of an above
ground fuel tank. All fuel storage tanks shall be completely buried
beneath the surface of the ground. Sec. 24-9(a) 2. The existing
storage tank is a non-conforming use since it has not been used for
many years. Whenever a non-conforming use has been discontinued for
a period of one year, such use shall not thereafter be re-established,
and any future use shall be in conformance with the provisions of this
chapter. Sec. 24-10(c).

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTME1'T
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council. Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance f~om the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yorrviews by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.
