',. . ~ ....,..f Description of proposed exception showing justification: The subject building was constructed in 1968(as a temporary) structure by the Aspen Center for Physics. Its (specific)purpose at the time was to provide facilities for the National Accelerator Laboratory's planning sessions sponsored and organized by the Center.Jor Physics It has since 1970 been used for the regular physics program. The building was constructed with the understanding that it was to be considered a temporary building. Both institutions agreed that the building was not in keeping with the overall architectural scheme of the Aspen Institute. During two school years (1970 through 1972) the Aspen Center for Physics has Leased its total facility (including subject building) to the Aspen Community School with the express understanding that the school's u~ag'; ~o~ld be terminated in the spring oy1972. ~ The building as it is currently positioned, is not in conformance with the master plan of the Aspen Institute. Consequently, it is proposed to move the building to a new pos ition as defined in the attached plan. fJ-. If repositioning is permitted as shown, the building will be placed upon';' concrete block foundation, the area cleaned up and a landscaping program commenced. Application made to move an existing building into the R-6 zone for a workshop. }fro Gordon Bell, General }fanager, submitted a plan of what is proposed. Hardship and information outlined as follows: building was constructed in 1968 as a temporary structure; the building is not in keeping with the overall architectural scheme of the Institute and is not in keeping with the overall master plan of the Institute; facility was leased to the Aspen Community School which will expire may 31, 1972; if permitted to move the building it will be placed on concrete block foundation, area will be cleaned up and landscaped and will be used for seminars and workshop space; ingress and egress will be to the north of the building, no on street parking space will be required since the present off street parking area for the Aspen Center for Physics will be expanded to the westward as required. }fro Bell further stated the building could seat 70 to 80 people but from 25 to 40 people might use the building at one time. Cannot give a definite answer since it is unknown at this time to what extent the remodeling will be. }fro }feyring pointed out a small piece of the building is presently on R-6 land. Board questioned the repositioning of the building being on the right-of-way of Gillespie Street. Question was also raised if Gillespie Street was ever dedicated as a street or vacated. Mr. Bell stated they would ask for a vacation of the street if the variance is granted. }fro }feyring stated if the street is not vacated the building could not be placed as platted since there is insufficBnt land, front yard would have to be North Street or Sixth Street. }frs. Lottie Bresnitz was present and stated she was speaking for her- self and }frs. Iselin and object to the proposed. The building has the appearance of being a barracks, the Institute is having it moved because it is not acceptable to them, we also object because not only would it be objectionable from an esthetic standpoint but also the use to which it would be put. County requires 10 acres for a school. The present use of the building under the lease has caused traffic and trash problems. Opposed to the Inst- itute going into a R-6 zone even though it is contiguous to their development unless they make of record their master plan. If this variance is approved would request the Board grant conditional approval providing that they file and make of record their master plan, and the zoning be brought up to date as in the Master Plan. Mr. Charles Donelan resident of the corner of Sixth and Gillespie stated he was opposed, feel a clarification of seminar and workshop space be made, this building as a physics building and school has caused traffic and trash nuisance. Butch Haberman was present and stated he was opposed to the granting of the variance. Mr. Francis Kalmes was present and stated he objected to R-6 status of this proerty being changed. Mr. Lavagnino stated as this is proposed, feel it would have an adverse affect on traffic and other problems. Feel this area should be studied more with the Planning and Zoning Commission to determine its proper use. Board questioned if the Institute had alternate plans if this request is turned down. Mr. Bell stated the future plans of the Physics Institute have not changed, the building will be used this summer. Mr. Lavagnino stated the Institute would be infringing on the people in the area by moving a building that is not acceptable into a resid- ential zone. Mr. Markalunas gave the background on the zoning of the property as follows: the property was zoned tourist in 1952 and 1953 when the Aspen Company built the Aspen Meadows. When the County created their zoning code they tried to accommodate the existing uses, so it was zoned tourist. Then the adjacent property on Gillespie was up for sale, people became concerned and reqested the County create a buffer zone on Gillespie and North between the Institute and residential area. The Institute is now asking for an extent ion of the AR zone into the residential area. Property owners last year requested the Institute meet with the City P & Z on their master plan. Mrs. Bresnitz stated she would not object to the building if it were more attractive, would request to see whatit would look like first. Mr. Lavagnino pointed out the Boards only concern is the use and its adverse affect on the R-6 zone, cannot consider esthetics. There being no further comments, Chairman Dukes closed the public hearing. Board went into executive session to discuss the drafting of the motion.
