Ralph requesting a variance permitting the extension of new construction into the set-back area above the roof of the existing building and to place 8 second story on said existing building. Ralph. being the owner of all of Lots R and S.. in Block 105. Aspen. respectfully petition the Board of Adjustment to grant a variance permitting me to extend new construction into the set-back area above the roof of the existing building and place a second story on said existing building. The grounds for this request and the pertinent ijformstion in relation thereto are as follows: 1. fue property described above is situate in the Tourist District which require. a set-back of five feet for all principal buIldings. 2. There is now an existing residence on said prop- erty and the eaves on the East side extend to the property line. The proposed construction of the east wall of the new elevation for the second floor would be even with the lot line. 3. This variance is ~t a use variance and notice will be forwarded to all adjOining property owners. 4. Since the existing building projects into the set-back area and since the encroachment occurs at an elevation above the first floor and constitutes in effect a continuation of the existing structure by reason of these exceptional situations and conditions of the existing building in relationShip to its location on the lots. it is our belief that adequate grounds exist for granting this\8riance and unnecessary hardship would result from a strict enforcement of this Ordinance. 5. It is further requested that off-street parking requirements be waived with respect to the new construction for the reason that in order to provide off-street parking upon said prell1ises. it would be necessary to disl:1ltband obliterate the existing landscaping in front of said exist- ing building. That the destruction adversely affects the appearance of the property and since it is on Cooper Avenue (Highway 82) that it is not in the best interests of the cOlll'aUni ty. Respectfully submitted. Nicholson, as agent for Donald T. Randall, d/b/a Aspen Laundry, respectfully petition the Board of Adjustment to grant a variance from the Zoning Ordinances for the City of Aspen and the Building Code of the City of Aspen to pemit the erection and construc- tion of a canppy extending ..sterly from the existing structure at said laundry over the sidewalk area to permit a drive-in accommoda- tion to our customers. The grounds and pertinent information relating to this request are as follows: 1. Said laundry is situate upon Lots A and B, in Block 81, and is within the Business Zone of the City of Aspen. 2. The operation of a laundry is a permitted use within this Zone, but it is felt that said projection may be within the jurisdiction of the Board of Adjustment for the reason that it extends into the public right-of-way and might be construed to be a structure similar to a sign and hence, require approval of this Board. 3. It is our intent and desire to better accommodate our customers and the public by providing a drive-in service in order to minimize traffic hazards, alleviate ?arking and promote the public safety. 4. We do not believe this would infriage upon the public interest, but is in the nature of an exceptional situation and an existing build1ng condition that justi- fies your Board in granting this request as provided in Section 10, Sub-paragraph A3. 5. This is a use variance and notice will be served on all adjoining property owners as provided 1n the ordi- nances of the City. 6. Attached hereto is Exhibit "A" constituting a sketch showing the projection extending at an elevation abovenlne feet into the public right-of-way a distance of approximately thblaen feet.
