The applicant wishes to construct a deck behind his duplex unit and a privacy fence to separate the yards of the duplex units according to the attached drawings. A PUD Amendment may be approved to alter the site specific development plan of the Snyder Park PUD. The applicant has obtained the approval of the Snyder Park homeowner's association to construct the deck and the fence. The proposed deck is. in a utility easement. The applicant has designed the deck in such a manner that allows the utility companies to access their equipment boxes at the rear of the lot (as is described in the application. The applicant has also obtained letters of consent from Holy Cross Energy and AT & T Broadband to allow him to put the deck in the utility easement. Staff finds that the proposed amendment meets the criteria for an insubstantIal amendment pursuant to section 26.445.I 00 of the City of Aspen Land Use Code. By signing the bottom of this letter, you are giving me permission to build this deck and fence and it will serve as a written notice. This deck is 14" x 19' with a fence built around the perimeter. See the attached, amended P.U.D. to see where it sits on the property and how it covers part of the utility easement. As we discussed with our homeowners, I will inform you and your homeowners of the exact nature of the proposed deck and fence through this letter. This deck is 14' x 19' with a fence built around the perimeter. The fence will match the fence that is existing just to the north, between Ardmore and 55 Smuggler Grove Ct. Importantly, this wiII be the only thing you wiII see from Ardmore, that is why I will use the same materials and match the existing fence. In my opinion., it is a huge improvement from the old "snow fence" that was broken in spots and falling down. The deck will sit on footers that is just above grade to meet the building code. It will have a gate at its entrance consisting of 2 doors that swing out and our 4' high x 3' wide. The deck will sit on Snyder Park's property per the P.U.D. plat. It isjust inside the property by 10" to the east and north. As for the constmction of the project, all materials, equipment, trucks and workers will use Snyder Parks property to complete the job. They will not be on Ardmore at all. The project should not take more than 5 days to complete once the necessary permits are in place and the planning and zoning department has approved the project. To clear up the confusion of the electrical meter that was placed on the Ardmore side of the fence, I will try to explain it to you how it was explained to me by Mike Johnson at AT+T Broadband. The node to cover the east end of town including the homes on Ardmore is located on Snyder Parks property. To get the broadband service up and running, the power to the existing cable service had to be increased. AT +T put in a generator and amplifier, which is located on Snyder Park's property on a utility easement, to boost the signal strength. The electrical meter that monitors the power usage of the generator was put on the Ardmore side of the fence on a utilty easement for easier access. Again, in my opinion., I feel that this is more than fair for the Ardmore homeowners because of the fact that the Snyder Park homeowners have the amplifier and huge generator sitting on their property and the Ardmore homeowners only have the small electrical meter sitting on their property. I'm sony for any confusion and inconvenience this has caused the Ardmore Homeowners Association. I'm quite confident that after the deck and fence are built, you will see it as an improvement to your sight lines.
