APPLICANT: Dick Friedman, represented by Harry Teague Architects. LOCATION: 851 Ute Avenue, Unit C ZONING: R-6 PUD PROJECT REVIEW PROCESS AND STAFF EVALUATION I. Background- The project is a remodel at the rear of the existing building. Staff has found that the proposed new windows violate the volume standard and the applicant wishes to pursue a waiver. II. Site description- The unit is part of the Black Swan Condominiums, set in a wooded location at the base of Aspen Mountain. III. Waiver requested- A. Standard: "Floor area ratio and allowable floor area for a residential building or portion thereof shall include a calculation based on the relationship between every instance of the exterior expressions and interior plate heights. All interior areas that include exterior expression of a plate height greater than 10 (ten) feet, shall be counted as two (2) square feet per each square footage of actual floor area. Exterior expression shall be defined as facade penetrations between nine (9) and twelve (12) feet above the elevation of the finished floor, and circular, semi-circular or non-orthogonal facade penetrations between nine (9) and fifteen (15) feet above the level of the finished floor. IV. Staff evaluation- The Committee may grant an exception to the design standards for any of the following criteria: a) yield greater compliance with the goals of the Aspen Area Community Plan; Staff response: The project does not further any goals of the AACP. b) more effectively address the issue or problem a given standard or provision responds to; or Staff response: The standard addresses a scale issue, and is meant to discourage two story windows. In this particular project, there is a break between the window units and they are located in an area which is not visible from the street. c) be clearly necessary for reasons of fairness related to unusual site specific constraints. Staff response: The variance is not related to site constraints. V. Attachment 1- Land use application form ✓ Response to Attachment 2 Response to Attachment 3 H A R R Y T E A G U E A R C H I T E C T S Design Review Appeal Specific Submission Requirement: 6 For 851 Ute Avenue unit C we are requesting a variance of Section 2, (D) Volume. so far as it pertains to facade_penetrations between 9' and 12'A.F.F. . The elevation in question lies in close proximity to the north facing hillside of Aspen Mountain and away from any high traffic area.The substantial tree cover to the south masks the already minimal nature of this alteration. As the elevation exists there is 10sq.ft. of glazing between 9'and 12'. After the alteration this will increase to28.5sq.ft. of glazing between 9' and 12'. Plan and Final Subdivision Plat Approval DATE: July 22, 1976 ■ r ■ This is a request for Final P.U.D. Plan and Final Subdivision Plat approval of the Black Swan Hall Condominium Subdivison consisting of a four (4) unit apartment house on 18,731 square feet of land south of Ute Avenue across from the Gant Condominiums. Each of the units is a three bedroom apartment. The property is zoned R-6 Mandatory P.U.D. The project was pro osed _a.s the "Cottonwoods" , but has changed their name to Black Swan tf 9L(i The Aspen Planning Commission on June 15, 1976 recommended approval of the Preliminary Plat and Preliminary P.U.D. Plan. The comments of the Planning Office are as follows : 1. The building is well located on the site and pre- serves the existing stands of large cottonwoods. The present use of the site is for a construction storage yard. 2. The P & Z and the Planning Office are recommending the normal parking requirement of one per bedroom which would require twelve (12) parking spaces be reduced to eight (8) parking spaces. The property is zoned Mandatory P.U.D. which allows variations in the number of parking spaces to be granted by the Council . We feel that proximity of the project to the Aspen Core facilitates pedestrian and bus transportation, and have therefore recommended a reduction to 8 parking spaces . 3. Mr. George Gleason, owner of the adjacent single family residence to the east, is relocating his access point to the Aspen Alps private road. His existing drive crosses the Black Swan property, but no easements were obtained by Mr. Gleason and he has agreed to move his access. v_�?, e/ 4. The open space dedication fee of $ 7 ;2 4,a; has been approved by Mick Mahoney. 5. Additional street dedication of 10 feet for Ute Avenue is reserved on the plat. j The Planning Office recommends approval of the Black Swan Hall Final P.U.D. plan and Final Subdivision plat conditioned upon the above requirements and those of the City Engineer.
