HomeMy WebLinkAboutagenda.council.special.202003131 AGENDA CITY COUNCIL SPECIAL MEETING March 13, 2020 3:00 PM, City Council Chambers I.CALL TO ORDER II.ROLL CALL ACTION ITEMS Resolution #20, Series of 2020 - Extension of the Declaration of Emergency Resolution #21, Series of 2020 - Amending City Council Rules and Regulation to Address Meetings During Times of Emergency III.ADJOURN 1 CITY OF ASPEN, COLORADO CITY COUNCIL RESOLUTION # 20 (Series of 2020) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, EXTENDING THE CITY OF ASPEN EMERGENCY DECLARATION OF MARCH 12, 2020 FOR COVID-19 LOCAL DISASTER WHEREAS, pursuant to the Colorado Disaster Emergency Act, C.R.S., Section 24-33.5-701, et seq., the City of Aspen (“City”) has identified a local disaster currently present in the City, to wit, the occurrence or imminent threat of widespread or severe damage, injury or loss of life or property resulting from COVID- 19 requiring emergency action to avert danger or damage and to protect public health; and WHEREAS, the cost and magnitude of responding to and recovery from the impact of COVID-19 is far in excess of the City’s available resources; and WHEREAS the Colorado Governor Jared Polis and Colorado Department of Public Health and Environment haveindicated the likelihood of community transmission of COVID-19 within the City of Aspen on March 11, 2020; and WHEREAS, pursuant to C.R.S. § 24-33.5-709, Aspen Municipal Code Chapter 4.12, and the emergency management and operations plans and resolutions of Aspen, Colorado, on March 12, 2020, at 14:07 Mountain Daylight Time, the City Manager declared a local disaster emergency. A copy of the declaration is attached hereto. Pursuant to C.R.S. § 24-33.5-709(1), the declaration shall not be continued or renewed for a period of in excess of seven days except by or with the consent of the City Council; and, WHEREAS, the City Council finds that it is appropriate and in the interests of the public health, safety, and welfare and would further protect property, for the City Council to ratify the actions of the City Manager and to extend the declaration until such time as the City Council terminates such declaration. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, Section 1. That the City Council hereby confirms, determines, and declares that there is a local disaster in Aspen, Colorado, to wit, the occurrence or imminent threat of widespread or severe damage, injury or loss of life or property resulting from COVID-19virus, including the presences and likelihood of additional cases, requiring emergency action to avert danger or damage. Section 2. That the effect of this declaration of disaster shall be to continue the response and recovery aspects of any and all applicable local and interjurisdictional disaster emergency plans and to authorize the furnishing of aid and assistance under such plans, including, but not limited toaid and assistancerequested or required to support Pitkin County. Colorado. 2 Section 3. That the City Manager is directed and authorized to continue coordination with internal and external partners and to direct city staff as appropriate and necessary to address the local disaster emergency. Section 4. That the City Council directs the City Manager to implement steps for long term continuity of government services. Section 5. That the City Council hereby ratifies and adopts the actions of the City Manager and hereby extends the Declaration of Local Disaster Emergency until such time as the City Council terminates such declaration. Section 6. That the City Clerk is directed to ensurethis resolution and declaration is promptly filed with the Pitkin County Clerk and Recorder, the Pitkin County Emergency Manager, and shall be distributed to the appropriate representatives of the news media. BE IT FURTHER RESOLVED that this Resolution shall be effective upon the date and time given below. INTRODUCED, READ AND ADOPTED by the City Council of the City of Aspen on the 13th day of March 2020, at ______p.m., Mountain Daylight Time. Nicole Henning, City Clerk 3 CITY OF ASPEN, COLORADO CITY COUNCIL RESOLUTION # 21 (Series of 2020) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, AMENDING CITY COUNCIL RULES AND REGULATIONS TO ADDRESS MEETINGS DURING TIMES OF EMERGENCY WHEREAS, pursuant to the Colorado Disaster Emergency Act, C.R.S., Section 24-33.5-701, et seq., the City of Aspen (“City”) has identified a local disaster currently present in the City, to wit, the occurrence or imminent threat of widespread or severe damage, injury or loss of life or property resulting from COVID- 19 requiring emergency action to avert danger or damage and to protect public health; and WHEREAS, pursuant to C.R.S. § 24-33.5-709, Aspen Municipal Code Chapter 4.12, and the emergency management and operations plans and resolutions of Aspen, Colorado, on March 12, 2020, at 14:07 Mountain Daylight Time, the City Manager declared a local disaster emergency. Pursuant to C.R.S. § 24-33.5-709 (1), the declaration shall not be continued or renewed for a period of in excess of seven days except by or with the consent of the City Council; and, WHEREAS, the City Council has ratified, adopted and extended the City Manager’s Declaration of Local Disaster Emergency; and, WHEREAS, in order to comply with the declaration, restrictions, and orders entered by the Pitkin County Public Health Director, the City Council finds that it is appropriate to amend the City Council Rules and Regulations adopted to pursuant to Resolution #51 (Series of 2005) to address the conduct of and attendance at meetings during a period in which an local disaster emergency has been declared. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, Section 1. That the City Council hereby amends the City Council Rules and Regulations by adding the following Section XX: The City Manager, with consultation and consent of the City Attorney, may adopt rules and procedures for the conduct of and attendance at City Council meetings through electronic means for City Council members and members of the public during a period in which a local disaster emergency has been declared.
