MAIN STREET, LEGALLY DESCRIBED AS LOTS A - I AND LOTS O — S, AND THE EASTERLY 20 FEET OF LOT N AND THE EASTERLY 170 FEET OF THE VACATED ALLEY ALL IN BLOCK 79, CITY AND TOWNSITE OF ASPEN, PITKIN COUNTY, COLORADO. Parcel ID: 273707321004 WHEREAS, the Community Development Department received an application from Sunny Vann of Vann Associates, LLC, on behalf of Iconic Properties — Jerome, L.L.C., requesting Temporary Use approval to erect the Ice Lounge for one -hundred and six (106) days per year and five (5) annual recurrences; and WHEREAS, pursuant to Chapter 26.450.050 of the Land Use Code, City Council may grant a temporary use approval for up to 180 days, and no more than ten (10) annual recurrences; and, WHEREAS, the applicant received approval via Resolution No. 173, Series of 2017 that allowed for various temporary use structures to be erected on site for up to seventy-four (74) days per year and five (5) annual recurrences, through 2022, with the ability to apply for an administrative extension for the temporary use approval for another five (5) years, through 2027; and, WHEREAS, the City Council has reviewed and considered the development proposal under the applicable provisions of the Municipal Code as identified herein, has reviewed and considered the recommendation of the Community Development Director, and has taken and considered public comment at a duly noticed public hearing on January 28, 2019 and continued the public hearing to February 25, 2019; and, WHEREAS, the City Council approves the Ice Lounge on the Mill Street terrace, allowing for temporary use of this structure for up to one -hundred and six (106) days per year; and, WHEREAS, the City Council finds that the request for the extended temporary use proposal for the Ice Lounge to be in accordance with the applicable development standards associated with the request, and has approved it for three (3) annual recurrences with the option to apply for an administrative extension of up to five (5) years after the initial approval; and, WHEREAS, the City Council finds that this resolution furthers and is necessary for the promotion of public health, safety and welfare. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: 0 • Section 1 Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the City Council hereby approves a Temporary Use request to allow the erection of the Ice Lounge on the Mill Street Terrace, for one -hundred and six (106) days in each calendar year for three (3) years, from February 2019 through December 2022. After three (3) years, the applicant may submit an application to be reviewed administratively for an additional five (5) annual recurrences (2023-2027). Section 2 Temporary structures that are approved on a site for a period greater than fourteen (14) days are subject to growth management review, resulting in affordable housing mitigation. The applicant is required to provide housing mitigation for one -hundred and six (106) days for the Ice Lounge. Staff has calculated the amount of affordable housing due, based on the fees in 2019, as $1012.13 Affordable Housing mitigation fees will be calculated at the current rate each year. Affordable Housing Mitigation for the Ice Lounge will be collected upon issuance of the tent permit for that structure. Each year, a new tent permit will be required. The methodology is shown in Exhibit A. Section 3: All temporary use structures on site must comply with the Outdoor Lighting Requirements outlined in Section 26.575.150 of the Land Use Code. A tent permit approval, including verification from the Aspen Fire Department that the structure meets all necessary safety requirements, is required prior to the erection of each temporary structure. If the Fire Department is unable to approve a tent in a given location it may not be erected. All material representations and commitments made by the Applicant pursuant to the temporary use proposal as herein awarded, whether in public hearing or documentation presented before the City Council, are hereby incorporated in such plan development approvals and the same shall be complied with as if fully set forth herein, unless amended by an authorized entity. Section 6: This resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 7: If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any 0 • reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. More specifically, approval was granted to erect tents in the Main Street courtyard and on the Mill Street terrace for a total of seventy-four (74) days per calendar year for a period of five (5) years commencing in January of 2018. The Mill Street terrace Ice Lounge was approved through April 1, 2018 with no annual recurrences. Proposed Temporary Use The Ice Lounge was erected and was well received by both Hotel guests and the general public during the 2018 winter. As a result, the Applicant would like to again erect the Ice Lounge for the 2019 winter and, as presently envisioned, during additional winters going forward. As the seasonal erection of the Ice Lounge on the Hotel's Mill Street terrace is expected to continue for the foreseeable future, the Applicant request that the City Council approve a minimum of five annual recurrences as provided for in Section 26.450.050.A. of the Regulations. A multi -year approval will preclude the need for the submission of annual applications. A maximum of ten such recurrences may be approved at the discretion of the Council. Pursuant to Section 26.450.050.A., temporary uses may not exceed one hundred and eighty (180) days in a 12-month period. As noted above, approval was previously granted for the erection of tents within the Hotel's Main Street courtyard and on its Mill Street terrace for a total of seventy-four (74) days. As a result, the duration of the Ice Lounge installation will be limited to a maximum of one hundred and six (106) days per calendar year. This limitation will allow the Lounge to remain open from January 1, 2019 to approximately April 16, weather permitting. Review Requirements The Applicants proposed Ice Lounge is subject to review pursuant to the City's Temporary and Seasonal Uses; Commercial Design Review; and Growth Management regulations. Each of these review requirements is addressed below. A. Temporary and Seasonal Uses The applicable review requirements for temporary uses, which are contained in Section 26.450.030, Temporary and Seasonal Uses, of the Regulations, and the proposed Ice Lounge's compliance therewith, is summarized below. 1. The location, size, design, operating characteristics and visual impacts of the proposed use. 0 • Mr. Garrett Larimer December 28, 2018 Page 3 The Ice Lounge will consist of an approximately 12 foot by 12 foot enclosure consisting of four approximately seven foot walls constructed entirely of ice blocks with an open door. The Lounge will be covered by an unenclosed canopy to shield the ice and guests from the weather. The Lounge will not contain either a bar or seats. Hotel guests and the general public can sign up with the Ice Lounge's host who will escort them to the Lounge for a vodka tasting. Pictures of the proposed Ice Lounge are attached as Exhibit 9. The Mill Street terrace is surrounded on three sides by the Hotel Jerome building, with only an approximately twenty (20) foot section of the terrace open to the street (see Exhibit 10). The terrace is located above the grade of the sidewalk, behind railings, and is set back from the building's Mill Street facade. As the pictures illustrate, the Ice Lounge will be located at the rear of the terrace. 2. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. The proposed Ice Lounge was approved and erected on the Mill Street terrace for the 2018 winter season and is believed to have had no adverse impact on the character, density and use of structures and uses in the immediate site area. 3. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns,. municipal services, noise levels and neighborhood character. The proposed Ice Lounge will have no adverse impact on pedestrian and vehicular traffic and will place no unusual demand on municipal services. The Lounge will comply with the City's applicable noise regulations, and the Hotel will manage its operation so as to minimize noise that would adversely impact its guests and the general public. 4. The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. Temporary Use approval has previously been granted. for the proposed Ice Lounge. The Lounge will be limited to a maximum duration of one hundred and six (106) days, and will be removed no later than April 16, 2019. Removal, howev- er, may occur sooner depending upon the weather. 5. The purposes and intent of the zone district in which the temporary use is proposed. Mr. Garrett Larimer December 28, 2018 Page 4 The Hotel Jerome is zoned CC, Commercial Core. Lodging uses are permitted by right in the CC zone district and are intended to support and enhance the City's local and resort economy. The proposed temporary use is consistent with this purpose in that it enables both locals and tourist to take full advantage of the various services provided by the Hotel. The City's approval of the requested Ice Lounge will significantly enhance the Hotel's ability to provided these services. 6. The relation of the temporary use to conditions and charac- ter changes which may have occurred in the area and zone district in which the use is proposed. The proposed Ice Lounge was previously erected and operated during the 2018 winter season with no known adverse impacts. To the best of the Applica- nt's knowledge, no changes in the condition or character of the immediate site area have occurred that would preclude its proposed erection and operation going forward. 7. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. The proposed Ice Lounge will have no adverse impact on the Commun- ity's public health, safety or welfare. B. Commercial Design Review . The proposed temporary use is also subject to Section 26.412.060.A., Com- mercial Design Review, of the Regulations. This Section requires that applications for Commercial Design Review comply with the `City's Commercial, Lodging and Historic District Design Standards and Guidelines. Per the Pre -Application Conference Summary, the Applicant need only respond to certain of the standards and guidelines. The applicable standards and guidelines, and the proposed temporary use's compliance therewith, are summarized below. 1. Section 1.22: Complete and accurate identification of materi- als is required. The proposed Ice Lounge will consist of a simple j]<1< block ice, walled enclosure with a small overhead canopy. The structure and canopy are essentially identical to that which was erected in 2018. 2. Section 1.23: Building materials shall have the following features: Mr. Garrett Larimer December 28, 2018 Page 5 • Convey the quality and range of materials found in the current block context or seen historically in the Character Area. • Convey pedestrian scale. • Enhance visual interest through texture, application, and/or dimen- sion. • Be non -reflective. • Have proven durability and weathering characteristics within Aspen's climate. • A material with an integral color shall be neutral color. This review criteria arguably does not apply as the proposed Ice Lounge is temporary in nature and does not incorporate traditional building materials. 3. Section 1.24: Introducing a new material, material applica- tion, or material finish to the existing streetscape may be approved by HPC or P&Z if the following criteria are met: • Innovative building design. . • Creative material application that positively contributes to the streetscape. • Environmentally sustainable building practice. The proposed Ice Lounge does not require review or approval by the HPC or P&Z. The Ice Lounge is temporary in nature and will not introduce new permanent building materials to the existing streetscape. 4. Section 1.25: Architecture that reflects corporate branding of the tenant is not permitted. The proposed Ice Lounge will not incorporate corporate branding. 5. Section 2.14: Architectural details should reinforce historic context and meet at least two of the following qualities: 0 Color or finish traditionally found downtown. Mr. Garrett Larimer December 28, 2018 Page 6 • Texture to create visual interest, especially for larger buildings. • Traditional material: Brick, stone, metal and wood. This review criteria arguably does not apply as the proposed Ice Lounge is temporary in nature and does not incorporate traditional building materials. 6. Section PA1.5: Street level Pedestrian Amenity areas shall be open to the sky. • Direct access to the Pedestrian Amenity from the street is required. • A street level Pedestrian Amenity space may be covered, subject to HPC or P&Z approval. If the space is covered, the street -facing portion shall be entirely open. The proposed Ice Lounge will be located within an existing open area on the Hotel property. While pedestrian access to the Hotel's Mill Street terrace is available from the adjacent sidewalk, access to the proposed Ice Lounge will be provided from within the Hotel proper. The Lounge will not occupy the entire terrace, portions of which will remain open to the sky. 7. Section PA1.7: Design amenity space that enhances the pedestrian experience and faces the street. See the response to guideline number PA1.6 above. C. Growth Management Pursuant to Section 26.470.090.I. of the Regulations, temporary uses that are erected for more than fourteen (14) days in a 12-month period are subject to affordable housing mitigation. Mitigation, however is only required for those days in excess of fourteen (14) in a-12-month period. As the fourteen (14) day exemption was applied to the Applicant's previously approved multi -year tent uses, mitigation will be required for the entire one hundred and six (106) day Ice Lounge temporary use. Mitigation in the. form of cash -in -lieu is permitted by right.
