ADJOURNMENT ♦ ,Y i RECORD OF PROCEEDINGS REGULAR MEETING BOARD OF ADJUSTMENT -NOVEMBER 13. 1986 Chairman Remo Lavagnino called the meeting to order at 4: 10 p.m. with Ron Erickson and Rick Head in attendance. Ann Austin and Charlie Paterson were also present but their terms had expired and therefore could not be used to fill the quorum. Remo apologized to the representatives of the Prospector and the Nitze applicants for this inconvenience . He explained these cases had to be postponed to a date certain which could be November 20 depending on whether Josephine Mann arrived back in town. He also explained that on November 24 , 1986 a decision should be made by the City Council about the three members whose terms have expired which is the reason we did not have a quorum on this date. Remo explained that on the 20th we could have four members which constitutes a quorum. In this case each case would need 100% of the approval of everyone present and voting for their variance. It is to the applicant ' s advantage to have a fifth person here in case one of the four decides against the variance. In such a case it could be tabled again. It would be left to the discreti- on of the representatives CASE #86-20 / NITZE After discussion as to when to reset the Nitze case it was discovered the sign posting may not have been done. Therefore time would have to be allowed for the posting and for renotifica- tion . Remo then noted that if the sign was posted this was indeed a legally constituted public hearing and we would have to make it a date certain. Remo then made a motion that Case #86-20 be tabled to December 4 , 1986 providing that the posting was done in a proper time frame required by law. The motion was seconded by Ron Erickson with all in favor. Remo then told Tom Wells " If you have the sign up we have a meeting December 4th, if you don't have your sign up you have to re-apply. " And explained that by not having posted the sign the requirements of the ordinance had not been met, that the respons- ibility is on the applicant to meet the requirements. And that a packet is offered to the applicant with the information in it to help people who apply for a variance. CASE #86-21 / PROSPECTOR Barry Lefkowitz asked if we were to reschedule this meeting to November 20, 1986 and four members were here and one said no then r would he still be able to come back. Remo explained he would be given the option to table the matter until we have a fifth member . Lefkowitz then asked to be scheduled for November 20 , 1986 . There was then discussion about blueprints with photographs attached. ( I found these immediately after this meeting was adjourned and mailed them the next day. ) Remo then made a motion table case #86-21 to November 20, 1986 at 4: 00 p.m. This was seconded by Ron Erickson with all ayes.
