SUBJECT & SITE OF Residential Design Standard Variance at
AMENDMENT: 1290 Snowbunny Lane
SUMMARY: The applicant is requesting a Variance from Subsection 26.410.040.D.3.a of the
Land Use Code that states "Street-facing windows shall not span through the area where a
second floor level would typically exist, which is between nine (9) and twelve feet (12) above
the finished first floor." The applicant is planning a remodel of this half of the existing duplex,
and is proposing two windows on a one-story street-facing element that extend to a height of 10'.
STAFF EVALUATION: The Code provides two criteria under which a Residential Design
Standard Variance may be granted, paraphrased below and detailed in Exhibit B. Only one of
these criteria must be met for a variance to be granted. Staff finds the following:
A) Provide an appropriate design or pattern of development considering the context in
which the development is proposed and the purpose of the particular standard.
Staff Response: The purpose of this standard is to provide some articulation between
building stories, to enhance the pedestrian scale and minimize the massing of a multi-story
residence. The newly proposed windows requiring a variance are on the unit's south, street-
facing fayade. This area of the building is an obvious one-story element. The proposed
windows span approximately one foot into this "no-window zone". Given the fact that these
windows are not spanning between stories of the building, Staff believes the purpose of the
standard is sufficiently met. Staff finds this criterion to be met.

Staff Response: Staff does not find any unusual site-specific constraints associated with this
parcel that would necessitate the granting of a variance in order to not deprive the owner of
reasonable use of the property.
DECISION: The Community Development Director finds the Administrative Application
for a Stream Margin Review Exemption, as noted above, to be consistent with the review
criteria (Exhibit B) and thereby, APPROVES the request.
