Hopkins Ave. AMENDMENT: Stream Margin Review Exemption SUMMARY: The applicant is requesting Exemption from Stream Margin Review for the remodel of a single-family residence. The applicant is proposing an extensive remodel of the building's interior and a minor remodel of the home's exterior fayade. According to the Engineering Dept. the interior remodel triggers the need to update the drainage for the site. The applicant has proposed to use existing infrastructure that sits within the 15' setback from the designated top of slope. A proposed project may available for a Stream Margin Review Exemption if the development meets the relevant review criteria, as found in Exhibit B to this approval. BACKGROUND: This property is located in the Residential Multi-Family (RMF) zone district, and is part of the East Aspen Addition Subdivision. The subject parcel hosts a two-story single-family residence. The home was constructed in 1988, prior to the adoption of Stream Margin Review standards, therefore there are some existing non-conformities. Specifically, the current building breaks through the 45 degree angle as measured from the top of slope, and there are large planters within the 15' setback from top of slope. CURRENT PROPOSAL: The application includes plans for an interior and exterior remodel of the existing home. At the southern end of the property the stone veneer will be removed from the garage, the existing roof deck will be upgraded with snowmelt and waterproof materials, and a new glass safety rail will be installed. On the northern side of the property the first and second story deck railings will be replaced. Throughout the building windows will be replaced, as well as portions of the existing roof. The roof currently extends into the 45 degree angle as measured from top of slope, however maintenance is permitted to maintain this non-conforming feature. 1 To accommodate Engineering Department's drainage requirements, the applicant has proposed turning two existing planters into rain gardens. One planter is east of the building, and extends slightly into the 15' area from top of slope. The other is north of the building, and exists fully within the 15' setback form top of slope. A four-inch wide (approximate) pipe will be placed on the existing timber walls to the east of the building that will provide water discharge to the northern rain garden. This will be above-ground, and will not require any modifications to the lot or an increase in support structure. STAFF EVALUATION: Per the proposed application, the remodel of the residence will use the existing building's footprint, and there will be no increase in the floor area of the structure. This is the first known request for Stream Margin Exemption, therefore this request does not exceed the proposed allowable 25% cumulative exemption. The proposed development does not require the removal of any tree on the property. There is no new development that will fall outside of the 15' setback from the top of slope. The proposal does not involve any increase to the amount of ground coverage structures within the 100-year flood plain. The Engineering Dept. is requiring the applicant to increase the drainage on the property as a result of the interior remodel. The applicant and City Engineer have agreed on a plan whereby two of the existing planter boxes on the site will be used as rain gardens to satisfy drainage requirements. The planter boxes are located within the 15' from top of slope area. The following are joint referral comments provided by both the Parks and Engineering Departments: • Liner and underdrains are required for the bio-retention areas; • The pipe to the west should be at-grade to protect the conifer tree; and • The Engineering Maintenance Plan should propose what maintenance is required should the No Problem Jo Trail be washed out or if the planter material washes into the trail. In their conversion to rain gardens, the exterior of the planter boxes will not be modified. Since these features are pre-existing within the 15' setback from the top of slope, they will be permitted to be maintained and used in the proposed manner. Staff finds all necessary criteria to be met to grant an administrative Stream Margin Review Exemption. DECISION: The Community Development Director finds the Administrative Application for a Stream Margin Review Exemption, as noted above, to be consistent with the review criteria (Exhibit B) and thereby, APPROVES the request,with conditions. Exhibit B Review Criteria 26.435.040.B. Stream Margin Review Exemptions The Community Development Director may exempt the following types of development within the stream margin review area: 1. Construction of pedestrian or automobile bridges, public trails or structures for irrigation, drainage, flood control or water diversion, bank stabilization, provided plans and specifications are submitted to the City engineer demonstrating that the structure is engineered to prevent blockage of drainage channels during peak flows and the Community Development Director determines the proposed structure complies, to the extent practical, with the stream margin review standards. Staff Response: This application does not involve the construction of any of the above- listed structures. Staff finds this criterion to be not-applicable. 2. Construction of improvements essential for public health and safety which cannot be reasonably accommodated outside of the "no development area" prescribed by this Section including, but not limited to, potable water systems, sanitary sewer, utilities and fire suppression systems provided the Community Development Director determines the development complies, to the extent practical, with the stream margin review standards. Staff Response: This application does not involve the construction of any of the above- listed structures. Staff finds this criterion to be not-applicable. 3. The expansion, remodeling or reconstruction of an existing development provided the following standards are met: a) The development does not add more than ten percent (10%) to the floor area of the existing structure or increase the amount of building area exempt from floor area calculations by more than twenty-five percent (25%). All stream margin exemptions are cumulative. Once a development reaches these totals, a stream margin review by the Planning and Zoning Commission is required; and Staff Response: The proposed development does not increase the floor area of the existing structure. The remodel does not increase the amount of building area exempt from floor area by more than 25%. This is the first known request for a Stream Margin Exemption for the subject property. Staff finds this criterion to be met. b) The development does not require the removal of any tree for which a permit would be required pursuant to Chapter 13.20 of this Code. Staff Response: The proposed development does not require the removal of any tree on the property. Staff finds this criterion to be met. c) The development is located such that no portion of the expansion, remodeling or reconstruction will be any closer to the high water line than is the existing development; 1 Staff Response: The proposed development will not be any closer to the high water line. Due to the extent of the interior remodel Engineering is requiring a reconfiguration of the drainage currently found on the property. The applicant will use the existing planter beds located below the I5'setback from the top of slope as rain gardens. The planter beds will be modified with a liner and interior materials, but will not be modified such that their footprint will increase, nor will the walls of the boxes increase in height. Staff finds this criterion to be met. d) The development does not fall outside of an approved building envelope if one has been designated through a prior review; and Staff Response: The remodel of the home maintains the existing building footprint. The existing rain gardens are located outside of the 15' setback from the top of slope area. No new development will fall outside of the approved building envelope. Staff finds this criterion to bet met. e) The expansion, remodeling or reconstruction will cause no increase to the amount of ground coverage of structures within the 100-year flood plain. Staff Response: The proposed remodel of the building and the enhanced use of the existing rain gardens for site drainage will cause no increase to the amount of ground coverage of structures within the 100 year flood plain. Staff finds this criterion to be met. 2 Exhibit C Department Referrals The following are joint comments made by David Radeck, Parks Department, and Josh Rice, Engineering Department. For 898 E. Hopkins: We would like to see the following: I. Liner and underdrains for the bio-retention areas: the bio-retention areas should be lined to provide a longer longevity of the planter boxes. The bio-retention areas should utilize an underdrain. 2. The pipe to the west should be at-grade so that the conifer is unaffected. 3. The Engineering maintenance plan should propose what maintenance is required should the trail washed out or if planter material washes into the trail. The maintenance agreement currently requires that any deficiencies found during an inspection be cured within 30 days. A flat fee or deposit is collected for land use applications based on the type of application submitted. A flat fee is collected by Community Development for applications which normally take a minimal and predictable amount of staff time to process. Review fees for other City departments reviewing the application (referral departments) will also be collected when necessary. Flat fees are cumulative — meaning an application with multiple flat fees must pay the sum of those flat fees. Flat fees are not refundable. A review fee deposit is collected by Community Development when more extensive staff review is required. Actual staff time spent will be charged against the deposit. Various City staff may also charge their time spent on the case in addition to the case planner. Deposit amounts may be reduced if, in the opinion of the Community Development Director, the project is expected to take significantly less time to process than the deposit indicates. A determination on the deposit amount shall be made during the pre-application conference by the case planner. Hourly billing shall still apply. All applications must include an Agreement to Pay Application Fees. One payment including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the City of Aspen. Applications will not be accepted for processing without the required application fee. The Community Development Department shall keep an accurate record of the actual time required for the processing of a land use application requiring a deposit. The City can provide a summary report of fees due at the applicant's request. The applicant will be billed for the additional costs incurred by the City when the processing of an application by the Community Development Department takes more time or expense than is covered by the deposit. Any direct costs attributable to a project review shall be billed to the applicant with no additional administrative charge. In the event the processing of an application takes less time than provided for by the deposit, the department shall refund the unused portion of the deposited fee to the applicant. Fees shall be due regardless of whether an applicant receives approval. Unless otherwise combined by the Director for simplicity of billing, all applications for conceptual, final, and recordation of approval documents shall be handled as individual cases for the purposes of billing. Upon conceptual approval all billing shall be reconciled and all past due invoices shall be paid prior to the Director accepting an application for final review. Final review shall require a new deposit at the rate in effect at the time of final application submission. Upon final approval all billing shall again be reconciled prior to the Director accepting an application for review of technical documents for recordation. The Community Development Director may cease processing of a land use application for which an unpaid invoice is 30 or more days past due. Unpaid invoices of 90 or more days past due may be assessed a late fee of 1.75% per month. An unpaid invoice of 120 days or more may be subject to additional actions as may be assigned by the Municipal Court Judge. All payment information is public domain. All invoices shall be paid prior to issuance of a Development Order or recordation of development agreements and plats. The City will not accept a building permit for a property until all invoices are paid in full. For permits already accepted, an unpaid invoice of 90 or more days may result in cessation of building permit processing or issuance of a stop work order until full payment is made. The property owner of record is the party responsible for payment of all costs associated with a land use application for the property. Hopkins is planning a remodel of their existing single family house. The remodel does not involve an increase in floor area. The existing house was built in 1988, before the adoption of Stream Margin regulations which require care in the development of properties adjacent to the Roaring Fork River, like this one. The house is non-conforming with Stream Margin rules in several ways. No development may take place below a boundary identified as the "top of slope." Within 15' uphill of the top of slope, no development other than native plantings is permitted. All development is required to remain below the height of a 45 degree angle projected from the top of slope. At 898 E. Hopkins, the 45 degree layback from top of slope is not met and there are numerous landscape features constructed within the development setback along the north property line. These elements can remain in place, however any documentation (prior surveys, building permit records, etc.) that can be provided to show that the features were legally constructed will assist in the building permit review process. All new improvements must meet today's standards. The scope of the proposed home remodel requires compliance with the City's storm water standards. The applicant plans to pay a cash-in-lieu fee for detention, but must create a filter to improve the quality of runoff before it leaves the site. The proposal is to convert an existing planter which abuts the top of slope into a rain garden. Nothing about the planter structure will be changed, but it will be lined and filled with the appropriate filtering material. Drain pipes that collect water on the site will need to be run to the rain gardens. All of this occurs in the area where no development other than native plantings is typically permitted. This work does require a land use review, as an administrative Community Development Director Exemption.
