It is really broad at the moment and I can't deem it complete. Here are my initial concerns: 1) There is no stamped survey. Survey or surveys showing topography, land areas that are subtracted from the calculation of floor area and information typically seen for stream margin review: clear flood plain information, top of slope and high water line for the site. 2) There is no dimensional information. How high are the buildings? How high will they be with some of the changes? 3) 1 also need to look over the proof of ownership a bit more. I'm happy to discuss but I'm literally leaving right now and will be out of the office for a week. PUD Amendment and Rezoning to RMF/PUD Parcel ID#273718131800 3 September 2073 PROJECT OVERVIEW The Aspen Club Condominium Association, Inc. (the "Applicant"), representing the individual owners of the units located at 1450 Crystal Lake Road, also known as Lots 13 and 13A of the Callahan Subdivision PUD (the "Property"), submit this application to amend the Planned Unit Development. The PUD Amendment will allow for possible expansions of the units by increasing the allowable floor area for the entire development to 75,000 sq. ft. The Applicant also proposes to rezone the Property to Residential Multi-Family (RMF)/PUD. This application is submitted in conformance with the pre-application conference summary dated 15 May 2013. The Property consists of approximately 6.6 acres and was originally zoned R-15/PUD. The existing floor area is 47,411 SF. The proposed increase in available floor area will be available to individual unit owners only if applicable zoning, building code, and HOA requirements can be met. Possible additions, which are identified in the menu of possible additions made a part of this application,would receive Stream Margin Review in connection with this application. The RMF zone district is a more appropriate zoning designation given the current and future multi-family use of the Property. Based on the lot area of the site and current dimensional requirements of the RMF zone district, the Property could conceivably support over 215,000 SF of available floor area. Therefore, the proposed 75,000 SF is considerably less than what the Property could yield based on a standard application of the Land Use Code for multi-family residential development. All potential additions that would be available to individual unit owners would be constructed within the existing vertical and horizontal building envelope of the existing units. The Supplemental Condominium Map No. 4, recorded at Book 100, Page 26, Pitkin County Clerk and Recorder's Office,which was prepared in connection with the Insubstantial Amendment Application, received Administrative Approval 15 June 2012. It recorded all modifications that occurred on the Property to date. The Supplemental Map No. 4, which is the basis of the possible expansion that will be available to individual unit owners, was prepared and verified by a registered land surveyor with regards to setback and site coverage. It includes,where appropriate, updated unit floor plans which reflecting new bedrooms, decks, and basement expansions that occurred since the prior Supplemental Condominium maps were recorded. This PUD Amendment will adequately address the future needs of the Applicant while also ensuring that modifications contemplated in the future will be fully compliant with the City of Aspen Land Use Code and applicable building codes. An applicant may appeal an amendment determination made by the Planning and Zoning Commission to the City Council.In this case, the determination made by the Planning and Zoning Commission shall be considered a recommendation and the amendment shall be subject to final development plan review and approval by the City Council,pursuant to Subsection 26.445.030.C,Step 4. An amendment found to be inconsistent with the approved final development plan by the Community Development Director shall be subject to final development plan review and approval by the Planning and Zoning Commission and City Council,pursuant to Subsection 26.445.030.C,Steps 3 and 4. During the review of the proposed amendment,the Planning and Zoning Commission and City Council may require such conditions of approval as are necessary to insure that the development will be compatible with current community circumstances.This shall include,but not be limited to,portions of the development which have not obtained building permits or are proposed to be amended,any new community policies or regulations which have been implemented since the original approval or changed or changing community circumstances as they affect the project's original representations and commitments. The applicant may withdraw the proposed amendment at any time during the review process. The proposed amendment to the PUD, which would increase the available floor area from 47,411 SF to 75,000 SF, is consistent with and enhancement recommended follow-on activity to the final approval for the Townhomes in the Subdivision Improvement/ Planned Unit Development Agreement, recorded at Book 312, Page 110. The proposed PUD Amendment will not increase the number of units nor would it increase maximum allowable height or site coverage on the site. Additions that utilize the additional floor area will primarily consist of deck expansions, additional bedrooms, and other additions which will be contained within the existing building envelope. The multi-family use will be continued and no new buildings are anticipated to be built at this time. The proposed increase in floor area will be available to the entire development and will be divided among the existing units as the home owners association deems appropriate. The Applicant understands that by conferring additional floor area the City is in no way ensuring that the floor area can be used in any given unit. Standard zoning, building codes, and Homeowner Association requirements will be required to be met. A menu of possible additions that may be pursued by individual unit owners has been included and made a part of this application. The Applicant requests that these additions receive Stream Margin Review as a part of this application. Given that the additional floor area will be utilized in manner consistent with applicable City and HOA requirements, the additional available floor area will be compatible with all current community circumstances. Page 2 PUD Amendment and Rezoning to RMF/PUD Parcel ID#273718131800 3 September 2013 26.435.40 Stream margin Review The provision of the stream margin review shall apply to all development within one hundred(100)feet, measure horizontally,from the high water line of the Roaring Fork River and its tributary stream and to all development within the Flood Hazard Area,also known as the 100-year flood plain. No new development is contemplated with this application. The menu of possible additions,which has been made a part of this application, identifies possible additions to all units. The Applicant requests that these possible additions receive Stream Margin Review. 26.310.060.Rezoning-Procedure for amendment. A.General.An application for amendments the Official Zone District Map may be initiated by the City Council,the Community Development Director,or a person or persons owning more than fifty(50)percent of the area of land subject to the amendment and shall be processed in accordance with the common development review procedures set forth at Chapter 26.304. This application is submitted by more than fifty (50) percent of the owners of the units of the Aspen Club Condominium Association. Approval forms from the owners have been made a part of this application. Staff has previously expressed support for the proposed rezoning which would correct a zone district inconsistency. The current R-15 zoning does not support the existing use of the Property as multi-family residential. The rezoning of the Property to RMF would support the existing and future multi-family use, as well as support the proposed increase in available floor area. SUMMARY:In 1976 the Callahan Subdivision/PUD was approved.As part of the subdivision, 20 multi=family residential units were approved on Lots 13 and 13A. These units were subsequently condominiumized as the Aspen Club Condominiums (Book 6, Page 20). The original approval of the townhomes in the SIMPUD agreement noted that the average sq.ft.per unit was 2,115 and the average sq. ft.of buildings was 43,560(Book 312,Page 110).Both of these numbers appear to be gross square footage numbers as the code at the time did not have any standards for calculating Floor Area.This is problematic under today's code as building size is calculated based on Floor Area not gross square footage. The current zoning of the property is R-15/PUD and the Callahan Subdivision entitlements clearly provided for a multi-family component as part of this subdivision. Extensions and expansions have occurred. The Applicant is requesting to memorialize changes that have occurred as well as memorialize and legitimize the current,built Floor Area of these units. STAFF EVALUATION:Staff finds that the request meets the requirements of an Insubstantial PUD Amendment and that it is in the city's interest to memorialize a baseline, existing Floor Area for the townhomes. Updating the condominium plat to show current conditions will legitimize development that has occurred over time while developing an existing baseline Floor Area will permit the development to be reviewed under current terminology in the land use code today or with any future development applications that may be submitted.
