HomeMy WebLinkAboutordinance.council.027-14 ORDINANCE N0. 27, (SERIES OF 2014) AN ORDINANCE OF THE ASPEN CITY COUNCIL APPROVING AN AMENDMENT TO THE LANDMARK DESIGNATION FOR THE PROPERTY LOCATED AT 417 AND 421 WEST HALLAM STREET, LOTS D, E, AND THE EAST 39 INCHES OF LOT C, BLOCK 36, UNITS A AND B OF THE HALLAM STREET CONDOMINIUMS, CITY AND TOWNSITE OF ASPEN, COUNTY OF PITKIN, STATE OF COLORADO Parcel ID: 2735-124-33-007 and 2735-124-33-008 WHEREAS, the applicant, David and Marcia Kaplan, represented by 1 Friday Design Collaborative and Thomas Pheasant, requested an amendment to the historic landmark designation for the property located at 417 and 421 West Hallam Street, Units A and B of the Hallam Street Condominium, City and Townsite of Aspen; and WHEREAS, City Council Ordinance 34, Series of 1992 designated Unit A of the Hallam Street Condominiums on the Aspen Inventory of Non-Landmark Historic Sites and Structures, and Unit A which is the non-historic half of the duplex; and WHEREAS, Community Development Department and the applicant are pursuing an amendment to the landmark designation legal description to correct the clerical error that designates the non-historic half of the duplex which is under City Council's authority; and WHEREAS, during a duly noticed public hearing on July 23, 2014 the Historic Preservation Commission recommended approval of the landmark designation amendment via Resolution No. 22, Series of 2014; and WHEREAS, upon initial review of the application and the applicable code standards, the Community Development Department recommended approval of the amendment; and, WHEREAS, the Aspen City Council has reviewed and considered the development proposal under the applicable provisions of the Municipal Code as identified herein, has reviewed and considered the recommendation of the Historic Preservation Commission and the Community Development Director, and has taken and considered public comment at a public hearing; and, WHEREAS, the City Council finds that the development proposal meets or exceeds all applicable development standards with conditions; and, WHEREAS, the City Council finds that this Ordinance furthers and is necessary for the promotion of public health, safety, and welfare. Vos Caudill, Pitkin County, CO Page 1 of 2 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO THAT: Section 1 The property located at Lots D, E and the East 39 inches of Lot C, Block 36, City and Townsite of Aspen Colorado, Units A and B of the Hallam Street Condominiums, Pitkin County Clerk and Recorder recordation # 199427, and buildings thereon are hereby added to the Aspen Inventory of Historic Landmark Sites and Structures. Section 2• This Ordinance shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 3• If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
