HomeMy WebLinkAboutordinance.council.006-15 ORDINANCE No.6 (Series of 2015) AN ORDINANCE OF THE ASPEN CITY COUNCIL ADOPTING AMENDMENTS TO CHAPTER 9.10—CONDUCT OF MUNICIPAL ELECTIONS OF THE CITY OF ASPEN MUNICIPAL CODE. WHEREAS, City Council approved Resolution 10, Series of 2015, designating the May 5th, 2015 general election as a mail ballot election; and, WHEREAS, C.R.S. 31-10-101, et seq. sets forth the procedures for conducting a municipal election; and, WHEREAS, Section 1.04.060 of the City of Aspen Municipal Code authorizes amendments to the code. NOW, THEREFORE BE.IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN,COLORADO THAT: Section 1: That The Municipal Code of the City of Aspen,Colorado, is hereby amended by adding a` section which said section reads as follows: Section 9.10.160 Mail Ballot Elections Mail Ballot elections shall be conducted pursuant to the Colorado Municipal Election Code, Section 31-10- 101, et seq. except as set forth below. (a) Any nominating petition in a mail ballot election may be circulated and signed beginning on the ninety-first day prior to the election and must be filed with the municipal clerk no later than the close of business on the second Monday in March prior to the election. The petition may be amended to correct or replace signatures that the clerk finds are not in apparent conformity with the requirements of the Colorado Municipal Election Code by filing such changes by no later than the close of business on the sixth day following the petition deadline. (b) Affidavits for write in candidates shall be filed with the City Clerk before the close of business on the third day following the nominating petition deadline. (c) Affidavits for withdraw shall be filed with the City Clerk by the close of business on the ninth day following the petition deadline. Section 2. This ordinance shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 3. If any section, subsection, sentence, clause, phrase,or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 4• A public hearing on this ordinance shall be held on the 9`h day of February, 2015, at a meeting of the Aspen City Council commencing at 5:00 p.m. in the City Council Chambers,Aspen City Hall,Aspen, Colorado Section 5• The City Clerk is directed, upon the adoption of this Ordinance,to publish a copy of this ordinance in a newspaper of general circulation within ten(10)days, or as soon as possible thereafter as possible. This ordinance, if adopted, will approve amendments to Chapter 9.10 of the municipal code regarding mail ballot elections.
