APPLICANT has submitted to CITY an application for 627 W Main Street Aspen CO 81611 (hereinafter,THE PROJECT). 2. APPLICANT understands and agrees that the City of Aspen has an adopted fee structure for Land Use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. 3. APPLICANT and CITY agree that because of the size,nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis. APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty of recovering its full costs to process APPLICANT'S application. 4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete processing or present sufficient information to the Historic Preservation Commission, Planning and Zoning Commission and/or City Council to enable the Historic Preservation Commission, Planning and Zoning Commission and/or City Council to make legally required findings for project consideration, unless current billings are paid in full prior to decision. 5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect full fees prior to a determination of application completeness,APPLICANT shall pay an initial deposit in the amount of$Paid at time of conceptual which is for 12 hours of Community Development staff time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse the CITY for the processing of the application mentioned above, including post approval review at a rate of$245.00 per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date. There shall be no deviations from the exterior elevations as approved without first being reviewed and approved by HPC staff and monitor, or the full board. 6. The conditions of approval will be required to be printed on the cover sheet of the building permit plan set and all other prints made for the purpose of construction. 7. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part of the building permit application indicating that all conditions of z approval are known and understood and must meet with the Historic Preservation Officer prior to applying for the building permit. 8. The development approvals granted herein shall constitute a site-specific development plan vested for a period of three (3) years from the date of issuance of a development order. However, any failure to abide by any of the terms and conditions attendant to this approval shall result in the forfeiture of said vested property rights. Unless otherwise exempted or extended, failure to properly record all plats and agreements required to be recorded, as specified herein, within 180 days of the effective date of.the development order shall also result in the forfeiture of said vested property rights and shall render the development order void within the meaning of Section 26.104.050 (Void permits). Zoning that is not part of the approved site-specific development plan shall not result in the creation of a vested property right. Chairperson, Michael Hoffman called the meeting to order at 5:00 p.m. Commissioners in attendance: Alison Agley; Ann Mullins, Jay Maytin, and Brian McNellis. Nora Berko and Sarah;Broughton where excused. Staff present: Jim True, Special Counsel Amy Guthrie, Historic Preservation Officer Sara Adams, Historic Preservation Planner Kathy Strickland, Chief Deputy City Clerk MOTION: Jay moved to approve the minutes of May 28`h, ,Tune 11`h and the amended minutes of June 25`h; second by Brian. All in favor, motion carried. 627 W. Main Street—Final Development— Public Hearing Amy said the project is a brick Victorian on Main Street and it already has an existing addition to it. The proposal is to modify the addition and add a second floor to the addition. A number of revisions have been made in order to make sure the presence of the addition was minimumized from Main . . Street. At conceptual approval there where'no conditions placed on asking for restudy on the design. This is'final'revrew and we are focused on landscape plan, lighting, fenestration and'selection of materials. A few things need clarification. In terms of landscaping there is no new landscaping as they do not have a large front yard. The only thing new is the sidewalk that wraps to the secondary entry. A cut sheet for the lighting plan has been submitted. The roof of the addition is asphalt shingles that have a little shadow line to it. The addition will be sided with clapboard. As part of the incentive for granting the bonus the applicant represented that they would remove the paint on the masonry and they have actually commenced the work. It looks like there where concrete patches that where concealed by the paint. There is railing around the entire deck on the new addition which is horizontal cable and staff recommends that it be some kind of wood material. Cut sheets for the windows on the new construction have been submitted. A cut sheet for the new front door has been presented. Right now there is a full light door with a stained glass that is not stylistically appropriate to the house. They are proposing something much more traditional with a half light and two panels below. The last issue that needs clarified is the front porch and the proportions of the columns: After researching staff feels there never was a front porch. HPC needs to decide if it should stay or be removed. Staff recommends approval of the project. Steev Wilson, Forum Phi— We are not putting any lighting on the historic building, only on the addition. There are some parts of the brick that are going to need patching and re-pointing and there are other parts that are filled with gray concrete. We would,Jike.to fill the patches.in with a matching material. Amy said we need to`do a site visit and normally we would like the patches to be replac6d with brick again. Ann inquired about the front porch. Steev said the porch has been there since the 70's. It is functional and the owner would like to leave it. We would repair it and keep it. In terms of the windows and doors they would be wood on the interior and exterior. The current windows would be painted. The siding would be a cedar clapboard. Michael asked about the recommendation from staff regarding the railing. Steev said we are proposing a cable rail that is light and easy to see through. We would prefer not to have a wall like railing. Jay asked about how much work would be done to the existing porch. Steev said they would just paint it and make sure the shingles are patched. We will not be restructuring it or putting in any lights. _ Amy pointed out that the porch is not ori the Sanborn map. If it where removed they might have other problems to address. We do not know if it is attached to the brick. Alison asked about the west elevation and the triangle window above the double hung windows. The glass block was removed and a double hung window put in. Chairperson, Michael Hoffman_opened the public hearing. Haley Dodd, neighbor asked about the railing on the new addition. It would be a two inch with wire. Maybe something more in keeping with the Victorian should be installed. They are within 12 feet of my house. Ann said the drawings are commendable and is the triangle clear glass? Michael pointed out that the triangle window is an existing element. Brian said he doesn't feel strongly about removing the window. Alison said with the FAR bonus we should remove the triangle window. Alison supports the proposed railing and it meets guideline 10.4. What we do with additions is to make=them a product of their own time. To do a more traditional balustrade on the addition would not read well. Michael commented that the narrower materials allow a better interpretation of the historic resource. Michael said he can support the modern railing. Jay said he supports the railing as presented. Less mass would be more sympathetic to the neighbor and since it is an addition it is a product of it sown time which meetsguideline j 0.4, If we where requiring the dormer to be removed then the triangle window;sho "d be removed but that is not the case so I am in support of the first recommendation to leave the window as -is. .,.. MOTION: Ann made the motion to approve resolution #16 for 627 W. Main with the condition that staff and monitor review the brick patches. All of HPC's standard conditions apply, second by Jay. Discussion: Amy said the applicant desires to use the front door elsewhere on the building. Steev said it would be used in the rear of one of the bedrooms. Michael said he feels the triangular glass is a further intrusion into the historic resource. Roll call vote: Ann,yes; Jay, yes; Brian,yes; Alison, no; Michael,yes. Motion carried 4-1. Isis Notch =.406',`k Hopkins Amy said the Isis Theatre is a designated landmark and in an historic district. The property came through in the mid 1990's from a simple theatre to a five screen theatre with residential on the roof. At the time the City had .,.. a requirement that 25% of any lot be left as open space. 25% of this lot 3 ASPEN HISTORIC PRESERVATION COMMISSION MINUTES OF JULY 9, 2008 �... would have been the entire parcel running along the west'side of the �., building. It was decided that it wasn't in the best interest to leave that area open so a portion of it was developed and a portion of the front was left open and the City received money as cash-in-lieu. for the open space not provided on the site. Over the years the front has been used as a waiting area for movies etc. The city has become the owner of the Isis Theatre and the owners of the residence on the roof have concerns with the use of the area. Skate boarders are hanging out etc. and they would like to see some improvements, some streetscape friendliness. The City hired Studio B. Joseph Speers from Studio B said the`concern of the proposed plan is that the idea of engaging the public is not`;presented in the plan. The Parks Dept. is concerned about benches in the'planting strip because they could be hit by snow plows, car doors etc. We need to figure out how to make this more pedestrian friendly. There is also a bike rack proposed in the plan. Susie Krevoy, residential owner above the Isis. The concern is the safety of our family. It tends to be a hangout area for skate boarders. The theater staff uses it as their smoking, drinking area. It is a party area and there is trash everywhere. Besides.making it more visually beautiful we would like ... some kind of separation where we can walk into our home. It is the entrance to a home and the exit of the theater. It is really unclear where the theater entrance is. Joseph Speers, Studio B architects said they where hired by the City to work with everyone and come up with a compromise. We tried to-create the separation and we also created plantings and organizations that people won't be able to hang out too much. There'I§a bike rack between the street trees. We identified a better exit for the theater. The planters are raised off the ground due to the snow melt about 1.8 inches and then it is raised to 36 inches which will have smaller flowers and grasses. The planters are brick and line up with the break between the doors. The planters are brick and will tie in well with the fire station when built. Ann said she sympathizes with the homeowner and that area is intimidating. It is not the place for a bench. The plan needs some work and you might want to involve a landscape architect. You need to distinguish the public place so that people go through quickly. The entrance to the residence should be a much more detailed scale. Maybe there could be a gate. The public space should relate more to the other public space near the fire 4 MEMORANDUM TO: Aspen Historic Preservation Commission FROM: ' Amy Guthrie, Historic Preservation Officer RE: 627 W. Main Street- Major Development (Final), Public Hearing DATE: July 10, 2008 SUMMARY: The applicant requests Final HPC approval to make an addition to this Victorian era home, which is located in the Main Street Historic District. The addition is to the rear of the property and includes living space and a one stall garage. Restoration work is proposed for the Victorian, including removing paint from the masonry. Conceptual approval, and a 500 square foot FAR bonus were granted on May 14`h. Main Street, Lot B, Block 25, City and Townsite of Aspen. ZONING: "MU, Mixed Use." MAJOR DEVELOPMENT (FINAL) The procedure for a Major Development Review is as follows. Staff reviews the submittal materials and prepares a report that analyzes the project's conformance with the design guidelines and other applicable Land Use Code Sections. This report is transmitted to the ,HPC with relevant information on the proposed project and a recommendation to continue, approve, disapprove or approve with conditions and the reasons for the recommendation. The HPC will review the application, the staff analysis report and the evidence presented at the hearing to determine the project's conformance with the City of Aspen Historic Preservation 1 Design Guidelines. The HPC may approve, disapprove, approve with conditions, or continue the application to obtain additional information necessary to make a decision to approve or deny. Major Development is a two-step process requiring approval by the HPC of a Conceptual Development Plan, and then a Final Development Plan. Approval of a Conceptual Development Plan shall be binding upon HPC in regards to the location and form of the envelope of the structure(s) and/or addition(s) as depicted in the Conceptual Plan application including its height, scale, massing and proportions. No changes will be made to this aspect of the proposed development by the HPC as part of their review of the Final Development Plan unless agreed to by the applicant. Staff Response: Final review deals with details such as the landscape plan, lighting, fenestration and selection of new materials. A list of the relevant design guidelines is attached as "Exhibit A." Only those guidelines where discussion is needed are included in the memo. The property is located at the western end of the Main Street Historic District, where 19`h century residential structures are prevalent. This house is constructed of masonry, which is unusual among the Victorians left in Aspen. Although the zone district is mixed use, this property remains a single family home. Previous alterations to the structure include painting the masonry, replacing doors and windows, and adding a dormer on the roof. There is an existing addition at the back of the house, part of which is demolished and replaced in this project. HPC held a worksession and two Conceptual review meetings. A number of adjustments to the massing of the new construction were made in order to meet the design guidelines and the FAR bonus criteria. The project is unchanged from what approved by HPC in May. There are a handful of issues that need further clarification. The architect has indicated that there will be no new landscaping. The one element added to the site is the walkway that wraps down the west side of the structure. Limited new exterior lighting is planned, however cut sheets will be provided to HPC at the meeting. The addition is to be roofed with shingles, with a sample provided to HPC at the meeting. A small area of metal roofing is proposed over the new staircase. The addition will be sided with clapboards. The windows are double hung and cut sheets will be needed for review by staff and monitor. HPC 'should consider whether it would be more appropriate to install a more traditional baluster railing than the proposed horizontal cables. As part of the discussion of the FAR bonus, the fact that the non-historic front door is not stylistically appropriate to the house came up. The owner would like to relocate that door, perhaps to the new addition. Clarification is needed, and a design for the new front door must be submitted for HPC review or staff and monitor review. After further research, staff has 2 ` determined that the house did not originally have a front porch. Although we don't believe HPC can insist on its removal (if that is even desired), it is worth discussing the options for clarifying the historic appearance of this.primary fagade of the building. DECISION MAKING OPTIONS: The HPC may: • approve the application, • approve the application with conditions, • disapprove the application, or • continue the application to a date certain to obtain additional information necessary to make a decision to approve or deny. RECOMMENDATION: Staff recommends HPC grant Major Development (Final) for the property located at 627 W. Main Street, Lot B, Block 25, City and Townsite of Aspen, Colorado after viewing the samples and cut sheets mentioned above. Exhibits: A. Relevant Design Guidelines B. May 14, 2008 minutes C. Main Street, Final Review" 1.9 Maintain the established progression of public-to-private spaces when considering a rehabilitation project. ❑ This includes a sequence of experiences, beginning with the "public" sidewalk, proceeding along a "semi-public" walkway, to a "semi-private" porch or entry feature and ending in the "private" spaces beyond. ❑ Provide a walkway running perpendicular from the street to the front entry. Meandering walkways are discouraged, except where it is needed to avoid a tree. ❑ Use paving materials that are similar to those used historically for the building style. Concrete,wood or sandstone may be appropriate for certain building styles. 1.10 Preserve historic elements of the yard to provide an appropriate context for historic structures. ❑ The front yard should be maintained in a traditional manner, with planting material and sod, and not covered with paving,for example. 4.5 When replacing a door,use a design that has an appearance similar to the original door or a door associated with the style of the house. ❑ A replica of the original, if evidence exists,is the preferred replacement. ❑ A historic door from a similar building also may be considered. ❑ Simple paneled doors were typical. 3 ❑ Very ornate doors, including stained or leaded glass, are discouraged, unless photographic evidence can support their use. 5.5 If porch replacement is necessary, reconstruct it to match the original in form and detail. ❑ Use materials that appear similar to the original. ❑ While matching original materials is preferred, when detailed correctly and painted appropriately,alternative materials may be considered. ❑ Where no evidence of the appearance of the historic porch exists, a new porch may be considered that is similar in character to those found,on comparable buildings. Keep the style and form simple. Also, avoid applying'decorative elements that are not known to have been used on the house or others like it. ❑ When constructing a new porch,its depth should be in scale with the building. ❑ The scale of porch columns also should be similar to that of the trimwork. ❑ The height of the railing and the spacing of balusters should appear similar to those used historically as well. 7.9 New or replacement roof materials should convey a scale, color and texture similar to those used traditionally. ❑ Replacement materials should be similar to those used historically on comparably styled buildings. ❑ If a substitute is used, such as composition shingle, the roof material should be earth tone and have a matte,non-reflective finish. ❑ Flashing should be in scale with the roof material. ❑ If copper flashing is to be used, it should be treated to establish a matte, non-reflective finish. 7.10 If it is to be used, a metal roof should be applied and detailed in a manner that is compatible and does not detract from the historic appearance of the building. ❑ A metal roof material should have an earth tone and have a matte,non-reflective finish. ❑ A metal roof with a lead-like patina also is an acceptable alternative. ❑ Seams should be of a low profile. ❑ A roof assembly with a high profile seam or thick edge is inappropriate. 10.3 Design a new addition such that one's ability to interpret the historic character of the primary building is maintained. ❑ A new addition that creates an appearance inconsistent with the historic character of the primary building is inappropriate. ❑ An addition that seeks to imply an earlier period than that of the primary building also is inappropriate. ❑ An addition that seeks to imply an inaccurate variation of the primary building's historic style should be avoided. ❑ An addition that covers historically significant features is inappropriate. 10.4' Design a new addition to be recognized as a product of its own time. ❑ An addition should be made distinguishable from the historic building, while also . remaining visually compatible with these earlier features. ❑ A change in setbacks of the addition from the historic building, a subtle change in material or a differentiation between historic, and more current styles are all techniques that may be considered to help define a change from old to new construction. 10.9 Roof forms should be similar to those of the historic building. ❑ Typically, gable,hip and shed roofs are appropriate. 4 ❑ Flat roofs are generally inappropriate for additions on residential structures with sloped roofs. 10.11 On a new addition, use exterior materials that are compatible with the historic materials of the primary building. ❑ The new materials should be either similar or subordinate to the original materials. 12.16 Use roofing materials that are similar in appearance to those seen historically. 14.6 Exterior lights should be simple in character and similar in color and intensity to that used traditionally. J ❑ The design of a fixture should be simple in form and detail. Exterior lighting must be approved by the HPC. ❑ All exterior light sources should have a low level of luminescence. 14.7 Minimize the visual impacts of site and architectural lighting. ❑ Unshielded, high intensity light sources and those which direct light upward will not be permitted. ❑ Shield lighting associated with service areas,parking lots and parking structures. ❑ Timers or activity switches may be required to prevent unnecessary sources of light by controlling the length of time that exterior lights are in use late at night. ❑ Do not wash an entire building facade in light. ❑ Avoid placing exposed light fixtures in highly visible locations, such as on the upper walls of buildings. ❑ Avoid duplicating fixtures. For example, do not use two fixtures that light the same area. 14.8 Minimize the visual impact of light spill from a building. ❑ Prevent glare onto adjacent properties by using shielded and focused light sources that direct light onto the ground. The use of downlights, with the bulb fully enclosed within the shade, or step lights which direct light only on to walkways,is strongly encouraged. ❑ Lighting shall be carefully located so as not to shine into residential living space, on,or off the property or into public rights-of-way. 14.13 Leave natural masonry colors unpainted where feasible. ❑ Where the natural colors of building materials exist, such as with stone or brick, they should be left unpainted. ❑ For other parts of the building that require painting, select colors that will complement those of the natural materials. ❑ If an existing building is already painted, consider applying new colors that simulate the original brick color. ❑ It is also appropriate to strip the paint from a masonry building to expose the natural color of the stone or brick. 14.15 Minimize the visual impacts of mechanical equipment as seen from the public way. ❑ Mechanical equipment may only be installed on an alley facade,.and only if it does not create a negative visual impact. ❑ Mechanical equipment or vents on a roof must be grouped together to minimize their visual impact. Where rooftop units are visible, provide screening with materials that are compatible with those of the building itself. ❑ Screen ground-mounted units with fences, stone walls or hedges. ❑ A window air conditioning unit may only be installed on an alley facade, and only if it does not create a negative visual impact. ❑ Use low-profile mechanical units on rooftops so they will not be visible from the street or alley. Also minimize the visual impacts of utility connections and service boxes. What are requested are conceptual review w and a FAR bonus. This project has been resorted and responds to the HPC guidelines. The addition has been moved in its planning, reduced in height and very sympathetic,and has a separation from the historic building and the.massing is very low. From the renderings it doesn't seem that therelwill be-any impacts on Main-Street at all, At the last meeting the request for continuation,involved the roof coming down and: that the dormer be reconsidered to see how it could:be minimized and 5* that has been accompli hed. An FAR bonus is requested and staff reconmend's that this be rewarded because the design is'ekemplary and also some of the restoration efforts involving the brick are really significant in bringing back the integrity of this historic building, Staff recommends conceptual and the FAR bonus,as designed with no 'cond i tion s. k Steev Wilson, architect: Steev said they lowered the back roof considerably so that the plate height on the interior will make the turn and.go up.7 6: lrr-addition W..e;brot ght the overhangs of'the dormers in considerably.and the overall height has been brought down. The smaller dormers where reduced in "size. Ann asked Steev to go over the FAR. Steev said the,allowable FAR is currently 2150 square,feet.
