THIS AGREEMENT, made and entered into this 3 14c Iday_ of
May 1985 by and between THE CITY OF ASPEN, COLORADO
(hereinafter "City" ) and ED GROSSE (hereinafter "Grosse" )
WITNESSETH:
WHEREAS, Grosse is the owner of certain real property
located at 100 E. Bleeker in the City of Aspen, more particularly
described as
Lots
Block 65
City and Townsite of Aspen
Pitkin County, Colorado,
hereinafter "Property" and
WHEREAS, Grosse has recently constructed a fence on the
property which was determined, after construction, to have been
mistakenly placed on City road right of way, and
WHEREAS, the City wishes to permit the occupancy of the
right of way for maintenance of the fence under certain
conditions (hereinafter enumerated) all of which are acceptable
to Grosse.
NOW, THEREFORE, the City does hereby grant to Mr. Grosse a
license , pursuant to Section 19-5 of the Aspen Municipal Code, to
maintain the fence on City right of way subject to each of the
following:
1. It is understood and agreed. that this license may be
withdrawn in the event the City shall make a good faith
determination that it is in its best interest to revoke
the same.
2. Grosse shall on or before July 1 , 1985 , (a) cut the
fence to a maximum height of 32 feet and (b) remove
each alternate slat, so that the result is a picket
fence.

3. This license shall lapse on the transfer (by sale or
otherwise) of the property from Grosse to anyone other
than transfer by will or intestate to a spouse or heir.
IN WITNESS WHEREOF, this license was granted by the Aspen
City Council at its regular meeting held , 1985.
