The project is currently in process to receive an FAR Bonus for 500 square feet to be applied to the proposed penthouse addition, in response to the significant refurbishing of the historic storefront, and a parking exemption of an additional 250 square feet. In response to the Commission's requirement that the original roof structure be kept in it' s original location, the Owners have revised their proposed design, lowering all roofs except that which is required for the elevator that serves the penthouse level. The roof over the elevator has been engineered to be minimum thickness, and set at the minimum height above the finished floor of the penthouse for the elevator to function properly and to meet code safety requirements. The penthouse level is set by the level of the existing roof structure, allowing for adequate drainage away from the proposed floor structure of the penthouse. The portion of the roof the exceeds the maximum allowable building height is approximately 45 square feet (1.5% of the building footprint), and would extend 2 feet above the maximum allowable building height. The grant of this variance will generally consistent with the purposes, goals, objectives, and policies ofthe Aspen Area Community Plan and the Municipal Code by furthering the preservation of historic resources in Aspen and allowing for the building to reach it's potential within the architectural inventory of Aspen. The grant of variance is the minimum variance that will make possible the reasonable use of the parcel, building, or structure. The proposed design asks for a variance to the height restriction only for the elevator shaft and roof; other roof elements have been lowered to i meet the height restriction. The 40 foot height limit is intended to allow for three stories above grade, and the incorporation of an elevator in the project design within the Commercial Core would be considered typical and allowable. Indeed, the required structure for an elevator could be held below the height limit if the Applicant were able to set the penthouse level to accommodate those requirements. The initial analysis assumed 2*10 members spaced at 16" oc bearing on a double glu-lam beam line (spaced approximately 5'-0" apart) in the center of the building, and at the brick walls of the exterior. However, the existing finish materials have since been removed, revpnling gignificant variances from what was assumed. The roof is constructed of 2xl0s at 16"oc. Where the rafters meet the exterior brick walls, they bear on a cripple wall that is framed on the inside of the brick wall. This cripple wall bears on 2x6 rafters which have been pocketed into the innermost brick wythe at 16" oc. In many locations, these have undergone fire damage. There does not appear to be any sort of positive connection between the rafters and the brick wall at either level. While gravity loads can be transferred in this manner, there is no opportunity to distribute lateral loads, which presents life safety concerns- At the interior bearing points, these rafters rest on cripple walls that in turn bear on the double qlu-lam beam line. At this point, the lower 2x6 rafters appear to present no Structural advantage. It is proposed that the lower, 2x6, rafters be removed. Structurally, this is acceptable and provides the opportunity to bring the numerous deficiencies and life safety issues into line with the current building code. Modify existing structure to meet current structural code as relates to the proposed uses. 2. Provide exiting as required for the proposed uses of the building. 3. Provide two parking spaces off the alley with an overhead garage door. 4. Perform required modifications to qualify for a Certificate of Occupancy. 5. Install an elevator, with restricted access, to serve the main, upper, and rooftop levels of the building. 6. Renovate the south, or Hyman Mall, faGade, including replacing the existing storefront window system, rebuilding the recessed entry, reconditioning the original stone and brick, and restoring the wood and steel detailing to historically appropriate details and colors. 7. Repair the brick and wood cornice, and replace the balcony on the alley faGade. 8. Provide one residential unit on the upper and rooftop levels, to be designed within existing height and view lane restrictions for the property (except as relates to a Height Variance that was granted by the H.P.C. for the elevator shaft on May 9% 2001). 9. Refurbish all existing windows and retain existing original glazing, as allowed by the City of Aspen Historic Preservation Design Guidelines and as requested by the H.P.C. 10. The Applicant has shown a commitment to an "outstanding effort" in the significant renovation o f the front and rear facades. The proposed project will improve both the original building and the neighborhood as a whole. The renovation of the front fagade will return the building closer to its original design, including returning the storefront to its former design with a recessed entry and full-height glazing, and more historically accurate materials, detailing, and colors. This extensive renovation will bring the building up to the standard set by other fine renovations in the neighborhood, and make the architectural inventory of the area more accurate and. The residential space proposed for the roof level will be set back approximately 60 feet from the Hyman Mall faQade and approximately 12 feet from the rear facade, and therefore minimizing visual impact on the mall streetscape and alley. The intent of the project is to return the Kobey Building to its former architectural significance within the community of Aspen. The design represented in this Final Submittal is the same as represented in the Conceptual design that was approved on May 9th, 2001, with the exception of the southerly skylight. The H.P.C. approved the Conceptual design with the condition that the design of the southerly skylight be redesigned to be less obtrusive and produce less light pollution. In response, the Applicant proposes the current design which lowers the height of the skylight, removes the south-facing glazing and keeps a minimum of north-facing vertical glazing, and moves the fireplace and resulting chimney closer to the middle and west side o f the building. The chimney has been offset below the roof to bring the portion that rises above the roof north of the skylight as much as possible. To further reduce the impact of the skylight and chimney, the current design proposes moving the skylight, fireplace and chimney to the north from its previous location. The elements of the original storefront that are still in place will be restained, missing features recreated, and the paint will be removed from the masonry. The HPC should perform a site inspection to view the condition of all of the existing window units to determine if their replacement is appropriate. The preferred treatment is to restore the existing materials. 3.1 Preserve the functional and decorative features of a historic window. • Features important to the character of a window include its frame, sash, muntins/mullions, sills, heads, jambs, moldings, operation and groupings of windows. • Repair frames and sashes rather than replacing them, whenever conditions permit. • Preserve the original glass, when feasible. On the rear fagade, the proposal involves extending a non-historic staircase to the roof level, removing and replacing an existing balcony, and creating an open parking area. Staff has no concerns with the staircase, but would like more information about the balcony to determine if it is historic construction. In renovations of similar historic structures in the downtown, the parking areas have had garage doors, which staff finds might be more appropriate than creating a large void in the wall. Building sections showing sight lines from the mall and alley have been provided to describe the visibility of the rooftop addition. It appears that it will not have a significant impact on the character of the building and has been pulled in far enough to address the design guidelines. 10.12 When constructing a rooftop addition, keep the mass and scale subordinate to that of a historic building. • An addition should not overhang the lower floors of a historic building in the front or on the side. • Dormers should be subordinate to the overall roof mass and should be in scale with historic ones on similar historic structures. • Dormers should be located below the primary structure's ridgeline, usually by at least one foot. 10.13 Set a rooftop addition back from the front of the building. 2 .. A. The partial demolition is required for the renovation, restoration or rehabilitation of the structure, or the structure does not contribute to the historic significance of the parcel. Staff Finding: The project involves removing a portion of the rear wall to create two parking spaces to serve the residential unit. Having a mix of residential and commercial space is important to the vitality of the downtown, and having on-site parking makes the residential use more viable. B. On the rear fagade, the proposal involves creating a two car garage (note that the architect has revised the plan to include overhead doors at the parking area,) extending a non- historic staircase to the roof level, and removing and replacing an existing balcony and overhang. Most of the discussion at the March 28th meeting focused on the rooftop addition. The applicants had proposed to demolish the existing roof structure, a concept that the board rejected. The plan now shows the roof preserved, and includes a request for a height variance in the area of the elevator overrun. The variance request will be discussed later in the memo. Other elements of concern for the rooftop development were skylights/light monitors and flues. Staff does not support the request for the skylight that is closest to the front of the building. While it may not be visible from directly across the street, it will be visible from other nearby locations and is intrusive to the historic character of the structure. Staff recommends that it be removed or replaced with a flat skylight, and would recommend that the other skylight be flat as well. 7.3 Minimize the visual impacts of skylights and other rooftop devices. • Flat skylights that are flush with the roof plane may be considered only in an obscure location on a historic structure. Locating a skylight or a solar panel on a front roof plane is not allowed. A skylight or solar panel should not interrupt the plane of a historic roof. It should be positioned below the ridgeline. The applicant has also requested a 500 square foot floor area bonus in recognition of an outstanding preservation effort. Staff agrees that the restoration of the Hyman Avenue fa~ade is much needed and that the bonus is appropriate in this case. 2 .. b. The proposed development rejlects and is consistent with the character of the neighborhood of the parcel proposed for development, and Staff Finding: The building is located in the heart of the commercial downtown. HEIGHT VARIANCE Because of the HPC requirement to retain the original roof framing, the applicant cannot drop the roof plane and minimize the height of the penthouse as intended. The elevator tower, which has a 45 square foot area, is 2 feet over the 40 foot height limit. In order to authorize a variance from the dimensional requirements of Title 26, the HPC must make a finding that the following three (3) circumstances exist: 1. The grant of variance will be generally consistent with the purposes, goals, objectives, and policies of the Aspen Area Community Plan and this Title; Staff Finding: The AACP promotes creating mixed use buildings in the downtown, with living spaces on upper floors. The project is in keeping with that goal. 2. The grant of variance is the minimum variance that will make possible the reasonable use of the parcel, building or structure; and Staff Finding: All areas of the penthouse living space have been designed to meet the height limit. The elevator tower has been lowered to the extent possible and is 2 feet over the height limit. Only 1.5% of the roof surface exceeds the requirement, and this area is pushed to the back of the building, so that it will not be perceived from the street. 3. Literal interpretation and enforcement of the terms and provisions of this Title would deprive the applicant of rights commonly enjoyed by other parcels in the same zone district, and would cause the applicant unnecessary hardship or practical difficulty. In determining whether an applicant's rights would be deprived, the board shall consider whether either of the following conditions apply: a. There are special conditions and circumstances which are unique to the parcel, building or structure, which are not applicable to other parcels, structures or buildings in the same zone district and which do not result from the actions of the applicant; or 4 .. Staff Finding: The building pre-dates the City's height limits. A third story is allowed within the zoning regulations, and the applicant could build the entire unit within the requirement if the HPC would allow the roof plane to be lowered. Plans indicate opening the rear wall (alley side), to provide access to the main level as a parking area. In addition to designing the needed structural elements to handle the gravity loads over the new wall opening and parking space, lateral performance becomes a primary design parameter. The shell looses the "box" integrity by removing the exlsting masonry wall. As we discussed in our previous meeting, we recommend that a steel frame be designed to set within the new opening, sized to laterally brace the masonry walls formerly braced by the rear wall. A reinforced concrete cap may be required aIong the top of the rear stone foundation wall, in order to distribute the steel frame horizontal forces back into the foundation.
