Lindt 1"'\ ~ 4. .1I7ff - 2fb\ ,....,., I} A ffl/bv e- c9 ~ () \A COlA?€ Col€lAda 11\ A RESOLUTION OF THE ASPEN CITY COUNCIL APPROVING "TRAINOR'S LANDING" AS A STREET NAME IN THE BARBEE PLANNED UNIT DEVELOPMENT RESOLUTION No. X (Series of 200 1) WHEREAS, the Community Development Department received an application from David Miller on behalf of Semrau Building and Design Inc. requesting approval for a street name; and WHEREAS, since the street access is a public right-of-way, only City Council has the authority to approve a name, provided the proposed name will not duplicate or be confused with existing street names within the City or its environs; and WHEREAS, the Community Development Department has reviewed the application and solicited comments from the Engineering Department, Fire Department, U.S. Post Office, Water Department, Streets Department, Police Department, Communications Center and City Mapping (GIS) Division, and no concerns were raised; and WHEREAS, Community Development Department staff is recommending approval of the proposed street name with conditions; and WHEREAS, at a public meeting the Aspen City Council has reviewed and considered the requested street name, and has reviewed and considered those recommendations made by the Community Development Department; and WHEREAS, the City Council finds that the proposed street name, with conditions, meets or exceeds all applicable criteria ofthe Municipal Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO as follows: Section 1: That the Aspen City Council hereby approves Semrau Building and Design's request to name the street access to the four deed restricted duplex units and the five free market lots at the intersection of South Garmish Street and Juan Street, "Trainor's Landing," with the following conditions: 1. Within 180 days of this approval, the applicant must complete an Insubstantial Planned Unit Development Plat Amendment to update the Barbee Planned Unit Development plat in accordance with the approvals contained herein. 2. New street signs shall be purchased by the applicant through the City Streets Department. The sign(s) shall be installed in a location approved by the Streets r\ f'l Department, and any costs associated with the installation of the sign(s) shall be borne by Semrau Building and Design Inc.. 3. All material representations made by the applicant in this application shall be adhered to and shall be considered conditions of approval, unless otherwise amended by the Community Development Director or City Council. FROM: RE: DATE: August 13,2001 SUMMARY: The Community Development Department received a request for an Insubstantial Amendment to the Barbee Subdivision PUD Plat to officially name the access road to serve the four affordable housing duplex units and five free market lots, "Trainor's Landing." Pursuant to Section 26.445.100, Amendment to a PUD Development Order, the requested plat amendment can be administratively approved by the Community Development Director; however, street name requests require City Council approval. Staff recommends that City Council approve with conditions the request to officially name the street access to the Barbee Subdivision, "Trainor's Landing." APPLICANT: Semrau Building and Design Inc. represented by David Miller. LOCATION: Located at the southern edge of Garmish St. near the intersection with Juan St. Please see Exhibit A for location map. BACKGROUND: The Barbee SubdivisionlPlanned Unit Development was approved in 1999 by the Aspen City Council. It was annexed into the City pursuant to Ordinance # II, Series of 1999. The street being named will provide access to four deed-restricted duplex units and five free market lots. The subject street was never named as part of the PUD. STAFF COMMENTS: With respect to the requested street name of "Trainor's Landing," staff has solicited the Engineering, Fire, Water, Streets, and Police Departments as well as the City GIS (mapping) division, Communications Center and U.S. Post Office to find out whether there are any concerns with the proposed street name. Staff has neither been told of any problems or concerns regarding the proposed name, nor found the proposed name to duplicate the name of any existing street within Pitkin County. If the street name is approved by City Council, the Community Development Department will administratively process the Insubstantial Plat Amendment. In order to qualify as an Insubstantial Amendment to the PUD development order, the request must not violate any of the provisions of Section 26.445.100(A). The provisions of said section of the code follow, along with staff s response. f""'\ l G 1. A change in the use or character of the development. RESPONSE: Naming the street is a minor change to the plat. The proposed amendment would not have an effect on the conditions and representations of the PUD approval. 2 An increase by greater than three (3) percent in the overall coverage of structures on the land RESPONSE: The amendment does not increase the overall coverage of structures on the land. 3. Any amendment that substantially increases trip generation rates of the proposed development, or the demand for public facilities. RESPONSE: Trip generation and demand for public infrastructure are not affected by this alteration to the PUD. 4. A reduction by greater than three (3) percent of the approved open space. RESPONSE: The amount of open space will not be reduced by the proposed amendment. 5. A reduction by greater than one (1) percent of the off-street parking and loading space. RESPONSE: The applicant is not requesting an amendment to the existing or required number of parking spaces. 6. A reduction in required pavement widths or rights-ol-way for streets and easements. RESPONSE: The applicant is not proposing changes to right-of-way widths. 7. An increase of greater than two (2) percent in the approved gross leasable floor area of commercial buildings. RESPONSE: The applicant is not proposing changes to a commercial building. 8. An increase by greater than one (1) percent in the approved residential density of the development. RESPONSE: The applicant is not proposing a change in the residential density. 2 ,-., n 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting a further variation from the project's approved use or dimensional requirements. RESPONSE: The proposed amendment is consistent with the project's original approval. RECOMMENDATION: The Community Development Department recommends that Council approve the attached Resolution, allowing Semrau Building & Design Inc. to name the access "Trainor's Landing" with the following conditions: 1. You will definitely need to record an amended plat with the street name on it. Street name changes have to be approved by City Council. Let me run the process question by the rest of our staff this afternoon and I will get back to you. The actual addresses will be assigned when you apply for permit on the units themselves.
