Present were Don Swales, Chairman, Jack Stanford and Bill Dinsmoor.
Excused were Jon Busch and Warren Ryan.
Also Present were Brooke Peterson, Barbara Umbreit and Lormie Whitmire.
Don opened the regular meeting of the CCLC.
ENFORCEMENT OF ALLEY CLEAN-UP
Don began the discussion on enforcement of alley tickets with Brooke Peterson.
Barbara stated that parking tickets would be issued in the alleys.
Jack noted that they had been trying to clean up the alleys with the compactor
program which had been successful. Jack said Lonnie had been assigned to CCLC
to keep the alleys clean and clear of encroachments. He said the only way
enforcement could be carried out in the compactor program was to red tag. They
can have a dumpster but it must be on private property and many dumpsters do not
fit on private property so there are encroachments. He said a lot of people also
park in the alleys. Jack said that everything goes back to Tim Ware's enforcement
for parking and fines to those that violate. He stated the problems were with
parking spaces that half-way encroach into the alley, they are ticketed and then in
court say that they were not sticking out into the alley and besides they have
parked there for years.
Brooke understood the concern and the need to have the alleys and downtown core
for parking. As a judge, Brooke Said he had to give the benefit of doubt to the
offender. He said he cannot remember the last time a parking offender was in his
Municipal Court. He stated that ifa violation can be proven for an alley
encroachment or parking violation, then he would back the enforcer. Brooke
noted that there was selective enfomement with parking in the alley. He said that
the City had to prove that there was a violation if not parked on private property.
Bill asked about trash offenders. He said now that there were trash compactors
with keys for operation, people just leave the trash in the alley. Bill said it could
be easy to identify the offender but what do we do about it. Brooke stated that
maybe there should be a central place for people to dump trash. Bill said the City
changed the Ordinance to be a potential fine of $1,000.00 and a year in jail. This
did send a message that the City was serious about trash offenders. Bill noted the
burden of proof was on the enforcer. Jack asked how much weight a picture

carried. Brooke stated that many traffic accidents are settled with pictures. Jack
asked if Lonnie were to have a Polaroid camera and gave his affidavit with the
date and what happened, would that be good enough. Brooke replied that it would
for the ticket but the enforcer would also have toI go to court and be subject to
cross examination. Brooke said the City Attorneys need to give direction. Bill
commented that he did not know if Brooke wanted the court filled with parking
and garbage violations. Brooke said that he did not know if any court could be an
enforcement mechanism. Bill stated concern for the proper way to discipline these
offenders. Jack said that corporate LIPS pays all traffic tickets for their drivers.
Jack noted that they will be pushing to write 'more tickets.
Lonnie said the newspaper had pictures ofPam Driscol's box in the alley and he
red tagged the door and the trash. He noted Avia came right out and cleaned up
their trash and another place said they gave their boxes to someone else. Bill
commented that a red-tag was just a wake up call from the city. Barbara said the
red-tag was issued before the ticket. Bill asked if there could be some sort of
warning letter handed out.
Lonnie remarked that it was a health hazard with the trash in the alleys. He said
that if the business owners were required to be accountable and if they had
violations, upon renewal of their business licenses more money would be due.
Jack said that the building owner should be ultimately responsible. Barbara noted
Lounie ends up doing jobs that other departments do not want to do.
Bill stated the last resort would be to go to court with the trash offender. He said
the business owner would have been given chances to rectify the situation. Bill
commented the businesses that do not pay as much sales tax because they send the
merchandise out of town, should pay a larger business license fee. Barbara said
that was a creative idea. She stated the business license was under the City and
the food service license was the state. She noted the City Attorneys need to
review these enforcement problems. Barbara said that GIS mapping for alley
enforcement on the encroachments could work: Jack stated that staff needed to
figure out the logistics. Don said an enforcer was needed. Barbara noted by the
next CCLC meeting they shoUld have more information.
Lonnie asked about the compactor in the Brand Building with respects to the
billing for the electricity. Bill stated that BFI should be billed.

MOTION: Jack moved to approve the minutes from October 30, 1996
meeting. Bill seconded. Ali in favor, Motion Passed~
50th ANNIVERSARY ASPEN SKIING COMPANY
Barbara stated the Banners had already been approved (a copy of what the banner
looked like was passed around to the Board). She said the Ski Co. was calling the
50th Anniversary "Pioneer Ski Week" because it celebrates the people that started
Skiing in Aspen. She wanted to bring the schedule of events (along with a
member of the Ski Co.), even though nothing public will take place in the
Commercial Core. The representative (Allison) from the Ski Company did not
attend this meeting but they are going through the Special Event Permit. Pioneer
Ski Week begins the week before Wintersk61.
DELIVERY VEHICLE REPORT
Jack explained that 5 City Departments (Streets, Traffic, Parks, Legal and Police)
met with the sub-committee and staffwas most enthusiastic. He said there were
two meetings with delivery vehicles, two with retailers and one ~vith City Staff.
Some rules and regulations will have to be changed with respects to parking and
the issuance of Commercial Permits. He said the next step would be for CCLC to
go to Council with the ideas researched t° draw up an Ordinance. Don asked what
the basics were to take to Council. Jack noted that the entire approach Was "an if"
basis. Jack commented that they also need the cooperation of the courts and even
the delivery vehicles need to be ticketed. UPS is one of the biggest offenders. He
said that the main concern would be enforcement. Bill mentioned to the Food
Managers this week, the response from the legal department to deliver by address
and thought the idea was very good. Bill said this would take care of many other
issues such as time of day and cleaned up when the delivery would be made. He
said all delivery vehicles may be required to deliver by address. Bill and Jack
talked about attending the Noon Brown Bag on 11/25/96. Barbara noted that they
had two options, either on the agenda or with a memo to go to Council. She said
the Brown Bag was informal and hard to know which Council Members would be
present but the Mayor generally attended and she urged them to attend.

COMMISSIONER COMMENTS
Bill stated the parking issues with extended hours for the shuttle and how
important that link was in making the parking garage work. He said Council
should recognize the need for this along with the increased lighting, Barbara said
there was really a need for more light at the cross walk on Main Street at Galena
which was another reason for extending the hours of the Galena Street Shuttle.
She noted that there were more lights were placed inside the garage.
Bill and Barbara spoke about the article in the Roaring Fork Sunday regarding the
alleys throughout the valley. Barbara said that Curtis Robinson's article was very
comprehensive. Lonnie stated that the guy whose photo was in the newspaper
throwing the trash from above the Paragon into the dumpster was miffed that his
picture in the paper.
