COMMISSIONER COMMENTS Don stated that he has never been informed about the DEPP meetings and could Staff Io°k into it. Staff indicated they would contact the Community Development Department and coordinate. Staff also stated that the Attorney's office is not in favor of the city putting a fee on trash that is left around the compactor. They prefer that the trash haulers incorporate the fee into their billing system. TRASH Lonnie Whitmire stated that Oleary's has not paid their trash bill. They have been red tagged. Mike Ricci stated that Rowland Krupp, manager has always been late with his payments. He also stated they are no longer servicing him. He stated that it has cost them time and money. Bill stated that the city should get keys for both compactors in case of emergencies. Staffreported that New York Pizza stated that an awning or casing needs to be placed over the controls for the compactor as they freeze and don't work. The other comments was from Sam Goodies and the manager Stacey stated that he felt the low use was a combination of everything, that people did not know how to use it and that they were lazy. He also felt that the compactor should be emptied more often. Tony Vagneur stated that it generally is not full. He also stated that he does not have a set day to dump the compactor. It gets dumped when it is full. COMMERCIAL CORE & LODGING COMMISSION JAN. 15, 1997 Terry Butler, resident of the downtown stated that the compactor in the Brand Bldg. has been there for almost 3 years and it is successful and working. The compactor in the Red Onion alley where she resides is not working. She stated that she worked with Bill Efting and he had written a letter and asked all of the companies not to empty the trash before 8:00 a.m. in the morning. Richard Ruseau, 305 S. Galena stated that the trash is never removed after 8:00 a.m. in the Red Onion alley. He stays in #6 unit which is right above the dumpsters. Jon stated that Club Soda has a dumpster and the Aspen Block has a dumpster. Don stated that the noise is coming from the dumpsters not the compactor. Terry stated that she can hear the compactor but she is not complaining about it because you can sleep through that noise. The dumpster you cannot. She also stated that the Planet Hollywood alley is very noisy. The bottle dUmping noise is terrible. Jon stated that CCLC could eliminate that problem because the dumpsters in both cases are in the public right-of-way. The encroachment was not for dumpsters. Bill stated that the city has the option to control time, manner and place. If the use is disturbing people it should be corrected. Terry Butler stated that she is speaking for the Independence Square Hotel, The Paragon Bldg., The Aspen Block Bldg. and Easter Winds. She stated some people work late and don't get up at 8:00 a.m. Trash pickup is around 6:15 to 7:15 a.m. then you go for a two hour period and there is not one truck in the alley. It would be great if they could come 9:00 a.m. to 11:00 a.m. She stated that she has monitored the noise in that area. Jack stated that the immediate solution would be if the dumpsters could be dumped at a later time in the morning and then address the encroachments. 2 COMMERCIAL CORE & LODGING COMMISSION JAN. 15, 1997 Jon statedthat alley is difficult because it is a dead end alley. Mike Ricci stated that you cannot give a scheduled time as trucks get delayed etc. Jack asked if those dumpster on the east end of the alley could be picked up on the way out of town. Mike Ricci stated that they would never be able to get into that alley at a later time. Terry Butler stated that she has lived there 10 years and she disagrees. She stated that the trash companies do not pick up in the West End at 6:00 a.m. because the neighbors wouldn't stand for it. Jon stated that encroachments are all revocable and he feels that the City can say no dumpsters under the encroaChment. If there are no dumpsters they are forced to use the compactor. Jack stated that we should have the two companies try to pick up at a later hour and while they are trying that lets have the legal department look at getting the encroachments revoked and getting rid of the dumpsters. Jon stated we can get a legal opinion but in either case it is not realistic to get rid of the encroachment. Jack stated that someone should talk to the individuals and explain the situation. Get rid of the dumpster or your encroachment will be revoked. Staff stated that Engineering should talk to the owners as encroachments are handled by that department. John Starr stated that CCLC needs to find our the legal position before proceeding. He also stated that it should be in writing. Bill stated the bottom line is that CCLC has no enforcement mechanism to make them change their behavior. 3 COMMERCIAL CORE & LODGING COMMISSION JAN. 15, 1997 Jon stated that possibly a light could be installed indicating that the safety switch has been activated. Tony stated that he could look into that. He also stated water got into the box twice right after a wet storm. He stated that he carries a torch in his truck to correct the situation. Bill stated that is one of his concerns, is there a legitimate non-use to leave the trash in the alley~ He also stated that Lonnie needs the combination and should have a key. All the customers should have direction on how to use the machine. Terry stated that the Brand alley works well because Harley Baldwin has control of the north side of the alley and all of his people were in agreement that it was necessary. In the Red Onion alley there are numerous owners to deal with. Tom Elder, Red Onion manager stated that there are people living in back of New York Pizza and he does not know if they have access to the compactor. When you come out you will see on top of the dumpster or next to the dumpster bags of trash. He also stated that the compactor is less noisy and the aroma is not as bad as he had anticipated. Tony Vagneur stated that there are people with no trash service in that alley. Lonnie stated that you have to catch them in the act or take pictures. Don asked about the Elks dumpster. Staff indicated that the two wooden encroachments were to be removed and put on private property in exchange for the compactor for the building. A site plan was to be processed for the encroachment and recorded with the Engineering Dept. Jon stated that Mason and Morse has huge for sale signs in their alley and they do not have an encroachment for that stuff. 4 COMMERCIAL CORE & LODGING COMMISSION JAN. 15, 1997 Bill stated that CCLC and the trash companies should start looking at another alley. Jack stated that Lonnie should look at the Planet Hollywood alley and find out how many encroachments there are and dumpsters there are. Bill stated that he is in favor ora video in the alley to see what is going on. Staff stated that they will get some costs on the video and report back. Lonnie indicated that the video will show how many people are putting their trash by the compactor that don't even live here. ~ MOTION: Don moved to adjourn; second by Jack.
