From: Councilmen, McCabe and Semrau Re: Special Meeting of the City Council This notice is to request a special meeting of the city council at 4:30PM on 10-25-02. The purpose of the meeting is to authorize our representative or alternate to the RFTA board to support the Modified Dierct alignment if a vote for the entrance to Aspen is brought forward by the RFTA board of directors at the next RFTA board meeting. Further, we would like the council to vote to mow the grass on the modified direct alignment so that the citizens could easily identify that alignment. We would have this mowing done as soon as possible as an informational service to all the citizens prior to the public vote about the alignment coming up on Nov. 5t~ of this year. Tom McCabe Tim Semrau Special Meeting Aspen City Council October 25~ 2002 Mayor Klanderud called the meeting to order at 4:30 p.m. with Councilmembers Paulson, Hershey, Semrau and McCabe present. Councilman McCabe said this special meeting is to discuss the city's position regarding the Roaring Fork Transit meeting on Monday morning and any direction to Council's representative. Council has not had an opportunity to discuss and make sure the majority view of Council regarding the entrance to Aspen is represented at that meeting. Councilman McCabe said RFTA is going to ask for a resolution of support for the modified direct alignment at that meeting. Councilman McCabe said he would like it kno~m the majority position of Council is in support of the modified direct alignment. Mayor Klanderud said 3 members, a majority of Council, have taken a position in favor of the modified direct alignment. Mayor Klanderud-stated as the city's representative to the RFTA board, it is her responsibility to represent that majority position. Mayor Klanderud said she has the right to express the opinion that two Council members do not agree with that position. Councilman Hershey said he feels it is ~mportant for RFTA to take a position on this ballot issue, as their business is transportation. Councilman Hershey said Council members wanted to make it clear that the majority of Council supports the modified direct alignment before RFTA meets Monday morning. Councilman McCabe suggested that the proposed modified direct alignment across the Marolt property be staked or mowed so that people can see where this fight-of-way is. Mayor Klanderud agreed the position of this Council as to a RFTA resolution supporting the modified direct alignment is understood. Mayor Klandemd said the second request is to mow or stake the proposed modified direct alignment across the Marolt property. Councilman McCabe said he feels this would be a service to voters to look across the Marolt property and see where the proposed alignment is, Randy Ready, assistant city manager, told Council due to weather conditions, the mowing will not be an indicator of the direct alignment. There are stakes across the Marolt property. Councilman Paulson said he is concerned about Councilpersons asking staff to spend public monies on a political issue. 1 Special Meetin~ Aspen City Council October 25, 2002 John Worcester, city attorney, reminded Council the state Fair Campaign Practices Act prohibits the use of public money to advocate for or against a ballot issue. Worcester said mowing or staking the fight-of-way across Marolt does not advocate for or against the ballot question. Councilman Semrau agreed the issue is whether it is a public service to indicate the fight- of-way across the Marolt property. Councilman Paulson said the stakes do not show the entire right-of-way, which includes the tunnel or the bridge. Mayor Klandemd said she is not in favor of staff staking the alignment across the Marolt property. It does not show what will really happen on the Marolt property. Councilman Hershey said if staking would not be an accurate representation, there is no reason to do it. Councilman McCabe said he would be in favor of staking the alignment. Ready reminded Council the stakes were already there and staff augmented them for mowing. Councilman Hershey moved to leave the stakes where they are; seconded by Councilman McCabe. Councilmembers McCabe, Hershey and Semrau in favor; Councilman Paulson and Mayor Klandemd opposed. Motion carried. Councilman Paulson moved to adjourn ar 5:15 p.m.; seconded by Councilman Semrau. All in favor, motion carried. 2
