AN ORDINANCE AUTHORIZING A TOTAL TRANSFER OF $6,200,000 TO THE
PARKS CAPITAL FACILITIES PROJECT FUND OF WHICH $;~,500}000 FROM THE
WHEELER OPERA HOUSE FUND AND $L700,000 IS FROM THE AFFORDABLE
HOUSING/DAY CARE FUND.
WHEREAS, by virtue of Section 9.12 of the Home Rule Charter, the City Council may
make supplemental and transfer appropriations: and
WHEREAS, the City Manager has certified that the City has unappropriated current year
revenues and/or unappropriated prior year fund balance available for appropriation in the
following funds: Wheeler Opera HOuse Fund and Affordable Housing/Day Care Fund;
WHEREAS, the City Council is advised that certain expenditures, revenue and transfers
must be approved.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section 1
Upon the City Manager's certification that them are current year revenues and/or prior
year fund balances available for transfer appropriations from the Wheeler Opera House
Fund and the Affordable Housing/Day Care Fund: the City Council hereby makes
supplemental transfer appropriations as prescribed above.
Section 2
If any section, subdivision, sentence, clause, phrase, or portion of this ordinance is for
any reason invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portion thereof.
Section 3
A public heating on the ordinance shall be held on December 9, 2002 at'5:00 p.m. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.

2002.
