Mayor Pro Tem Fallin called the meeting to order at 5:00 p.m.
with Councilmembers Tuite, Isaac and Gassman present.
Mayor Pro Tem Fallin said she feels an election is not the way to
go; however, she does not want the city to be held up over severe
criticism. Mayor Pro Tem Fallin said it is up to Council to get
the election information out. Cindy Shafer, finance director,
said the way the question is written will work. Her concern is
not putting a specific mill levy to allow for annexations.
Councilman Gassman presented a rewrite of the question using
simple declarative sentences. Council discussed the wording of
the ballot question. "On June 3, 198, the electors of the city
of Aspen approved a 5 year serial levy for street improvements at
an annual rate of 1.5 mills. Due to a state-wide property tax
re-evaluation, this mill rate will generate almost 2-1/2 times
the revenue anticipated in 1986. Shall the city of Aspen
maintain the present mill rate of 1.5 an spend the additional
revenue on street improvements? Should this question failed to
be approved, the City Council will reduce the annual rate of tax
levy to reflect revenues generated based on the assessed valua-
tion formula in effect in 1986." Assistant City Manager Mitchell
said this reads as a double negative and suggested the question
should state, "Shall the mill rate be reduced from 1.5 to .7".
Taddune suggested wording "Shall the city of Aspen maintain the
present 5 year serial tax levy mill rate at an annual rate of 1.5
and spend the additional revenue on street improvements" putting
the question up front with the explanatory language following.
Mayor Pro Tem Fallin said she would not like the question to be
interpreted that the city is doing away with the whole serial
levy. Mitchell said the question should have the existing rate
of 1.5 with the reduced rate of .7.
Councilman Gassman moved to amend Resolution #26, 1987, to change
the wording of the question; seconded by Councilman Tuite. All
in favor, motion carried.
The question will read, "On June 3, 1986, the electors of the
city of Aspen approved a 5 year serial tax levy for street
improvements at an annual rate of 1.5 mills. Due to the state-
wide property tax re-evaluation, this mill rate will generate
almost 2-1/2 times the revenue anticipated in 1986 for the
remaining 4 years. All revenue is restricted to street improve-
ments. Shall the city of Aspen maintain the present serial tax
levy at an annual rate of 1.5 mills? If the electors f ail to
approve this question, the annual rate of serial tax levy will be
reduced to .7 mills."
All in f avor, with the exception of Councilman Isaac. Motion
carried.
