HomeMy WebLinkAboutminutes.council.19900104Work Session Aspen City Council January 4, 1990 Mayor Stirling called the meeting to order at 5:45 p.m. with Councilmembers Crockett, Gassman, Peters and Tuite present. ASPEN MOUNTAIN LODGE NON-COMPLIANCE Councilman Peters said there have been challenges to his participa- tion in these deliberations because of a conflict of interest. Councilman Peters said he took the challenge submitted to Council last June and with the city obtained an independent counsel who reviewed this and gave an independent legal opinion on the conflict of interest question. Councilman Peters said the conflict of interest is both moral ethical question and a legal question. Councilman Peters said as far as the moral question, he is square with his conscience. Councilman Peters said he feels he is fair and judges facts on their own merits. Councilman Peters told Council he received an analysis which left him confident that he could proceed to vote both ethically and that his position was legally justifiable and defensible. Councilman Peters said December 18, 1989, Bob Hughes submitted another letter challenging him on conflict grounds. Councilman Peters said this letter had case law cites . Councilman Peters said he felt it would be prudent to go back to the independent counsel with this additional information and to obtain an updated opinion. Council- man Peters said he has just received that opinion and would like this issue tabled until he had had a chance to review the letter. Mayor Stirling said Council has just received the response from Hadid Aspen Holdings. Mayor Stirling said he would like a chance to review this response, also. Sandy Stuller, city attorney's office, said Councilman Peters's request is reasonable. Ms. Stuller said she would like Council to be able to review the applicant's response. Bob Hughes, representing the applicant, submitted their response to the record.
