HomeMy WebLinkAboutordinance.council.003-86 ORDINANCE NO. 3 (Series of T~~gr-- AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF TWO (2) PRECINCTS FOR THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON MARCH 18, 1986, AND SETTING FORTH THE DESCRIPTION OF THOSE PRECINCTS WHEREAS, the City Council ("Council") of the City of Aspen, Colorado (the "City"), in the County of Pitkin and State of Colo- rado, a municipal corporation duly organized and existing as a home rule city pursuant to Article XX of the Colorado Constitu- tion, will conduct a special municipal election, pursuant to Sec- tion 2.2 of the Aspen Home Rule Charter, on Tuesday, March 18, 1986; and WHEREAS, Council has determined, and hereby does determine, that the use of two election precincts for said special municipal election will maximize the convenience of the voters; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 Pursuant to Section 2.3 of the Aspen Home Rule Charter, the Council has heretofore adopted Ordinance No. 5-71, establishing multiple voting precincts. The Council has determined, and hereby does determine, that, solely for the purpose of the special muni- cipal election to be held March 18, 1986, the City shall consti- tute two (2) voting precincts, the boundaries of the special elec- tion precincts (General Election Precincts 1, 2, 3, 4 and 5) pre- viously established for use in connection with general elections, which two (2) precincts are described in Exhibit "A" attached hereto and incorporated herein by this reference. This ordinance shall supersede said Ordinance No. 5-71, but only as to the March 18, 1986, special municipal election. Section 2 The officers of the City shall be, and they hereby are, auth- orized and directed to take all action necessary or appropriate to effectuate the provisions of this ordinance. Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
