AN ORDINANCE AIDPl'ING A NEW RATE SCHEDULE FOR RETAIL ELECTRIC.AL
SERVICE AND ADDING A NEW SECTION 23-16 TO THE MUNICIPAL CODE, TO
AUTHORIZE THE IMPOSITION OF A SERVICE CHARGE OF THIRTY DOLLARS
($30.00) FOR EACH TURN-ON AND EACH SHUT-OFF OF ELECTRICAL SERVICE
WHREAS, the City Council has enacted certain notice and hear-
ing requirements for setting rates for electr ical serv ice along
with a retail rate policy based on its wholesale electrical pur-
chase contract with the Municipal Energy Agency of Nebraska
(MEAN), on the Ruedi Reservoir Hydroelectric Po~r Project (Ruedi
proj ect), and on other power suppl ies: and
WHEREAS, Section 23-18 of the Municipal Code of the City of
Aspen prov ides that the rates for electr ical serv ice shall be set
forth in the most recent schedule approved by the City Council:
and
WHEREAS, the City Council now desires to enact a schedule of
rates for retail electr ical serv ice pursuant to said Section
23 -1 8: and
WHEREAS, City Council desires to add a Section 23-16 to the
Municipal Code of the City of Aspen to prov ide for a serv ice
charge of 'Ihirty DJllars ($30.00) for each turn-on and each shut-
off of electrical service howsoever occuring.
NOO, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF AS PEN, COLORADO:
Section 1

Pursuant to Section 23-18 of the Municipal Code of the City
of Aspen, the City Council does hereby establish the followin;
rate schedule for electrical po~r, such rates to be effective as
of July 15, 1986.
A. The Purchased Power Subrate shall be:

B. 'Ihe Commercial Customer City Facility Subrate shall be:

C. The Residential Customer City Facility Subrate shall be:

D. 'Ihe M:lnthly Customer Service O1arge for all retail cus-
toners shall be:

E. All of the above rates shall be effective: July 15,
1 986
F. 'Ihe first billing under the above rates shall be mede on
or abo ut: AlJ3 ust 31, 1986
Section 2
Tha t Olapter 23 of the Mun ic ipal C0d e of the Ci t Y 0 f Aspen is
hereby emended by the addition of a new Section 23-26 to reed as

A service charge of thirty dollars ($30.00) is hereby estab-
1 ished for each turn-on and each shut-off of electric ser-
vice howsoever occurr ing ."

Section 3
If any section. subsection, sentence, clause, phrase or
port ion 0 f this ord inance is for any reason held inval id or
unconsti t ut ional by an y co urt of competent j ur isd iction, such
portion shall be deemed a separate, distinct and independent
prov ision and suc h hold ing shall not affec t the val id i ty 0 f the
remaining portions thereof.
Section 4
Nothing in this ordinance shall be construed to affect any
right, d ut y or 1 i ab il ity und er any ord inances in effect pr ior to
the effective date of this ordinance, and the same shall be con-
tin ued and concl Lrl ed und er such pr ior ord inance.
Section 5
The sched ule of rates under Section
hereof shall be
published on or about June 26, 1986, and a public hearin; shall be
held on July 28, 1986, in the City Council Chambers, Aspen City
Hall, Aspen, Colorado.
