B E'lWEEN THE CITY OF AS PEN AND IAUDERDALE -AS PEN CCRPORATION PROVID-
1NG FOR THE E~ENSION OF 'IREATED WATER SERVICE TO THE PRESERVE
PROJECT WHICH IS LOCATED OUTSIDE THE ASPEN CITY LIMITS BUT WITHIN
THE CITY'S SERVICE AREr... 2, SETTING FORTH THE TERMS AND CONDITIONS
FOR SUCH WATER M1\IN EXTENSION, AND AUTHCRIZING THE MAYCR TO EXE-
CurE SAID l\GREEMENT AND ALL OTHER roClMENTS NECESSARY TO ACCCM-
PLISH SAID WATER EXTENSION
WHEREAS, there has been submitted to the City Council a
Water Main Extension and Service Agreement between the City of
Aspen and Lauderdale-Aspen CorpJration providing for the extension
of treated water serv ice to the Preserve Proj ect which is located
out sid e the As pen Ci t Y limits but wi thin the Ci t y' s Serv ice Ar ea
2, a copy of which agreement is annexed hereto and made a part
her eo f.
N~v, THEREFCRE, BE IT ORDl\INED BY THE CITY COUNCIL OF THE
CITY OF r...S PEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve that
Water Main Extension and Service Agreement for the extension of
treated water service to the Preserve Project, which agreement is
annexed hereto and incorporated herein, between the City of Aspen
and Latrlerdale-r...spen Corp:>ration, and does hereby authorize the
Mayor to execute said agreement and all other docunents approved
by the City Attorney as may be necessary to accomplish said water
extension on behalf of the City of Aspen.

Section 2

If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion all shall be deemed a separate, distinct aoo irrlependent
provision and such holding shall not affect the validity of the
remain ing port ions ther eof .
Section 3
Nothing in this ord inance shall be construed to affect any
right, duty or liability under any ordinances in effect. prior to
the effective date of this ordinance, and the same shall be con-
tin ued and co ncl 00 ed urrl er such pr ior ord in ance.
Section 4
