AN ORDINANCE APPROVING THAT TRAIL AGREEMENT BETWEEN THE CITY OF
ASPEN, COLORADO, AND THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, TERMINATING A JOINT MAINTENANCE AND POLICING
AGREEMENT DATED SEPTEMBER 13, 1976, AND SETTING FOR THE TERMS AND
CONDITIONS FOR THE TRANSFERRING OF WAGNER PARK AND EASEMENTS FOR
THE COUNTY TRAIL SYSTEM FROM PITKIN COUNTY TO THE CITY OF ASPEN;
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF OF
THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council a
Trail Agreement between the City of Aspen and the Board of County
Commissioners of Pitkin County, Colorado, providing for the
termination of that Joint Maintenance and Policing Agreement
dated september 13, 1976, and tranSferring control of Wagner Park
and easements for the County Trail System to the City of Aspen.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
section 1
That the City Council hereby approves that agreement between
the City of Aspen and the Board of County Commissioners of Pitkin
County, Colorado, terminating that Joint Maintenance and Policing
Agreement dated September 13, 1976, and setting forth the terms
and conditions for transferring control of Wagner Park and
easements for the County Trail System to the City of Aspen, a
copy of which agreement is attached hereto and incorporated
herein by this reference, and authorizing the Mayor to execute

said agreement on behalf of the City of Aspen.
section 2
If any section, subsection, sentence, clause or portion of
this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portions
thereof.
section 3
The Agreement attached hereto is an amended version of that
agreement approved pursuant to Ordinance No. 18 (Series of 1985),
which ordinance is hereby repealed and superceded.
section 4
A public hearing on the ordinance shall be held on the /~~

Chambers, Aspen City Hall, Aspen, Colorado.
