AN ORDINANCE APPROVING THAT WATER MAIN EXTENSION AND SERVICE
AGREEMENT BETWEEN THE CITY OF ASPEN, COLORADO, AND THE MAROON
CREEK RANCH HOMEOWNERS PROVIDING FOR THE SUPPLY OF WATER TO THE
HOMEOWNERS WITHIN THE CITY'S WATER SERVICE AREA 5; SETTING FORTH
THE TERMS AND CONDITIONS FOR THE SUPPLY OF WATER BY THE CITY TO
SAID HOMEOWNERS; AND AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT ON BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council a
Water Main Extension and Service Agreement between the City of
Aspen and the Maroon Creek Ranch Homeowners whereby the City
agrees to provide water service to the homeowners within Water
Service Area 5.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council hereby approves that Water Main
Extension and Service Agreement between the City of Aspen,
Colorado, and the Maroon Creek Ranch Homeowners providing for the
supply of water by the City to the homeowners in Water Service
Area 5, a copy of which agreement is attached hereto and incor-
porated herein by this reference, and authorizing the Mayor to
execute said agreement on behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinance in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinance.
Section 4
A public hearing on the ordinance shall be held on the
day of , 1986, in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
