HomeMy WebLinkAboutordinance.council.048-86 ORDINANCE NO ~ (SERIES OF 1986) AN ORDINANCE AMENDING DIVISION 3 OF ARTICLE III OF CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, ENTITLED "WATER RATE AND CHARGES" (THEREBY AMENDING ORDINANCE NO 18-1984) BY INCREASING CERTAIN WATER RATES AND CHARGES. WHEREAS, the City Council finds it necessary to improve the existing water transmission system; and WHEREAS, the City has issued 9 million dollars of General Obligation Utility Bonds; and WHEREAS, the City Council desires that the cost of the debt service for these utility improvements be paid for by the water customers rather than out of the General Fund; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: SECTIQN 1 That Division 3 of Article III of Chapter 23 of the Municipal Code of the City of Aspen, Colorado, (and by implication, Ordinance No. 18-7984 No.3-1983 and Ordinance No. 36-1981) and hereby is amended to read as follows: A. That Section 23-101(a) is hereby amended to read as follows: "(a) The residential, multiple family and commercial flat in-city rate shall be computed on a point basis according to the following schedule; and for each point determined by fixture count there shall be charged ( $1.27 ) per-month, provided, however, that in no event shall there be billed less than ( $19.32 ) per-month for any flat rate service given." B. That section 23-102(a) is hereby amended to read as follows: "(a) Residential (single-family and duplex only) . For in-city residential water users where a metering device has been installed, is operative and readily accessible, the rate of charge and/or monthly charge, or any fraction thereof, shall be computed in accordance with the following table: Gallons Monthly Charge Meter Size (Minimum) (Minimum) 3/4 inch 5,000 $11.60 1 inch 10,000 $20.88 1 1/2 inch 20,000 $36.72 2 inch 40,000 $71.12 Each additional 1,000 gallons over the minimum = $1.27 C. That Section 23-102(b) is hereby amended to read as follows "(b) Commercial and multiple family (all other metered water users except residential single and two family units). For commercial and multiple family in-city users where a metering device has been installed, is operative and readily accessible, the rate of charge and/or monthly charge or any fraction thereof, shall be computed in accordance with the following table: Meter Size Gallons Monthly Charge (Minimum) (Minimum) 3/4 inch 5,000 $ 12.77 1 inch 10,000 $ 23.20 1 1/2 inch 20,000 $ 40.21 2 inch 40,000 $ 77.30 3 inch 90,000 $170.45 4 inch 150,000 $278.29 6 inch 300,000 $541.14 Each additional 1,000 gallons over the minimum = $1.45 SECTION 2 The water rates and charges contained in Section 1 of this ordinance shall become effective as of October 15, 1986. SECTION.~ If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. SECTIQN 4 A public hearing on the ordinance shall be held on the ~ day of 1986, at 5:00 p.m. in the City Council Chambers, Aspen City Hall, 130 South Galena Street, Aspen, Colorado.
