ORDINANCE NO. 3
(Series of 1987
AN ORDINANCE APPROVING THE CONVEYANCE OF UNIT 1, McARTHUR
CONDOMINIUMS, PITKIN COUNTY, COLORADO, TO ROBERT S., JR. AND
LEONARDA ANDERSON PURSUANT TO THE TERMS OF THE PURCHASE AND
OPTION AGREEMENT ANNEXED HERETO; AND AUTHORIZING THE MAYOR TO
EXECUTE ALL DOCUMENTS AS MAY BE APPROPRIATE TO CONSUMMATE THE
TRANSACTION
WHEREAS, the City Council desires to convey Unit 1, McArthur
Condominiums to Robert S. and Leonarda Anderson on the terms and
conditions set forth in the Purchase and Option Agreement between
the City of Aspen and Robert S. Anderson, Jr. and Leonarda
Anderson, annexed hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO
Section 1
The City Council does hereby authorize and approve the
conveyance of unit 1, McArthur Condominiums, to Robert S.
Anderson, Jr. and Leonarda Anderson in accordance with the terms
of that Purchase and Option Agreement between the City of Aspen
and Robert S. Anderson, Jr. and Leonarda Anderson annexed hereto.
Said agreement may be modified as may be necessary to consummate
the transaction upon approval by the city Attorney.
section 2
The Mayor is authorized to execute such documents on behalf
of the City as may be deemed necessary to consummate the afore-
said transaction.
section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
section 4
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinance.
section 5
A public hearing on the ordinance shall be held on the':"~(~
