DEVELOPMENT ORDER
of the
City of Aspen
Community Development Department
This Development Order, hereinafter "Order", is hereby issued pursuant to Seetion
26.304.070, "Development Orders", and Seetion 26.308.010, "Vested Property Rights",
of the City of Aspen Munieipal Code. This Order allows development of a site specific
development plan pursuant to the provisions of the land use approvals, described herein.
The effective date of this Order shall also be the initiation date of a three-year vested
property right. The vested property right shall expire on the day after the third
anniversary of the effective date of this Order, unless a building permit is approved
pursuant to Seetion 26.304.075, or unless an exemption, extension, reinstatement, or a
revocation is issued by City Couneil pursuant to Seetion 26.308.010. After Expiration of
vested property rights, this Order shall remain in full force and effeet, excluding any
growth management allotments granted pursuant to Section 26.470, but shall be subjeet
to any amendments to the Land Use Code adopted sinee the effective date of this Order.
This Development Order is associated with the property noted below for the site specifie

WHEREAS, the Community Development Department received an application
from the Applieant, William and Joyce Gruenberg, represented by Randy Wedum of
Wedum Associates, requesting a Stream Margin Review approval and a variance to the

~ may review and approve the Stream Margin Review Applieation and serve as the Design

WHEREAS, upon review of the application and the applicable Land Use Code
standards, the Community Development Department recommends approval for the Stream
Margin Review and the. variance to .the Residential Design Standards for the non-
orthogonal windows; and
WHEREAS, the Aspen Planning and Zoning Commission reviewedan9
eonsidered the development proposal under the applicable provisions of the Munieipal Code
as identified herein, and reviewed and eonsidered the recommendation of the Community
Development Director, and has taken and eonsidered public eomment at a duly noticed
public hearing on October 1, 2002; and
WHEREAS, the City of Aspen Planning aIld Zoning Commission fmds that the
development proposal meets or exeeeds all applieable development standards and that the
approvals of the development proposal are consistent with the goals and elements of the
Aspen Area Community Plan; and,
WHEREAS, the City of Aspen Planning and Zoning Commission finds that this
Resolution furthers and is necessary for the promotion of public health, safety, and welfare;
and.
WHEREAS, the Planning and Zoning Commission approved, by a vote of six
to zero (Q - Q) the Stream Margin Review and varianee to the Residential Design
Standards; and,
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF ASPEN, COLORADO ON TillS 1st DAY OF
OCTOBER 2002, THAT:

Section 1
Pursuant to the procedures and standards set forth in Title 26 of the Aspen Munieipal
Code, the Planning and Zoning Commission approves the Stream Margin Review subjeet

1. No vegetation shall be removed or damaged or slope grade changes (eut or fill)
made outside of the speeifically defined building envelope designated on the
approved site plan (dated July 5, 2002 and revised August 17,2002). The building
envelope shall be barricaded prior to issuanee of any demolition, excavation or
,building permits and the barricade shall remain in place until the issuance of
Certificates of Occupancy; and
2. Prior to issuance of building permit, the following shall be required:

a. A lighting plan shall be submitted with the building permit applieation. All
exterior lighting shall be low and downeast with no light(s) directed
toward the river or loeated down the slope and shall be in eompIiance with
section 26.575.150.
A drainage plan shall be submitted to the Engineering Department for
review prior to construetion. The proposed development shall not pollute
or interfere with the natural ehanges of the river, stream or other tributary
including erosion and/or sedimentation dllring eonstruction and a silt fence
shall be placed along the riverside of the building envelope.
The appIieant shall obtain all necessary permits from the Building
Department as required.
The applieant shall pay a Park Dedication Impact Fee for any additional
bedrooms that are added.
The applieant shall obtain a floodplain development permit from the City
of Aspen Engineering Department.
A finaneial guarantee shall be provided to the City in an amount
determined by the Community Development Engineer for the diteh
proposed to be relocated, that applies to the developer and his heirs,
successors and assigns that ensures that the flood carrying eapaeity on the
parcel is not diminished as a result of the reloeation. The bond shall be
released upon eompletion of the ditch reloeation and satisfaetion of the
Community Development Engineer.
g. The site plan submitted with the building permit application shall clearly
delineate the top of slope.
h. Confirmation from the Army Corps of Engineers that no wetlands permits
shall be required for this application,
1. In aecordanee with documented offer from the appIieant (letter from
Wedum Architect & Associates dated September 23,2002), a Fisherman's
Easement shall be dedicated to tjJ.e City in a form approved by the City
Attorney for the area of the lot from the Roaring Fork River up to the edge
of bank, as shown on the approved site plan,

3. A written notiee shall be. given to the Colorado Water Conservation Board prior to
any alteration or relocation of a watercourse, and a eopy of said notice shall be
submitted to the Federal Emergency Management Ageney and the Community
Development Department.
4. The landseape plan shall limit new plantings (including trees, shrubs, flowers, and
grasses) outside of the designated building envelope on the riverside to native
riparian vegetation.
5. If the newly enclosed area plus the area of the exiting strueture exceeds 5,000
square feet, the newly enclosed area may be required to be sprinkled. The plans
will be reviewed with the Fire Marshall at the time of application for a building
permit.
Section 2
Pursuant to the procedures and standards set. forth in Title. 26 of the Aspen Municipal
Code, the Planning and Zoning Commission approves the variance to the Residential
Design Standards, allowing two (2) non-orthogonal windows on the south-east elevation
of the residence.
Section 3
All material representations and commitments made by the applicant pursuant to the
development proposal approvals as herein awarded, whether in publie hearing or
doeumentation presented before the Planning and Zoning Commission or City Council, are
hereby incorporated in sueh plan development approvals and the same shall be eomplied
with as if fully set forth herein, unless amended by an authorized entity.
Section 4
If any seetion, subsection, sentence, clause, phrase, or portion of this Resolution is for
any reason held invalid or uneonstitutional in a court of competent jurisdietion, such
portion shall be deemed a separate, distinet and independent provision and shall not affeet
the validity of the remaining portions thereof.

specifically mentioning the ditch relocation. is sufficient Regarding the site visit, I would follow up
directly with Nick Adeh (920-7476). I have just sent off the resolution that establishes the development
order. to the Deputy City Clerk and she informs me that it will be signed and recorded in two weeks or
less. It is not neeessary to wait for it to be recorded to submit th.e building permit You will. however,
need to have all of the inf()rmation required for building permit (as outlined in the conditions of approval)
with your building permit

REQUESTED ACTION
Stream Margin Review and Appeal of the Stream Margin Map's top of slope determination
and a varianee to the Residential Design Standards for two non-orthogonal windows.
SUMMARY
The property is located in an Environmentally Sensitive Area along the Roaring Fork River,
therefore is subjeet to the special review procedures of the Stream Margin Review. The
applieant is proposing a 2,060 square foot addition to an existing single-family dwelling,
whieh consists of a two ear garage, laundry room, mud room, shop, new entry, and a later

remodel and addition to the master bedroom, bunk room, bathrooms on the seeond floor of
the existing house.
The existing house is located partially in the 100-year floodplain, although the entire
addition will be sited to be eompletely outside of the 100-year floodplain. The Stream
Margin Map indicates that the house and addition are within the designated top of slope
boundary, so the applieant is requesting a varianee to the designated top of slope boundary.
The applicant is also requesting a varianee to add two non-orthogonal windows to the front
fa9ade where only one is allowed.
STAFF COMMENTS
Development loeated within one hundred (100) feet, measured horizontally, from the high
water line of the Roaring Fork River and its tributary streams, or within the one-hundred-year
floodplain where it extends one hundred (100) feet from the high water line of the Roaring
Fork River and its tributary streams, or within a flood hazard area are subject to heightened
review so as to reduee and prevent property loss by flood while ensuring the natural and
unimpeded flow of watercourses. Review shall eneourage development and land uses that
preserve and protect existing watercourses as important natural features.
26.435.040 C Stream Marf!in Review Standards states:
No development shall be permitted Within the Stream. Margin of the Roaring Fork River,
unless the Community Development Director makes a determinati9n tha,t . the proposed
development complies with all requirements set forth below (NOTE: Sinee the application
does not comply with criteria #8 and #9 below, it is being reviewed by the Planning and
Zoning Commission instead of the Community Development Director):
1. It can be demonstrated that any proposed development, whieh is in the Special Flood
Hazard Area, will not increase the base flood elevation on the parcel proposed for
development. This shall be demonstrated by an engineering study prepared by a
professional engineer registered to practiee in the State of Colorado which shows that
the base flood elevation will not be raised, including, but not limited to, proposing
mitigation techniques on or off-site which eompensate for any base flood elevation
increase caused by the development; and
>- Staff Finding:
Complies - Although the existing house is partially located within the IOO-year
floodplain (Special Flood Hazard Area), the submitted plans show the new
addition to be located completely out ofthe IOO-year floodplain,
2. The reeommendations of the Aspen Area Community Plan: Parks/Recreation/Open
Space/Trails Plan and the Roaring Fork River Greenway Plan are implemented in the
proposed plan for development, to the greatest extent practicable. Areas of historie
publie use or aecess shall be dedicated via a reeorded easement for publie use. A

fisherman's easement granting public fishing access within the high water boundaries
of the river course shall be granted via a recorded "Fisherman's Easement;" and,
~ Staff Finding:
Complies - Per the submitted plans staff does !lot foresee any conflicts with goals
and objectives ofthe Aspen Area Community Plan; and
Complies - The Roaring Fork River Greenway Plan recommendations are being
met and implemented to the greatest extent possible; and
According to the applicant, this site has not traditionally provided access for
fishermen. Staff inquired as to whether the applicant would be willing to
provide a fisherman's easement granting public fishing aecess within the high
water boundaries of the river course, but the applicant did not wish to do so at
this time.
3. There is no vegetation removed or damaged or slope grade changes (cut or fill) made
outside of a specifieally defined building envelope. A building envelope shall be
designated by this review and said envelope shall be barrieaded prior to issuanee of
any demolition, excavation or building permits. The barricades shall remain in place
until the issuanee of Certifieates of Oecupancy; and
~ Staff Finding:
Complies - Per the submitted. plans, 6 trees will be need to be relocated and 3
trees will be removed (due to roots affecting the floor in th'1 sun room, branches
and debris falling on the solar skylight, and are in the area of expansion),
however, all are located within the specifically defined building envelope, A
Tree Removal Permit has been obtained fro,m the City of Aspen Parks Office
granting approval for removing the trees (with. a payment of $8,000 for
mitigation). Given the heavily wooded nature of the site, the removal of 3 trees
and the relocating of 6 others will not have a notice:tbleeffect on thll site.
There will not be any disturbance of vegetation outside of the building envelope.
The Code requires that the building envelope be barricaded prior to issuance of
any demolition, excavation or building permits and that it shall remain in place
until the issuance of Certificate of Occupancy.
4. The proposed development does not pollute or interfere with the natural changes of
the river, stream or other tributary, including erosion and/or sedimentation during
constmetion. Increased on-site drainage shall be aeeommodated within the pareel to
prevent entry into the river or onto its banks. Pools or hot tubs eannot be drained
outside of the designated building envelope; and

>- Staff Findin2:
Complies - The proposed development will not pollute the river or interfere with
the natural changes of the river, stream or other tributary including erosion
and/or sedimentation during construction. As a condition of approval, a silt
fence shall be placed along the riverside of the building envelope.
5. Written notice is given to the Colorado Water Conservation Board prior to any
alteration or reloeation of a water course, and a copy of said notice is submitted to the
Federal Emergency Management Ageney; and
>- Staff Findin2:
Complies - As a condition of approval, the applicant will notify the Colorado
Water Conservation Board because they are proposing to relocate the Taggart
Ditch to make way for the proposed addition,
6. A guarantee is provided in the event a water eourse is altered or reloeated, that applies
to the developer and his heirs, successors and assigns that ensures that the flood
carrying capacity on the parcel is not diminished; and
>- Staff Findin2:
Complies - Since the watercourse is proposed to be altered, a guarantee shall be
provided and applied to the developer and his heirs, successors and assigns that
ensures that the flood carrying capacity on the parcel is not diminished. The
details of the guarantee shall be determined prior to building permit (a condition
of approval has been added to this effect).
7. Copies are provided of all necessary federal and state permits relating to work within
the one-hundred-year floodplain; and
>- Staff Findin2:
Complies - Per the submitted plans, no development is proposed within the one-
hundred-year floodplain.
8. There is no development other than approved native vegetation planting taking place
below the top of slope or within fifteen (15) feet of the top of slope or the high
waterline, whichever is most restrictive. This is an effort to proteet tbe existing
riparian vegetation and bank stability; and
>- Staff Findin2:
Staff supports a variance to the location of the top of slope to accommodate this
request for the following reasons: This is an existing house located within the top
of slope and the high waterline, so there already exists a non-conforming

structure. The addition to the house will be.locatedo~tside. of the. high
waterline, therefore, not expanding the non-conformity, If this were a proposal
for a new house on a previously un-built lot, staff would require the home to be
built to the standards of the ordinance, According to Engineering, in this
instance, the most important factor is that the addition is located outside of the
floodplain and that it is covered under the National Flood Insurance Program.
9. All development outside the fifteen (15) foot setback from the top of slope does not
exeeed a height delineated by a line drawn at a forty-five (45) degree angle from
ground level at the top of slope. Height shall be measured and determined by the
Community Development Director using the definition for height set forth at Seetion
26.04.1 00 and method of ea1culating height set forth at Seetion 26.575.020; and
>- Staff Finding:
With the variance to the stop of slope location, the new addition (but not a
portion of the existing house) will be. located outside.the 15~jfoot setback from the
new top of slope and does not exceed the height delineated by a line drawn at a
45-degree angle from the ground level at the top of slope.
10. All exterior lighting is low and downcast with no light(s) directed toward the river or
loeated down the slope and shall be in eompliance with seetion 26.575.150; and
>- Staff Finding:
Complies - As a condition of approval, the applicant shall submit a lighting plan
with the Building Permit application demonstrating compliance with all exterior
lighting and design criteria,
11. There has been aceurate identification of wetlanqs and riparian zones.

Complies - A site plan has been submitted that identifies the riparian zone. The

Variance from the Residential Design Standards
Section 26.410.020 D. Variances. Variances from the Residential Desizn Standards, Section
26.410.040 , may be granted by the Design Review Appeal Committe" as established in
Chapter 26.222. An applieant who desires to eonsolidate other requisite land use reviews
by the Historic Preservation Commission, the Board of Adjustment or the Planning and
Zoning Commission may elect to have the varianee applieation deeided by the board or

The applicant requests a variance from the follo'Ying Residential Design Standard
requirement:
Section 26.4JO.040.D.3.b. No more than one non-orthogonal window shall be allowed on
eaeh facade of the building. A single non-orthogonal window in a gable end may be divided
with mullions and still be considered one non-orthogonal window.
The applieant is proposing two non-orthogonal windows (see attached letter from applieant
requesting the varianee). Staff supports the request, as this strueture is not visible at all to the
general public. It is located at the end of a eul-de-sae and on a heavily wooded lot and this
relatively minor varianee would not impact the streetseape.
ST AFF RECOMMENDATION
Staff recommends approval of the stream Margin Review and Appeal of the Stream Margin
Map's top of slope determination, finding that the eriteria per Seetion 26.435.040 C, Stream
Margin Review Standards has been met and the variancy to theR,ysidel1ti;l1 Design Standards
to allow two non-orthogonal windows on the south east and south west fayade.

for the Gruenberg Property and I agree that the wetland area mentioned in my letter of
August 21, 2002 is not on the Gruenberg property, it is on the property direetly
downstream. I regret this oversight and any confusion it may have caused.
Seeondly, please know that since the work that is being proposed includes only a
relocation of an existing ditch; and the diteh will be reloeated on the Gruenberg
property only; and no jurisdictional wetlands will be impacted by the proposed work;
and the work does not change the characteristics of the flood plain; and the diteh does
not presently lie within the 100 year flood plain, there are no notifieations required by

This letter is a request by the OWller to get a variance from the design review
requirement concerning non-orthogonal windows.
The property is at the end of the road in an pld subdivision. It is heavily wooded
and is visually blocked from view by the road or any other house.

The entry on the addition has an eyebrow window above the entry, and we are
placing them over the garage doors for drainage and to tie in the entry. Also in Part 2 of
the remodel we will be remodel4tg the upper level of the existing house, were we have
added eyebrow windows to this fa9ade to tie the new addition into the main house.
They main entry element needs to be reflected in. other elements of a building for
balance and visual continuity, and residential architecture is no different. To have one
element on a fa9ade as a limit is not esthetically pleasing or balanced.
I do not know how this concept was developed or what its intent was, but due to
its location and non visibility from anyone, it should not have to be applied here.
We sincerely request a variance from the non-orthogonal window design standard
on this residence, for our eye-brow windows.

In reference to your request for information dated August 27, 2002 I have these
additional comments.
1. The Beach Environmental LLC. Letter, which I have submitted to yon,
explains that no letter is required.
2. Addressing "Fisherman Easement
a. There is no public access through the property from a public way existing.
b. Since the High Water boundary of the river bas been established by the
City Engineer as the 100-year flood plane line and that that line goes
through the middle of the house and site, a Fisherman Easement would not
make since using that line. Access along the river up to the edge ofbank
as shown on the survey would however be acceptable.
3. The Beach Environmental LLC. Letter which I have submitted to you explains

4. The Surveyor used the Flood Plane Map Supplied by the City of Aspen.

In response to our telephone conversation this afternoon, I have reviewed the survey
for the Gruenberg Property and I agree that the wetland area mentioned in my letter of
August 21, 2002 is not on the Gruenberg property, it is on the property directly
downstream. I regret this oversight and any confusion it may have caused.
Secondly, please know that since the work that is being proposed includes only a
relocation of an existing ditch; and the ditch will be relocated on the Gruenberg
property only; and no jurisdictional wetlands will be impacted by the proposed work;
and the work does not change the characteristics of the flood plain; and the ditch does
not presently lie within the 100 year flood plain, there are no notifications required by
either the U.S. Army Corps of Engineers or the Federal Emergency Management
Agency.

By virtue of this .letter, I wanted to follow-up on a few items as well as bring some
questions to your attention that I've had in the course of reviewing this project.
First, do you have clear direction on our request for more information regarding the top
of slope designation? We reviewed your submitted information with the City Engineer,
Nick Adeh, and he felt several additional cross sections are necessary for him to make a
determination 'on whether to accept your surveyor's getermination' of top of slope or to
stay with the determination represented on the city's maps. . . ,
In' addition to that question, I have the following additional questions, which need to be
addressed prior to scheduling a public hearing. They are as follows:
.' Have you received a letter from the Army Corps of Engineers regarding whether
or not there are impacts to wetlands by relocating the ditch and other impacts?
· The Stream Margin Ordinance 'requires that public access easements be dedicated
for areas that have traditionallyexperienced public access. Does this lot typically
see any public access? If not, would the applicant be 'willing to grant a
Fisherman's Easement to allow public fishing access within the high water
boundaries of the river (Note: this is not a city requirement for approval)? .
· Section 26.435.040 C (5) requires, written notice to the Colorado Water
Conservation Board prior to any relocation of a watercourse (which the ditch
qualifies as) with a copy submitted to FEMA. . Please submit that letter to City
staff as well and provide confirmation that those entities have received that letter:'
· Please provide an explanation of how you determined the IOO-year floodplain
designation on the site.

As far as I am aware, this is a drainageway and not a ditch. There are no
appropraiated water rights assocaiated with this from our review of arae
water rights, There should be no water rights implications associated with
relocating the drainageway. Of course this could affect the flood channel
because the drainageway would be carrying water during these conditions,
I believe there is a connection between the Taggert Ditch and this .
drainageway, but this connection is upstream of the property in question,
The City does not own an interest in the Taggert Ditch but has been asked
several times to take over operation of the ditch, Part of the reason the
City declined this request is the potential for flood damage from operation
of the ditch, described below. During flooding conditions on Castle Creek it
is possible that a significant flow of water could be conveyed into this
Taggert Ditch and thence to a complicated system of drainage ways through
the Black Birch neighborhood. There is no practical way to limit the amount
of water entering the Taggert Dich since the headgate and return structures
are very close to the river level and are prone to flooding. Tom Rubel at
Parks may have more familiarity with the drainage network in this area since
I believe he was lOOking at it during the last significant flooding in 1995,
My general comment is to take a very close look at the flood way and flood
plain delineations to ensure that it considers all the pathways that would
potentially flood, including the Taggert Ditch headgate. I would also take a
close look at the design calculations for how much water will be conveyed in
the relocated drainageway, including an allowance for debris clogging, Thanks,

1170 Black Birch is located in the R-30 Zone District which has the following
dimensional requirements:
Setbacks:
Front Yard - 25 feet
Side Yard - 10 feet
Rear Yard - 15 feet
The structure and landscape plans do appear to comply with the setback requirements, but
this will be confirmed at the time of building permit submittal. Nodevelopment is
permitted in the setback more than 30" above or below natural grade. No development,
including landscaping, is permitted below the top of slope or within 15' of the top of
slope line.
Based on the information submitted by the applicant, the gross lot area is 26, I 0 1 square
feet. After the exclusion of areas within the high water line the lot area totals 22,874 for
the purposes of calculating FAR. Staff needs to verify that the language "area
underwater" on the survey is consistent with the Code's definition of "high water line."
The proposed floor area as well as lot area calculations will be verified when working
drawings are submitted to the Building Department for building permit review.
The applicant will be required to pay a Park Dedication Impact Fee for any additional
bedrooms that are added.
Residential Design Standards
Based on floor plans submitted July 2002, the proposed dwelling unit met all of the
required Residential Design Standards with the exception of having more than 1 non-
orthogonal window per fayade. The windows will need to be changed or a variance from
the standards will need to be sought.

Stream Margin Review
Exterior lighting is required to meet Section 26.575.150 of the Land Use Code. Per the
Section 26.575.150, the applicant is required to submit a lighting plan with the ESA
review. Staff feels a lighting plan, with cut sheets, can be submitted at the time of
building permit submittal.

Section 21.16.060 Driv~way and curb cut specifications.
(a) Where curbs exist, or are required, driveways shall be
paved for their full width from curb to property line.
(b) Where a driveway crosses a sidewalk, the sidewalk shall
be increased to a minimum of six (6) inches of concrete.
(c) A driveway or curb cut on a corner lot shall be set back a
minimum often (10) feet from the property line at the corner and
shall be a minimum of five (5) feet from the end of the curb
radius.
(d) There shall be a minimum of twenty-five (25) feet
between any two (2) curb cuts whether on one (1) or more
properties, except common driveways may be used on adjoining
properties. Distance between curb cuts will be such as to
maximize the amount of on-street parking.
(e) The number and width of curb cuts for the different
zoning districts shall be as follows:
(1) In residential districts R-6, R-15, R-30, R-40 and RR and
in Conservation (C) District there shall be allowed one (1) curb
cut often (10) feet in width for each building site with sixty (60)
feet or less frontage. For building sites with over sixty (60) feet
of frontage, the curb .cut shall be either ten (10) feet in width for
a single driveway or eighteen (18) feet in width for a double
driveway.
(2) In districts Neighborhood Commercial (Ne),
Service/CommerciallIndustrial (S/CII), Commercial Lodge (CL),
Lodge-One (L-l), Lodge-Two (L-2), Office (0) and 0-2, and
Residential-MuitipleFamily (R-MF), each building site shall be
allowed either one (1) eighteen-foot wide curb cut or two (2)
ten-foot wide curb cuts.
(3) In commercial districts CC and Cl each building site
shall be allowed one (1) ten-foot wide curb cut.
(4) In specially planned districts and all other districts the
number and size of curb cuts shall be subject to review.
(f) No driveway or curb cut shall be allowed on State
Highway 82 or other designated arterial where public alley
access exists, anything to the contrary notwithstanding.
(g) All curb cuts shall conform to the standard specifications
; in the City Engineer's office.
(h) All newly constructed or rebuilt driveways shall not
exceed a maximum slope of twelve (12) percent within twenty
(20) feet of a property line bordering a public or private

is not possibie at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an
initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis,
APPLICANT agrees additional costs may accrue following their hearings andlor approvals, APPLICANT agrees he
will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred, CITY agrees it will be benefited through the greater certainty
of recovering its full costs to process APPLICANT'S application,
4, CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission andlor City Council to enable the Planning
Commission andlor City Council to make legally required findings for project consideration, unless current billings
are paid in full-jJrior to decision.
5, Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the
amount of $ which is for hours of Community Development staff time, and if actual
recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, inciuding post approval review at a rate of $205.00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date,
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and
in no case will building permits be issued until all costs associated with case processing have been paid,

Rezoning or text amendment. Whenever the official zoning district map is in
any way to be changed or amended incidental to or as part of a general revision
of this Title, or whenever the text of this Title is to be amended, whether such
revision be made by repeal of this Title and enactment of a new land use
