AN ORDINANCE AMENDING ORDINANCE NO. 58, SERIES OF 1986,
BY ADDING AN APPROPRIATION FOR POLICE PENSION FUND
EXPENSES OF $44,000 AND RECOGNIZING POLICE PENSION FUND
REVENUES OF $99,000, WHICH APPROPRIATIONS WERE INADVER-
TENTLY DELETED FROM SAID ORDINANCE.
WHEREAS, it has come to the attention of the City Council
that an appropriation for Police Pension Fund expenses of $44,000
and recognizing Police Pension Fund Revenues of $99,000 were
inadvertently deleted from the provisions of Ordinance No. 58,
Series of 1986, and
WHEREAS, it was the intention of the city Council to
authorize the aforesaid appropriations at the time Ordinance No.
58, Series of 1986, was passed, and
WHEREAS, the City Council desires to amend Ordinance No. 58,
Series of 1986, so as to accurately reflect the intention of the
City Council with regard to the aforesaid appropriations, and
WHEREAS, the city Manager has certified that as of the date
of the passage of Ordinance No. 58, Series of 1986, revenues and
funds in excess of those estimated in the budget were available
for appropriation in the Police Pension Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
- CITY OF ASPEN, COLORADO:
Section 1
That the title of Ordinance No. 58, Series of 1986, be
amended by adding the following: "AN ORDINANCE AMENDING ORDI-
NANCE NO. 58, SERIES OF 1986, BY ADDING AN APPROPRIATION FOR
POLICE PENSION FUND EXPENSES OF $44,000 AND RECOGNIZING POLICE
PENSION FUND REVENUES OF $99,000."
Section 2
That Section 1 of Ordinance No. 58, Series of 1986, be
amended by inserting the following language after the language
"Lodge Area Special Improvement District Capital Projects Fund"
and before the language "the City hereby makes supplemental
appropriations as itemized in Exhibit A attached."
"Police Pension Fund"
Section 3
That Exhibit "A" be annexed to Ordinance No. 58, Series of
1986, be amended by the addition of the aforesaid appropriations
for the purposed specified in the amended Exhibit "A" which is
annexed hereto and made a part hereof.
Section 4
If any section, subsection, sentence, clause, phrase of
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the /~%f-/
day of ~ , 1987, at 5:00 p.m. in the
city Council Chambers, Aspen City Hall, Aspen, Colorado.
