AN ORDINANCE APPROVING AN AGREEMENT FOR PURCHASE AND SALE OF REAL
ESTATE BETWEEN THE CITY OF ASPEN, COLORADO, AND INFOTEL PARTNERS
PROVIDING FOR THE SALE OF LOT 2, GOLF COURSE SUBDIVISION (COM-
MONLY KNOWN AS "THE RED ROOF INN") BY THE CITY OF ASPEN TO
INFOTEL PARTNERS FOR THE PURCHASE PRICE OF TWO MILLION TWO
HUNDRED FIFTY THOUSAND DOLLARS ($2,250,000.00) INCLUDING ALL
IMPROVEMENTS, FURNITURE AND FIXTURES, SETTING FORTH THE TERMS AND
CONDITIONS FOR SUCH SALE, AND AUTHORIZING THE MAYOR TO EXECUTE
SAID AGREEMENT AND ALL OTHER DOCUMENTS NECESSARY TO ACCOMPLISH
SAID SALE ON BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council an
Agreement for Purchase and Sale of Lot 2, Golf Course Subdivision
(commonly known as the "Red Roof Inn"), involving the sale of
said parcel and improvements, equipment, furniture and fixtures,
access and utility easements, and sign easement, for a purchase
price of $2,250,000.00, a copy of which agreement is annexed
hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve that
Agreement for Purchase and Sale of Real Estate, a copy of which
is annexed hereto and incorporated herein, between the City of
Aspen, Colorado, and Infotel Partners providing for the sale of
Lot 2, Golf Course Subdivision, and the improvements, equipment,
furniture and fixtures, access and utility easements and sign
easement to Infotel Partners for a purchase price of
$2,250,000.00, and does hereby authorize the Mayor to execute
said agreement and all other documents approved by the City
Attorney as may be necessary to accomplish said sale on behalf of
the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
Section 4
A public hearing on the ordinance shall be held on the ~~

Chambers, Aspen City Hall, Aspen, Colorado.
