HomeMy WebLinkAboutminutes.council.20030203Special Meeting Aspen Ci~, Council February 3, 2003 Mayor Klanderud called the special meeting to order with Councilmembers Semrau, Hershey, Paulson and McCabe present. Councilman Semrau moved to go into executive session to discuss a personnel matter pursuant to C.R.S. 24-6-402(4)(f) and property acquisition pursuant to C.R.S. 24-6- 402(4)(a); seconded by Councilman Hershey. All in favor, motion carried. Councilman Paulson asked if the personnel matter is regarding a city board member. Mayor Klanderud said it is and Council is according that board member the courtesy of an executive session. Councilman Paulson asked if the board member wanted an open meeting or an executive session. John Womester, city attorney, said under state statutes, the person subject of an executive session can ask that it be an open meeting. Bert Myrin said he would like this to be an open meeting. Mayor Klandemd said Council will meet in executix~e ~e~sion to dis~gss land acquisition and will return to discuss the personnel issue. Councilman Hershey moved to come out of executive session; seconded by Councilman McCabe. All in favor, motion carried. Mayor Klandemd thanked Bert Myrin for his years on P&Z. Mayor Klanderud moved to terminate Myrin's appointment to P&Z; seconded by Councilman Semrau. Councilman Semrau also thanked Myrin for his time on P&Z. Councilman Panlson asked on what grounds. Mayor Klandemd said all appointees to city boards and commission serve at the pleasure of Council and someone can be dismissed from a board without cause. Councilman Paulson asked if there was a memorandum generated on this. Mayor Klandemd said there was not. Councilman paUlson asked if there was discussion an~ong the other Council members; Councilman Paulson said he feels left out. Mayor Klandemd said she has ~alked G0 th~ city attorney, to Myrin, to the city attorney with Myrin. Mayor Klandernd said she has discussed this with other Council but not as a group. Councilman Semrau said this is the first group discussion on this topic. Councilman Semrau said he Would be glad to meet with Myrin personally and explain his reasons for supporting this termination. Councilman Pauls0n asked if there should be a group discussion. Mayor Klanderud noted technically Council could have had a meeting, made a decision, and sent a letter to Myrin. Mayor Klanderud said as a courtesy, she requested an executive session. Myrin chose not to have an executive session. Mayor Klandernd said she chooses not to discuss this in public. Councilman Paulson said Myrin should know of what he is being accused. Councilman Paulson said he is not privy to these reasons. Mayor Klanderud said Councilman Paulson is aware of the reason. Councilman Semrau noted there is no accused; this is board member who serves at the discretion of Council. There is no accusation; the question has come up whether Council wants Myrin to continue on P&Z. Councilman Paulson asked if there is further discussion. John Worcester, city attorney, reiterated board members serve at the pleasure of City Council and if Council does not wish to discuss it, he cannot Special Meeting Aspen City Council February 3, 2003 force it. Councilman Paulson said he is not clear on the reasons for this. Councilman Semrau said as a courtesy to Bert, he will not discuss this in open session. Councilman Paulson said he had no idea this matter was coming up. All in favor with the exception of Councilman Paulson. All in favor, motion carried. Councilman Hershey moved to adjourn: seconded by Councilman McCabe. All in favor. motion carried. City Clerk
