(Series of 1987) A ORDINANCE OF THE CITY COUNCIL OF ASPEN, COLORADO, AUTHORIZING AN ADMINISTRATIVE DELAY IN THE ACCEPTANCE AND/OR PROCESSING OF ANY APPLICATION FOR A BUILDING PERMIT FOR CONSTRUC- TION OF STRUCTURES WITHIN THE R-6 ZONE DISTRICT AS DEPICTED ON THE OFFICIAL ZONING MAP OF THE CITY OF ASPEN WHEREAS, it has come to the attention of the City Council that construction, reconstruction or remodelling of structures within the R-6 zone district as depicted on the official zoning map of the City of Aspen (hereinafter referred to as "R-611), may be having an undesirable adverse impact because (1) they result in an unacceptable increase in density in established neighbor- hoods, (2) they have the potential for creating structures out of character with the overall nature of these areas, and (3) the dimensional requirements of these zone districts may be outmoded with regard to current conditions; and WHEREAS, the City Council deems it in the best interest of the City to review the dimensional requirements contained within the Municipal Code of the City of Aspen with regard to the construction of structures within the R-6 zone district; and WHEREAS, the City Council deems it to be in the best interests of the City of Aspen, its inhabitants and visitors, to delay the acceptance and/or approval of any building permit application for construction, reconstruction or remodelling of structures within the R-6 zone district until the current provisions and proposed amendments to the Municipal Code of Aspen may be fully studied; and WHEREAS, any review or approval of a specific application would be inadequate unless and until a review of existing zoning ordinances and, if necessary, proposed amendments thereto is completed; and WHEREAS, the City Council has determined that more time is necessary to evaluate the regulation of construction, reconstruc- tion or remodelling in the R-6 zone district in order to avoid the risks and negative aspects which may result therefrom, and therefore, deems it to be in the best interests of the City, its inhabitants and visitors to impose an administrative delay until December 31, 1987, as provided hereinbelow. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 The City Council does hereby authorize an administrative delay until Decemeber 31, 1987, with regard to the acceptance and processing of all applications for building permits in connection with construction, reconstruction or remodelling of structures within the R-6 zone district. The administrative delay shall not apply to approved PUD's in the R-6 zone district. Section 2 The City Manager is hereby directed to implement said administrative delay through the aforementioned period until such time as the administrative delay period expires, is extended, or is lifted as hereinbelow provided. Section 3 This administrative delay may be lifted by resolution of the City Council, either generally or specifically, with respect to an individual application upon a finding by the City Council that the application presented is not within the spirit and intent of this administrative delay as reflected by the proposed amendments to Section 24-3.4, annexed hereto and incorporated herein as Exhibit "A", and that approval of the application will not result in a negative impact. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 5 A public hearing on the ordinance shall be held on the,�-X,'I day of 4�� 1987, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
