AN ORDINANCE APPROVING THE AMENDMENT OF EXHIBIT B TO THE
SUPPLEMENTAL AGREEMENT DATED JUNE 25, 1984, BETWEEN THE CITY OF
ASPEN AND MUNICIPAL ENERGY AGENCY OF NEBRASKA REVISING THE
FORMULA FOR CALCULATING THE NET DEMAND OF THE CITY OF ASPEN
MINUS THE HYDROELECTRIC CAPACITY DURING ASPEN'S PEAK HOUR,
PROVIDING THAT THE REVISED FORMULA BE IMPLEMENTED STARTING WITH
THE SEPTEMBER, 1987, BILLING, AND AUTHORIZING THE MAYOR TO
EXECUTE SAID AMENDMENT ON BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council an
Amendment to Exhibit B to that Supplemental Agreement between the
City of Aspen and Municipal Energy Agency of Nebraska dated June
25, 1984, revising the calculation language to provide for
calculating the net demand of Aspen as the maximum demand minus
the hydroelectric capacity available during Aspen's peak hour
each month.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
Amendment to Exhibit B to the Supplemental Agreement between the
City and Municipal Energy Agency of Nebraska revising the
calculation formula, a copy of which is annexed hereto and
incorporated herein, and does hereby authorize the Mayor to
execute said amendment on behalf of the City of Aspen.
section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
section 4
A public hearing on the ordinance shall be held on the
