AN ORDINANCE AMENDING SECTION 7-215 OF ARTICLE IX OF
THE MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, SO
THAT A PLUMBING PERMIT SHALL NOT BE ISSUED BY THE
BUILDING DEPARTMENT UNLESS PROOF OF PAYMENT FOR NEW OR
ADDITIONAL FIXTURES AUTHORIZED BY A UTILITY CONNECTION
PERMIT OR UTILITY ASSESSMENT PERMIT IS ISSUED BY THE
WATER DEPARTMENT.
WHEREAS, the City Council of the City of Aspen, Colorado
has determined that a plumbing permit shall not be issued by the
Building Department to any person desiring to add or change the
water demand factors as set forth in the Municipal Code of the
City of Aspen, Colorado, until the Building Department receives
proof of payment for the new or additional fixtures authorized by
a Utility Connection permit or a Utility Assessment permit from
the Water Department.
WHEREAS, the Council desires that additional demand factors
be assessed by the current policy guidelines in the water rate
structure as set forth in the Municipal Code of the City of
Aspen, Colorado.
NOW THEREFOR, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section 1
That Section 7-215 of Municipal Code of the City of Aspen,
Colorado, is hereby amended to read as follows:
Sec. 7-215 UTILITY ASSESSMENT OR UTILITY CONNECTION
PERMITS
Any person who desires to connect to the municipal
water utility system or who is already connected to the
municipal water utility system and intends to add or
change a water demand factor or fixture shall pay all
fees related to an utility assessment permit or a
utility connection permit before obtaining a plumbing
permit from the building department. (Section 7-215 a-
g follows)
Section 2
If any section, subsection, sentence, clause, phase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the
day of ~f.~.~.~-~--- , 1988 at 5:00 P.M. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
