ORDINANCE NO./C
AN ORDINANCE ADDING SECTION 7-141(303)(F) TO THE
MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, SO THAT
NO BUILDING PERMIT SHALL BE ISSUED BY THE BUILDING
DEPARTMENT UNLESS PROOF OF PAYMENT FOR NEW OR
ADDITIONAL FIXTURES INCIDENT TO A UTILITY CONNECTION
PERMIT OR UTILITY ASSESSMENT PERMIT IS ISSUED BY THE
WATER DEPARTMENT.
WHEREAS, the City Council of the City of Aspen, Colorado,
requires that any person desiring to connect to the municipal
water utility system or who is already connected to the municipal
water utility system and intends to add or change a water demand
factor or fixtures shall pay all fees related to a utility
assessment permit or a utility connection permit before obtaining
a building permit from the building department.
WHEREAS, the Council desires that additional demand factors
be assessed by the current policy guidelines in the current water
rate structure as set forth in the Municipal Code of the City of
Aspen.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 7-141(303) of the Municipal Code of the City
of Aspen, Colorado, is hereby amended by adding subsection (f)
which said section reads as follows:
"(f) Any person who desires to connect to the municipal
water utility system or who is already connected to the
municipal water utility system and intends to add or
change a water demand factor or fixtures shall pay all
fees related to a utility assessment permit or a
utility connection permit before obtaining a building
permit from the building department."
Section 2
If any section, subsection, sentence, clause, phase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public rearing on the ordinance shall be held on the
/'/g~'J day of ,~_~_~ , 1988 at 5:00 P.M. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
