AN ORDINANCE AMENDING ORDINANCE NO. 60, SERIES OF 1987, BY
ADDING A TRANSFER OF $69,500 FROM THE GENERAL FUND TO THE
WHEELER TRANSFER TAX FUND; APPROPRIATING POLICE PENSION FUND
EXPENSES OF $15,000, RECOGNIZING CASTLERIDGE NOTE RECEIVABLE
FUND REVENUES OF $16,500; TRANSFERRING $10,000 FROM THE
CASTLERIDGE NOTE RECEIVABLE FUND TO THE GENERAL FUND; WHICH
APPROPRIATIONS WERE INADVERTENTLY DELETED FROM SAID
ORDINANCE.
WHEREAS, it has come to the attention of the City Council
that a transfer of $69,500 from the General Fund to the Wheeler
Transfer Tax Fund, appropriating Police Pension Fund expenses of
$15,000, recognizing Castleridge Note Receivable Fund revenues of
$16,500, and transferring $10,000 from the Castleridge Note
Receivable Fund to the General Fund were inadvertently deleted
from the provisions of Ordinance No. 60, Series of 1987, and
WHEREAS, it was the intention of the City Council to
authorize the aforesaid appropriations at the time Ordinance No.
60, Series of 1987, was passed and
WHEREAS, the City Council desires to amend Ordinance No. 60,
Series of 1987, so as to accurately reflect the intention of the
City Council with regard to the aforesaid appropriations, and
WHEREAS, the City Manager has certified that as of the date
of the passage of Ordinance No. 60, Series of 1987, revenues and
funds in excess of those estimated in the budget were available
for appropriation in the General Fund, Police Pension Fund, and
Castleridge Note Receivable Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the title of Ordinance No. 60, Series of 1987, be
amended by adding the following: "AN ORDINANCE AMENDING
ORDINANCE NO. 60, SERIES OF 1987, BY ADDING A TRANSFER OF
$69,500 FROM THE GENERAL FUND TO THE WHEELER TRANSFER TAX FUND;
APPROPRIATING POLICE PENSION FUND EXPENSES OF $15,000;
RECOGNIZING CASTLERIDGE NOTE RECEIVABLE FUND REVENUES OF
$16,500; TRANSFERRING $10,000 FROM THE CASTLERIDGE NOTE
RECEIVABLE FUND TO THE GENERAL FUND".
Section 2
That Section 1 of Ordinance No. 60, Series of 1987, be
amended by inserting the following language after the language
"Electric Fund" and before the language "and unappropriated prior
year fund balance in the General Fund and Asset Replacement Fund,
the City hereby makes supplemental appropriations as itemized in
Exhibit A attached."
"Police Pension Fund, Castleridge Note Receivable Fund"
Section 3
That Exhibit "A" be annexed to Ordinance No. 60, Series of
1987, be amended by the addition of the aforesaid appropriations
for the proposed specified in the amended Exhibit "A" which is
annexed hereto and made a part hereof.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the ~/~
day of ,~-~-~, , 1988, at 5:00 p.m. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
