AN ORDINANCE AMENDING SECTION 23-101 (a) OF THE MUNICIPAL CODE OF
THE CITY OF ASPEN TO ESTABLISH MONTHLY WATER RATES AND CHARGES
FOR METERED, NON-METERED, AND CONSTRUCTION RATE CITY OF ASPEN
WATER CUSTOMERS FOR THE BILLING PERIOD BEGINNING SEPTEMBER 15,
1988, AMENDING SECTION 23-43 (a)5 OF THE MUNICIPAL CODE OF THE
CITY OF ASPEN TO MODIFY THE EXTRAORDINARY WATER USAGE DEFINITION,
REPEALING SECTION 23-43 (a) (7), AMENDING SECTION 23-42 (b) TO
MODIFY THE WEIGHTING FACTORS ASSIGNED TO SERVICE AREAS,
AMENDING SECTION 23-42 (c) TO REMOVE THE OUT-OF-CITY CHARGE AND
DELETE REFERENCE TO UTILITY INVESTMENT CHARGES, AND AMENDING
SECTION 23-58 (b) TO ESTABLISH WEIGHTING FACTORS BY SERVICE AREA
TO BE USED IN CALCULATING UTILITY INVESTMENT CHARGES.
WHEREAS, in 1985 the City Council adopted Ordinance # 27
which endorses the Comprehensive Water Management Plan (WMP) for
the City of Aspen, Colorado, which plan provides, among other
things, for a structure of rates and charges to fully and fairly
recover the costs of water service, including debt service, so
that all costs of such water service are paid by the customers of
such service rather than by general or other city funds; and
WHEREAS, Ordinance # 27 describes the service areas of the
Aspen water utility in Section 23-42 (a) and specifies the
weighting factors assigned to the service areas in Section 23-42
(b) for monthly billing purposes; and
WHEREAS, Ordinance # 27 specifies that the rates for monthly
metered service for the demand, out-of-city service, fire
protection, pumping, and variable charges shall be set according
to the criteria outlined in Section 23-43 on an annual basis; and
WHEREAS, Ordinance # 27 specifies that the rates for monthly
unmetered service shall be set according to the criteria outlined
in Section 23-102 (a) and (b);
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 23-101 of the Municipal Code of the City of
Aspen, Colorado is hereby amended to read as follows:
"Section 23-101 Monthly rates for metered water service.
a) Ail metered customers except temporary construction
accounts shall pay the sum of charges 1) through 5) that
follow:
1) A demand charge of $4.3546 per ECU per month with a
service area factor of 1.0.
2) A variable charge of $1.1682 per thousand gallons of
ordinary water use per month.
3) A variable charge of $1.7522 per thousand gallons of
extraordinary water use per month in the months of May 15
through September 15, such charge being increased to
$2.3364 in the remaining months of the year.
4) A pumping charge of $.7200 per thousand gallons pumped
per month with service per one pump station.
5) A fire protection charge of $.0720 per ECU per month
with a service area factor of 1.0.
b) Construction accounts shall pay demand, out-of-city (if
applicable), and fire protection charges at the same
rates as above for metered customers. Variable and
pumping charges will be waived for a maximum of six
months, or the duration of the construction project,
whichever is less. Construction account ECU's will be
based on information shown on the building permit."
Section 2
That Section 23-43, Subsection (a)5, of the Municipal Code
of the City of Aspen, Colorado is hereby amended to read as
follows:
"Section 23-43 (a)5:
Monthly water use in excess of 15,000 gallons per month
per ECU shall be considered extraordinary water use in all
months except May 15 through September 15, when
extraordinary use shall be use in excess of 30,000 gallons
per month per ECU. The monthly variable charge shall be
two times the amount charged for ordinary water use in all
months except May 15 through September 15, when the monthly
variable charge shall be one and one half times the amount
charged for ordinary water use."
Section 3
That Section 23-43 (a) 7 is hereby repealed.
Section 4
That Section 23-42, Subsection(b), of the Municipal Code of
the City of Aspen, Colorado is hereby amended to read as follows:
"Section 23-42 (b):
Annual debt service and other annual fixed costs approved
for the water system shall be allocated among service areas
in accordance with the following weighting factors:
Service Area Weighting Factor
1 ............................. 1.00
2 ............................. 2.00
3 ............................. 2.00
4 ............................. 1.25
5 ............................. 1.50
6 ............................. 2.00
7 ............................. 1.50 "
Section 5
That Section 23-42, Subsection (c), of the Municipal Code of
the City of Aspen, Colorado is hereby amended to read as
follows:
"Section 23-42 (c):
The service area weighting factors in paragraph (b) shall be
applied in calculating the demand and fire p r o t e c t ion
charges under sections 23-101 and 23-102, except a s
otherwise provided herein."
Section 6
That Section 23-58, Subsection (b), of the Municipal Code
of the City of Aspen, Colorado is hereby amended to read as
follows:
"Section 23-58 (b):
The total utility investment charge for a customer shall be
the customer's ECU rating multiplied by the base charge in
paragraph (a) and by the service area weighting factor
provided by the table shown below for the service area in
which the customer is located.

Section 7
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 8
A public hearing on the ordinance shall be held on the

Council Chambers, Aspen City Hall, Aspen, Colorado.
