ORDINANCE NO. 43
(Series of 1988)
AN ORDINANCE OF THE CITY OF ASPEN, COLORADO, SETTING THE ANNUAL
FINE SCHEDULE FOR ORDINANCE NO. 38 (SERIES OF 1988)
WHEREAS, Ordinance No. 38 (Series of 1988) requires City
Council to approve each year an annual fee schedule for viola-
tions of the aforementioned act; and
WHEREAS, the City Council desires to set the fine schedule
for the winter of 1988-89.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the fine schedule for the winter of 1988-89 for
violations of Ordinance No. 38 (Series of 1988), the mandatory
odd/even no-burn ordinance is hereby set as follows:
(a) For a first offense at a given address, a verbal
warning shall be issued by the Environmental Health Department if
possible.
(b) For a second offense and for each additional offense at
a given address, a written warning shall be sent to the renter,
if known, and to the owner and property manager.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
Section 4
A public hearing on the ordinance shall be held on the ~?~
